A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,APPROVING THE PRELIMINARY SUB-
DIVISION PLAT FOR VILLAGIO SUBDIVISION,CASE SD -2-06,BY
DONNA AXT GOLD REALTY,LLC,REPRESENTED BY CLIFF AXT AND
TERRY GALLOWAY.
WHEREAS,the sub -divider in Case SD -2-06 proposes to subdivide a
parcel,approximately 4 gross acres in the Northeast quarter of the
Southwest quarter of Section 30,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Pinal County,Arizona,into 21
court home units,pursuant to Arizona Revised Statutes (A.R.S.),Title
9,Chapter 4,Article 6.2,and pursuant to the Apache Junction City
Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,
Article 19,Planned Development Zoning District,and Chapter 2,
Subdivision Regulations;and
WHEREAS,on May 16,2006,the Mayor and City Council of the City
of Apache Junction approved Ordinance No.1268 which rezoned the
property and approved the Planned Development concept plan;and
WHEREAS,on April 25,2006,the Planning and Zoning Commission
held a public hearing regarding the preliminary plat for Case SD -2-06
and recommended approval of Case SD -2-06 by a vote of 5 to 0;and
WHEREAS,this City Council finds this preliminary subdivision plat
to be in compliance with the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance and Chapter 2,
Subdivision Regulations,and Ordinance No.1268,which authorized the
preliminary plan for the property.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that:
The preliminary subdivision plat for Villagio subdivision be approved
with the following conditions:

1)All stipulations of concurring Ordinance No.1268 shall
govern the design and subsequent improvements of the Final
Subdivision Plat.
2)Within one year of Preliminary Subdivision Plat Approval,the
applicants shall submit for formal review of the Final
Subdivision Plat for the proposed development.
3)Street improvements,such as extension of pavement and the
provision of sidewalk,curb,gutter and streetlights,
normally required shall be required as part of the planned
development rezoning.
4)The community ramada amenity shall be shaded for the
mitigation of summer heat by drought -tolerant,low-water
using trees.Specifically,either thirty-six inch (36")box
Ironwoods or twenty-four inch (24")box Rio Solado Mesquites.
The Ironwood representing the first choice,as i t is slow
growing and the Mesquite as a secondary option,as i t is
resistant to high winds.
5)The perimeter of the development adjacent to 16' Avenue shall
be completely landscaped,with a maximum of fifty percent
(50%)of the area set aside for retention applications.A
wall shall be built to reduce traffic noise and to screen the
development from the road.
6)The proposed houses shall include southwestern architectural
features as illustrated in the city's Design Guidelines,
shall offer ground mounted air conditioning units and
architectural treatments on all four sides of the buildings
so as to preclude flat or blank facades,including pop -outs
and roofline and color variations to add visual interest.
7)Front yard xeriscape landscape packages shall be provided
with the development of the lots,to include a minimum of two
twenty-four inch (24")box trees,four 5 -gallon shrubs and
groundcovers and decomposed granite as specified in the City
of Apache Junction Landscape and Screening Requirements.
8)All applicable permits shall be applied for and plans shall

be designed to current city codes prior to any building
removal,lot grading or construction on the lots.
Inclusively,all applicable development fees shall be paid
at the time of permits issuance.
9)The twenty-eight foot (28')wide private access way created
pursuant to Resolution No.05-11 shall be rescinded on the
Final Subdivision Plat drawing and be replaced with the
public street known as Desert View Place.
10)The existing property owner at the southwest corner of the
proposed development shall be allowed unrestricted ingress
and egress to his property during construction and shall have
right to use the public street after i t is constructed.
11)Street -side landscaping shall be provided in the right-of-way
on the northerly side of parcel number 102-18-002B.
