A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,APPROVING A PRELIMINARY PLAT,FOR
IRONWOOD TRAILS,A RESIDENTIAL SINGLE FAMILY SUBDIVISION,IN
CASE SD -4-05,BY TANA NICHOLS,REPRESENTING HABITAT FOR
HUMANITY.
WHEREAS,the subdivider in Case SD -4-05 proposes to subdivide Pinal
County Assessor's Parcel Number ("APN")100-35-028,a 5 -gross acre,into
18 residential lots,pursuant to Arizona Revised Statutes ("A.R.S.")
Title 9,Chapter 4,Article 6.2,and pursuant to the Apache Junction City
Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,
Section 15.0400,CR-3 Single Family Residence Zone,Section 19.0101,
Planned Development Zoning District,Chapter 2,Subdivision Regulations.
The property is legally described as:
The South half of the Northwest quarter of the Southwest
quarter of the Southeast quarter of Section 18,Township
1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Pinal County,Arizona:and
WHEREAS,on July 19,2005,the Mayor and City Council of the City of
Apache Junction approved Ordinance No.1240,for zoning Case PZ-7-05,to
change the zoning district classification from General Rural Residence
Zone ("GR")to Minimum 7,000 square feet lot Single -Family Residence Zone
through Planned Development ("CR-3/PD")by a vote of 6 to 0.
WHEREAS,on March 28,2006,the Planning and Zoning Commission held a
public hearing regarding the preliminary plat for Case SD -4-05 and
recommended approval 5 to 0:and
WHEREAS,the City Council finds this preliminary subdivision plat to be
in compliance with the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance,Section 15.0400,CR-3
Single Family Residence Zone,Section 19.0101,Planned Development Zoning
District,Chapter 2,Subdivision Regulations:and Ordinance No.1220
which authorized the preliminary plat for the property.

NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
The preliminary subdivision plat for Ironwood Trails (APN 100-35-028)be
approved,subject to the following stipulations:
1)The developers shall pay all applicable City of Apache
Junction development fees prior to the issuance of
building permits.
2)The developer shall provide a decorative masonry wall
along the Ironwood frontage.All other walls,external
and internal to the site are encouraged to be painted
in neutral desert tones.
3)Garages and carports may not be converted into habitable
space.
4)Homes with identical exterior elevations,including
reversed identical exterior elevations,may not be
located next to or across the street from each other.
5)Upon the formation of a Homeowners Association ("HOA"),
said HOA will provide the City of Apache Junction
with a complete and accurate copy of the adopted
codes,covenants and restrictions.
6)The open space,including retention areas and street
side,and right-of-way landscaping (common areas)
will be perpetually maintained by the HOA or by
Habitat for Humanity until the HOA is created.Any
dead plant material in common areas will be replaced
by HOA or Habitat for Humanity,and any dead plant
material in the required front yards will be replaced
by private property owners.All replaced plant material
in the subdivision must meet approved landscaping plans as
on file in Case SD -4-05.
7)Open space/retention areas shall not be constructed
upon,otherwise obstructed,or used in any manner

inconsistent with their purpose.An exception will be
made for playground equipment that does not require
a concrete base to be poured.
8)All wall and trim colors on homes shall be consistent
with the approved color palette or can only be changed
to earth tones.
9)All design elevations on house plans must include the
quality of architectural features included on the homes
in the presentation to City Council on July 19,2005.
Each house shall include no less than one of the following:
archways on front porches,window pop outs,decorative trim,
stained wood trim,and small metal or pilaster ornaments to
break up large expanses of blank wall.
10)Housing plans being used for the Building Blitz may be
submitted separately from the other housing plans,and are
not required to contain the flat roof plane elevations shown
in the presentation to City Council on July 19,2005.This
will facilitate Habitat for Humanity in their ability to
complete their necessary housing plans in time for the Building
Blitz in June.
