A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AMENDING THE FINAL SUBDIVISION
PLAT FOR "THE VILLAS AT SUPERSTITION MOUNTAIN PHASE 2", BY
APPROVING A NEW PRELIMINARY SUBDIVISION PLAT, PROPOSING TO
RENAME AND RE -PLAT THE FORMER SUBDIVISION UNDER THE NEW
NAME "APACHE JUNCTION TOWNHOMES", IN CASE SD -1-11, AS
REQUESTED BY PATHFINDER TRF THREE LLC AND ADAMS
CONSTRUCTION COMPANY, REPRESENTED BY BEUS GILBERT PLLC.
WHEREAS, on August 6, 2002, the Mayor and City Council of
the City of Apache Junction approved Ordinance No. 1155, which
amended the planned development concept plan for the two
remaining phases of the original "Quail Creek Apartments"
project (approved under Ordinance No. 456), under the new name,
"Idaho Creek Villas Phase 2 and 3", by a vote of 6-1; and
WHEREAS, on February 25, 2003, the Planning and Zoning
Commission held a public hearing regarding a proposed
preliminary plat for the Phase 2 and 3 properties noted above,
case SD -4-02, proposing to subdivide said properties for
condominium units under the name of "Idaho Creek Villas Phase 2
and 3", and recommended approval of the preliminary plat by a
vote of 7 to 0; and
WHEREAS, on April 1,2003, the Mayor and City Council
approved Resolution No.03-08 approving the preliminary plat for
case SD -4-02, by a vote of 7 to 0; and
WHEREAS, on May 2,2006 the Mayor and City Council approved
Resolution Nos. 06-14 and 05-07, re -approving the expired
preliminary plat approved under Resolution No. 03-08, and
approving the final subdivision plat for "Idaho Creek Villas
Phase 2 and 3", respectively; and
WHEREAS, on March 20, 2007, Resolution No. 07-14 was passed
and adopted by the Mayor and City Council, approving a major
amendment to the final plat for "Idaho Creek Villas Phase 2",
reflecting new ownership,renaming the subdivision as "The
Villas at Superstition Mountain Phase 2", assigning names to the
interior private streets and approving other minor changes
pertaining to interior and exterior amenities and improvements;
and

WHEREAS, presently, the new owners of "The Villas at
Superstition Mountain Phase 2" propose to amend the final plat
for said subdivision by renaming it "Apache Junction Townhomes"
and by re -platting the property from 197 two-story townhome
units to 88 one-story townhome units built mostly in duplex
style buildings, and by changing the interior amenity features
as illustrated in the concept plans and preliminary plat
submitted with cases SD -1-11 and PZ-3-11, and as otherwise
conditionally approved herein and by Ordinance No. 1379; and
WHEREAS, on January 10, 2012, the Apache Junction Planning
and Zoning Commission voted to recommend approval of the planned
development major amendment, case PZ-3-11, and the proposed
preliminary plat for "Apache Junction Townhomes", case SD -1-11,
with a vote of 6-1; and
WHEREAS, the property is presently legally described as:
Lots 1 through 197, inclusive, and Tracts A through D,
inclusive, of The Villas at Superstition Mountain Phase 2,
according to the plat recorded in Cabinet H, Slide 29,
records of Pinal County, Arizona; and
WHEREAS, this City Council finds this preliminary
subdivision plat to be in compliance with the Apache Junction
City Code,Volume II,Land Development Code,Chapter 1,Zoning
Ordinance and Chapter 2,Subdivision Regulations,and Ordinance
No. 1379, which authorized the planned development plan for the
property.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The preliminary subdivision plat proposing to rename and re-
subdivide "The Villas at Superstition Mountain Phase 2" into a
new subdivision to be called "Apache Junction Townhomes", is
hereby approved subject to the following conditions:
1)All conditions of approval for the CR-5/PD zoned property
as approved pursuant to Planned Development Major Amendment
case PZ-3-11 shall govern the design and subsequent
improvements of the Final Subdivision Plat.

2)Within one year of Preliminary Subdivision Plat approval,
the developers shall submit for formal review, the Final
Subdivision Plat and improvement plans for the proposed
subdivision, to include final landscape and amenity area
improvement plans.
3) Street improvements along N. Idaho Road and Plaza Drive,
including but not limited to, the extension of pavement and
the provision of sidewalks, curbs, gutters and streetlights
shall be designed and constructed according to the City of
Apache Junction Engineering Guidelines.
4) N. Idaho Road and N. Plaza Drive, adjacent to the subject
property shall be dedicated as public streets (if not
already done so) .The interior streets shall be private
streets, perpetually owned and maintained by the management
company and/or Homeowners Association for "Apache Junction
Townhomes".
