A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AMENDING THE FINAL
SUBDIVISION PLAT FOR THE "IDAHO CREEK VILLAS - PHASE
TWO" TOWNHOMES SUBDIVISION, IN CASE SD -4-02, BY A.J.-
NEW ARIZONA VENTURES, LLC, REPRESENTED BY STUART
FARBER AND RICK TYNER.
WHEREAS, on August 6, 2002, the Mayor and City Council
of the City of Apache Junction approved Ordinance No. 1155,
which amended the Planned Development concept plan for the
remaining parcels of the original "Quail Creek Apartments"
project approved under Ordinance No. 456, by a vote of 6-1;
and
WHEREAS, on February 25, 2003, the Planning and Zoning
Commission held a public hearing regarding the preliminary
plat for SD -4-02, proposing to subdivide the above noted
parcels and naming the new development "Idaho Creek Villas
- Phases Two and Three", and recommended approval by a vote
of 7 to 0; and
WHEREAS, on April 1, 2003, the Mayor and City Council
approved Resolution No. 03-08 approving the Preliminary
Plat for case SD -4-02, by a vote of 7 to 0; and
WHEREAS, on May 2, 2006 the Mayor and City Council
approved Resolution Nos. 06-14 and 05-07, re -approving the
expired preliminary plat approved under Resolution No. 03-
08, and approving the final subdivision plat for "Idaho
Creek Villas - Phases Two and Three", respectively; and
WHEREAS, the new owners/developers of Idaho Creek
Villas - Phases Two and Three propose to amend the
previously approved final plat for Idaho Creek Villas -
Phase Two, originally approved under case number SD -4-02
(Resolution No. 05-07), to reflect new ownership
information, to rename the subdivision from "Idaho Creek
Villas - Phase Two" to "The Villas at Superstition Mountain
- Phase Two", and to add names to the private streets
within, but to make no changes to platted lots and tracts;
and

WHEREAS, the new owners/developers propose to make
aesthetic improvements to the main entry way off of Idaho
Road, in the form of upgraded landscaping, berms,
curvilinear walls with view -fencing, decorative pavers, and
automatic iron gates; and in the central common area, the
developers propose a larger swimming pool, the addition of
a wading pool and spa, and other recreational features,
instead of the clubhouse and smaller pool originally
proposed; and
WHEREAS, the Phase Two property is presently legally
described as:
Idaho Creek Villas - Phase Two, as recorded in Cabinet
G, Slide 58, in the records of the Office of the
County Recorder of Pinal County, Arizona; and
WHEREAS, this City Council finds this final
subdivision plat to be in compliance with the Apache
Junction City Code,Volume II,Land Development Code,
Chapter 1,Zoning Ordinance and Chapter 2,Subdivision
Regulations,and Ordinance 1155, which authorized the
preliminary plan for the property.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The final subdivision plat for "Idaho Creek Villas - Phase
Two" is hereby amended for the purposes described herein
and is renamed as, "The Villas at Superstition Mountain -
Phase Two", subject to the following condition:
1) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department revised improvement and landscape
plans for the new entry -way and central common area
facilities.

CITY OF APACHE JUNCTION, ARIZONA, THIS 20TH DAY OF
