A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, APPROVING A FINAL SUBDIVISION
PLAT FOR "APACHE JUNCTION TOWNHOMES", IN CASE SD -1-11, BY
PATHFINDER TRF THREE LLC AND ADAMS CONSTRUCTION COMPANY,
REPRESENTED BY BEUS GILBERT PLLC.
WHEREAS, the sub -divider in Case SD -1-11 proposes to amend
and rename the subdivision presently known as "The Villas at
Superstition Mountain Phase 2", under the new name of "Apache
Junction Townhomes"; and to decrease the density and intensity
of the subdivision from 197 two-story townhome units into 88
one-story townhome units, constructed mostly as duplexes,
pursuant to Arizona Revised Statutes ("A.R.S.") Title 9, Chapter
4, Article 6.2, and pursuant to the Apache Junction City Code,
Volume II,Land Development Code,Chapter 1,Zoning Ordinance,
Section 1-15-9 CR-5 Multiple -Family Residence Zone,Article 1-19
Planned Development Zoning District,and Chapter 2,Subdivision
Regulations;and,
WHEREAS, the property is presently legally described as
follows:
Lots 1 through 197, inclusive, and Tracts A through D,
inclusive, of The Villas at Superstition Mountain Phase 2,
according to the plat recorded in Cabinet H, Slide 29,
records of Pinal County, Arizona; and
WHEREAS, on February 21, 2012, the Mayor and City Council
of the City of Apache Junction approved planned development
major amendment case PZ-3-11, Ordinance No. 1379, to change the
plan of development for the 14.22 net acres, CR-5/PD (Multi-
family Residences/Townhomes by Planned Development) -zoned
property upon a recommendation for approval with conditions from
the Planning and Zoning Commission; and
WHEREAS, on February 21, 2012, the Mayor and City Council
of the City of Apache Junction approved the proposed preliminary
plat request for the renaming and re -platting of the
subdivision, case SD -1-11, Resolution No. 12-03, upon a
recommendation for approval with conditions from the Planning
and Zoning Commission; and

WHEREAS, also on February 21, 2012, the City Council held a
public hearing regarding the final plat for "Apache Junction
Townhomes", case SD -1-11; and
WHEREAS, this City Council now finds the final subdivision
plat for "Apache Junction Townhomes" to be in substantial
compliance with A.R.S. Title 9, Chapter 4, Article 6.2, and
pursuant to the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance,Section 1-15-9
CR-5 Multiple -Family Residence Zone,Article 1-19 Planned
Development Zoning District,Chapter 2,Subdivision Regulations,
and Ordinance No. 1379 which approved the planned development
major amendment for the property.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The final subdivision plat for "Apache Junction Townhomes" is
hereby approved, subject to the following conditions:
1) The final plat mylar map drawings shall not be recorded
until the developer submits to the city's Public Works
Engineering and Development Services Departments, for
review, possible revisions and approval, the following
items:
a) Subdivision improvement plans drawings incorporating all
requested revisions; and
2) The final plat mylar map drawings shall not be recorded
until the developer submits for review and approval, the
following items:
b) Construction assurance bond;
c) Copy of Assured Water Supply Certificate from the Arizona
Department of Water Resources;
d) Copy of Approval to Construct Potable Water and Sewer
from the Arizona Department of Environmental Quality;
e) Copy of Notice of Intent for AZPDES from the Arizona
Department of Environmental Quality; and
3) Upon compliance with Conditions 1 and 2 above, Staff is
directed pursuant to A.R.S. Section 9-463.01(J) to record

the final plat with the Pinal County Recorder and to
collect the final plat recording fee from the subdivider
and remit such amount to the Pinal County Recorder.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, THIS 21ST DAY OF
FEBRUARY , 2012.
