HomeMy WebLinkAboutRES 06-06RESOLUTION NO.06-06 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING A PRELIMINARY SUBDIVISION PLAT,FOR A SINGLE-FAMILY RESIDENTIAL SUB- DIVISION.IN CASE SD -5-05,BY DOWN TO EARTH PROPERTIES, LLC,REPRESENTED BY DURAN THOMPSON OF D & M ENGINEERING. WHEREAS,the subdivider in Case SD -5-05 proposes to subdivide portions of APN 103-20-015,approximately 5 gross acres,into 16 residential lots pursuant to Arizona Revised Statutes ("A.R.S.")Title 9,Chapter 4,Article 6.2,and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance, Section 15.0400,CR-3 Single -Family Residence Zone,Section 19.0101 Planned Development Zoning. District,and Chapter 2,Subdivision Regulations.The property is legally described as: The North half of the Southeast quarter of the Northwest quarter of the Southwest quarter of Section 27,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona,more specifically described in Case SD -5-05;and WHEREAS,on January 17,2006,the Mayor and City Council of the City of Apache Junction approved Ordinance No.1256 for rezoning Case PZ-21-05.to change the zoning district classification from General Rural ("GR")to Single -Family Residence Zone through Planned Development ("CR-3/PD")for the property,by a vote of 7 to 0;and WHEREAS,on February 28,2006,the Planning and Zoning Commission held a public hearing regarding the preliminary plat for Case SD -5-05 and recommended approval by a vote of 5 to 0;and WHEREAS,this City Council finds this preliminary subdivision plat to be in compliance with the Apache Junction City Code,Volume II, Land Development Code,Chapter 1,Zoning Ordinance,Section 15.0400, CR-3/PD,Chapter 2.Subdivision Regulations,and Ordinance No.1256, which authorized the rezoning for the property. RESOLUTION NO.06-06 PAGE 1 OF 3 NOW.THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: The preliminary subdivision plat for the above described property be approved,subject to the following stipulations: 1)All standard CR-3 zoning requirements and other conditions as prescribed by Ordinance No.1256 shall be observed during the construction of the subdivision and the lots therein. 2)A minimum of three model types with three front elevation variations each shall be presented along with the final plat and improvement plans submittal. 3)The abandonment of the S.Vista Road alignment for roadway and utility purposes shall be completed prior to final plat approval. 4)All applicable development fees shall be paid at the time of permits issuance. 5)The developers shall complete the street improvements prior to home construction or shall otherwise provide for water supply and all weather access for fire apparatus,subject to the approval of the Fire Marshal.
