A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,RE -APPROVING AN EXPIRED PRELIMINARY
SUBDIVISION PLAT FOR QUAIL CREEK VILLAS,PHASES TWO AND THREE,
CASE SD -4-02,ORIGINALLY PRE -PLATTED BY DRY CREEK PARTNERSHIP
AND REPRESENTED BY PAT LANNAN OF DEL PUEBLO HOMES.
WHEREAS,the new subdivider in Case SD -4-02,Apache Junction Town
Square,L.L.C.,proposes to subdivide two parcels,a combined 19.68
gross acres in the East half of the Southeast quarter of Section 17,
Township 1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Pinal County,Arizona,into 244 residential condominium lots,
pursuant to Arizona Revised Statutes ("A.R.S."),Title 9,Chapter 4,
Article 6.2,and pursuant to the Apache Junction City Code,Volume II,
Land Development Code,Chapter 1,Zoning Ordinance,Article 19,Planned
Development Zoning District,and Chapter 2,Subdivision Regulations;
and
WHEREAS,on August 6,2002,the Mayor and City Council of the
City of Apache Junction approved Ordinance No.1155 which amended the
Planned Development concept plan originally approved under Ordinance
No.456 for the property by a vote of 6 to 1;and
WHEREAS,on February 25,2003,the Planning and Zoning Commission
held a public hearing regarding the preliminary plat for Case SD -4-02
and recommended approval of Case SD -4-02 by a vote of 7 to 0;and
WHEREAS,on April 1,2003,the Mayor and City Council of Apache
Junction held a public hearing regarding the preliminary plat for Case
5D-4-02,Quail Creek Villas,Phases Two and Three,and approved said
preliminary plat pursuant to Resolution No.03-08;and
WHEREAS,pursuant to the Apache Junction City Code,Volume II,
Land Development Code,Chapter 2,Subdivision Regulations Section
2.04.7(b),the preliminary plat expired prior to the submittal of the
final plat application;and
WHEREAS,the City Council finds that the preliminary plat for
Quail Creek Villas,Phases Two and Three,as conceptually approved by
Ordinance No.1155,Case PZ-6-01,and with the same conditions as set

forth in Resolution No.03-08,must be re -adopted prior to considering
the final plat for approval;and
WHEREAS,this City Council finds this preliminary subdivision
plat to be in compliance with the Apache Junction City Code,Volume II,
Land Development Code,Chapter 1,Zoning Ordinance and Chapter 2,
Subdivision Regulations,and Ordinance No.1155,which authorized the
preliminary plan for the property.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that:
The preliminary subdivision plat for Quail Creek Villas,Phases Two and
Three,be approved with the following conditions:
1)All stipulations of Ordinance No.1155 are in full force
and effect and shall govern the design of the final
subdivision plat,final improvement plans,and construction
of improvements.
2)Within one year of preliminary plat approval,the applicants
shall submit for formal review a final subdivision plat and
improvement plans for the proposed development.
3)Trash guards shall be installed at the openings of all
drainage culvert pipes to be installed in Phases Two and
•Three.
4)Final landscape improvement plans shall be submitted for
review and recommendation to City Council,City Parks and
Recreation Department,and Planning Division.
5)The applicants shall provide a pool in Phase Two with a water
area no less than 600 square feet in size.
