A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION COMMITTING LOCAL FUNDS AS
LEVERAGE FOR A FY 2006 COMMUNITY DEVELOPMENT BLOCK GRANT
APPLICATION.
WHEREAS,the City of Apache Junction i s desirous of
undertaking community development activities;and
WHEREAS,the City of Apache Junction has adopted Resolution
Number 05-34 which authorizes the submission of an application to
the State of Arizona Department of Housing ("ADOH")for Community
Development Block Grant ("CDBG")Regional Account funds for FY
2006;and
WHEREAS,the application indicates that $107,084 will be
committed by the City of Apache Junction as leveraged funds,in
the form of cash or resources to be used to implement Activity
Number 2:Purchase of communications equipment for the Apache
Junction Police Department;and
WHEREAS,the CDBG Program requires that all local leveraged
funds/resources be committed in the form of a resolution by the
governing body,and that such a commitment contain an opinion by
the applicant's legal counsel that the leveraged funds represent
a binding commitment,legally enforceable under State laws,
NOW,THEREFORE,BE IT RESOLVED that the Mayor and Council
hereby commit $107,084 to the CDBG Program,to be used for the
following:Activity Number 2:Purchase of communications
equipment for the Apache Junction Police Department,for staff
support,and the payment of monthly user fees,contingent upon
the receipt of the FY 2006 CDBG assistance;and that the Mayor
and Council of the City of Apache Junction hereby state that this
commitment i s legally binding based on the legal opinion of the
City Attorney,and that such funds will be available for an audit
at the termination of the grant,i f so required by ADOH.
