A RESOLUTION -OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,REAFFIRMING ITS INTEREST
IN ANNEXING FIFTY ACRES LOCATED IN SECTION 18,
TOWNSHIP I SOUTH,RANGE 8 EAST, FOR THE ELLIOT AVENUE
REALIGNMENT,EAST OF MERIDIAN DRIVE,PINAL COUNTY,
ARIZONA.
WHEREAS,on June 17,2008,the Mayor and City Council
directed the City Manager to send a letter to the Arizona State
Land Department ("ASLD")Commissioner advising that the City was
requesting the ASLD Selection Board approve the City of Apache
Junction's annexation request for a 32 -acre parcel of land
located in unincorporated Pinal County to facilitate the
realignment of Elliot Avenue; and
WHEREAS, the final draft of said letter was conveyed to the
ASLD, through the State Land Commissioner on September 25, 2008;
and
WHEREAS, this request was made in furtherance of the City's
planning efforts in the Portalis Master Planned Community area
south of U.S. 60; and
WHEREAS, recently,pursuant to A.R.S. § 9-471 et seq.,the
area was expanded to roughly 50 acres from the original 32 acres
in order to comply with the dimensional requirements of A.R.S. §
9-471(H) (2)(see Exhibits A and B for current annexation area
description and drawing thereof)(the "Property"); and
WHEREAS, while some time has passed since the original 2008
request,the City s t i l l has such interest in annexation of the
Property; and
WHEREAS, the Selection Board, established pursuant to A.R.S.
§ 37-202,is currently scheduled to meet on November 5, 2009 to
consider the City's request purSuant to A.R.S. § 9-471(A).
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION ARIZONA, AS FOLLOWS:
The Mayor and City Council reaffirms its September 25,2008
annexation request for the property as newly described in
Exhibit A and depicted in Exhibit B, as expanded from 32 acres
to 50 acfes, to meet dimensional requirements of A.R.S.§ 9-

471(H), and the Mayor and City Council intend, once permission
to annex is received from the Selection Board and ASLD
Commissioner, to pursue any: and all neCeSsary steps under A.R.S.
§ 9-471 et seq..to complete the annexation process,including
the filing of an annexation petition with Pinal County and
scheduling hearings and consideration of a Final Annexation
'Ordinance.
