A RESOLUTION OF THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION,ARIZONA,
APPROVING THE FINAL PLAT FOR SUPERSTITION
BIG BOY'S TOYS,A 123 CONDOMINIUM UNIT
STORAGE SUBDIVISON,IN CASE SD -3-07 BY
SUPERSTITION BIG BOY'S TOYS LLC.
WHEREAS,the sub -divider in Case SD -3-07 proposes to
subdivide Pinal County Assessor's Parcel Number 102-21-
018A,(approximately 5 gross acres)into 123 condominium
unit storage subdivision lots,pursuant to Arizona Revised
Statutes (A.R.S.), Title 9 Chapter 4, Article 6.2,and the
Apache Junction City Code,Volume II,Land Development
Code,Chapter 1,Zoning Ordinance,Article 19,Planned
Development Zoning District,and Chapter ,2,Subdivision
Regulations,legally described as follows:
The north half of the Northwest quarter of the
Southeast quarter of the Northwest quarter of
Section 33, Township 1 North, Range 8 East of
the Gila and Salt River Base and Meridian,
Pinal County, Arizona; and
WHEREAS,on November 20,2007,the Apache Junction
Planning and Zoning Commission held a public hearing
regarding the preliminary plat for Case SD -3-07 and
recommended approval by a vote of 6 to 0; and
WHEREAS,on January 15,2008, the City Council held a
public hearing regarding the preliminary plat for Case SD-
3 -07 and voted to approve the preliminary plat for Case SD-
3 -07 by a unanimous vote; and
WHEREAS,the Mayor and City Council finds this final
subdivision plat to be in compliance with the Apache
Junction City Code,Volume II,Land Development Code,
Chapters 1,and Chapter 2,Zoning Ordinance,Subdivision
Regulations,as well as with the requirements of Ordinance
No. 1314.

NOW,THEREFORE,be it resolved by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The final subdivision plat for Superstition Big Boy's Toys
Subdivision is approved subject to the following conditions:
1)The improvement plans shall conform substantially
with the approved preliminary plat.
2)The Arizona Department of Environmental Quality
Sewer Approval Letter must be received by the
City of Apache Junction before the final plat is
signed by the Mayor.
3)Staff shall, pursuant to Arizona Revised Statutes
9-463.01(J), record the Final Plat with the Pinal
County Recorder and shall collect the Final Plat
recording fee from Superstition Big Boy's Toys LLC
and remit such amount to the Pinal County Recorder.
