A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE
SUBMISSION OF AN APPLICATION FOR THE BROWNFIELDS
PROGRAM FOR ENVIRONMENTAL ASSESSMENT THROUGH THE
ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY
BROWNFIELDS STATE RESPONSE GRANT PROGRAM AND
CERTIFYING THAT THE APPLICATION:(1) MEETS THE
COMMUNITY'S IDENTIFIED ENVIRONMENTAL ASSESSMENT NEEDS;
AND (2) IS NECESSARY FOR IMPLEMENTATION AND COMPLETION
OF THE ACTIVITIES OUTLINED IN THE APPLICATION.
WHEREAS, the City of Apache Junction is desirous of
undertaking economic development activities; and
WHEREAS, the State of Arizona is administering the
Environmental Quality Brownfields State Response Grant Program
("State Brownfields Program"); and
WHEREAS, the State Brownfields Program requires that the
requested Brownfield funds address community social,
environmental, and economic needs; and
WHEREAS, the activities within this application help to
address the community's identified economic development needs;
and
WHEREAS, a grantee of State Brownfields Program funds is
required to comply with the Program guidelines and federal
statutes and regulations.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction Arizona, as follows:
SECTION 1:
Staff is authorized to submit an application to the State of
Arizona Department of Environmental Quality, and that the City
Manager, or his designee, is authorized to sign the application,
contracts and grant documents for receipt and use
of State Brownfield Program funds for:

A Phase I and Phase II Environmental Site Assessment on a
plot of State Trust land that is bounded by the Meridian
Drive alignment to the west, Ironwood Road to the east, a
Pinal county industrial island to the south (i.e. Houston
Avenue) and Baseline Road to the north.
SECTION 2:
The City Manager, or his designee, is authorized to take any and
all actions necessary to implement and complete the activities
submitted in the application.
SECTION 3:
The application for State Brownfields Program funds furthers the
needs under State guidelines for addressing community needs.
SECTION 4:
The City of Apache Junction shall comply with all State
Brownfield Program guidelines, federal statutes and regulations
applicable to the State Brownfield Program and certifications
contained in the applications.
