A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,APPROVING A PRELIMINARY
PLAT, FOR SUPERSTITION MOUNTAIN ESTATES, A RESIDENTIAL
SINGLE FAMILY SUBDIVISION,IN CASE SD -3-05,BY FRANK
DELL'ARMI, REPRESENTING TOMAHAWK 20 LLC.
WHEREAS, the subdivider in case SD -3-05 proposes to
subdivide Pinal County Assessor's Parcel Numbers 100-25-006,
100-25-007, 100-25-008, and 100-25-017 into 16 residential lots,
pursuant to Arizona Revised Statutes ("A.R.S.") Title 9, Chapter
4, Article 6.2, and pursuant to the Apache Junction City Code,
Volume II,Land Development Code,Chapter 1,Zoning Ordinance,
Section 15.1.0100,R1-43 Single Family Residence Zone,Chapter 2,
Subdivision Regulations,20 gross -acres legally described as
follows:
Pinal County Assessor's Parcel Number 100-25-017, the
North half of the Southwest quarter of the Northwest
quarter of the Northwest quarter of Section 15 of
Township 1 North, Range 8 East, of the Gila and Salt
River Base and Meridian, Pinal County, Arizona.
5.00 Acres.
Pinal County Assessor's Parcel Number 100-25-006, the
North half of the Northeast quarter of the Northwest
quarter of the Northwest quarter of Section 15 of
Township 1 North, Range 8 East, of the Gila and Salt
River Base and Meridian, Pinal County, Arizona.
5.00 Acres.
Pinal County Assessor's Parcel Number 100-25-007, the
North half of the Northwest quarter of the Northwest
quarter of the Northwest quarter of Section 15 of
Township 1 North, Range 8 East, of the Gila and Salt
River Base and Meridian, Pinal County, Arizona.
5.00 Acres.
Pinal County Assessor's Parcel Number 100-25-008, the
South half of the Northwest quarter of the Northwest
quarter of the Northwest quarter of Section 15 of
Township 1 North, Range 8 East, of the Gila and Salt
River Base and Meridian, Pinal County, Arizona.
5.00 Acres.; and
WHEREAS, on May 23, 2006, the Planning and Zoning Commission
held a public hearing regarding the preliminary plat for SD -3-05
and recommended approval by a vote of 5 to 0; and

WHEREAS, the City Council finds this preliminary subdivision
• plat to be in compliance with Apache Junction City Code,Volume
II,Land Development Code,Chapter 1,Zoning Ordinance,Section
15.1.0100,R1-43 Single Family Residence Zone,and Chapter 2,
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council
of the City of Apache Junction, Arizona, that the preliminary
subdivision plat for Superstition Mountain Estates be approved,
subject to the following stipulations:
1)The final plat and improvement plans shall conform
substantially with the approved preliminary plat.
2)The developers shall pay all applicable development
fees prior to the issuance of building permits.
3)Within one year of Preliminary Plat approval, the
applicants shall submit for formal review a Final
Subdivision Plat and Improvement Plans for the
proposed development.
3)Any use or development of said property is conditioned
upon the provision of public improvements, a
decorative masonry perimeter wall, and landscaping
in accordance with the landscape and screening
regulations of the City, and amendments thereto. The
provisions of the Uniform Building Code, Uniform
Fire Code (including, but not limited to, the
provision of sufficient fire apparatus access roads,
the marking of fire lanes and the provision of
adequate water supplies, and fire hydrants),
Engineering Guidelines and all other city codes,
policies, guides, and standards shall apply and
control all design and construction of improvements.
4)Upon the formation of a Homeowners Association, said
Homeowners Association will provide the City of
Apache Junction with a complete and accurate copy of
the accepted codes and covenants and restrictions
adopted by such Homeowners Association.
5)The open space, including retention areas and street
landscaping will be perpetually maintained by adjacent
property owners, or by the developer, its heirs,
successors, assignees, or other acceptable arrangement
that legally binds the assuming entity or individuals
to open space maintenance.Said open space/retention
areas shall not be constructed upon, otherwise

obstructed or used in any manner inconsistent with
their platted purpose.
7)The property owners shall dedicate and improve to
the City Engineer's standards any necessary rights-
of -way internal and external to this site.Said
improvements may include, but not necessarily be
limited to, the provision of curbs, gutters, side-
walks, driveways, streetlights, and retention basins.
8)The narrow street fronting side of each lot shall be
considered its front yard.
