A RESOLUTION OF THE MAYOR AND CITY- COUNCIL, OF THE CITY
CAE ATTACHE JUNCTION, ARIZONA, DECLARING AS A PUBLIC
LIC
RECORD THAT CERTAIN DOCUMENT FILED WITH THE CITY CLERK
AND ENTITLED LET "2025 AMENDMENTS _ TO THE A 'ACHE JUNCTION
CITY COTE, VOLUME II, LAND DEVELOPMENT CODE CHAPTER I :
ZONING ORDINANCE, ARTICLE 1-5; ZONING BULK AND USE
REGULATIONS"; REPEALING ANY CONFLICTING PROVISIONS; AND
PROVIDING FOR EE ERAAILITS w
WHEREAS, on January 16, 2024, the city council gave
direction to staff to prepare a text amendment to integrate city
council review and consideration into the land use approval,
process of certain high-impact, permanent land uses decisions;
and
WHEREAS, the planning and zoning commission met on January
14, 2025, with a city council discussion on February 5, 2025 on
the proposed amendment; and
WHEREAS, the planning and zoning commission also recommended
to the city council on January 14, 2025, in a vote of „0, to
approve the amendment; and
WHEREAS, the city council further er discussed the issue at the
February 18, 2025 public hearing; and
WHEREAS, Arizona Revised Statutes Annotated (hereinafter
'"A R¢ f, - 02 permits municipalities to enact the provisions
f a cede or public record in existence without setting forth
such provisions in full text as long as the adopting ordinance
is published in full text, and one paper copy is filed with the
city clerk and an electronic copy is accessible on the ci y' s
e s.i e, with both made available for public use and inspection;
and
WHEREAS, city staff has identified such provisions herein,
and it is the intent of the city to declare such do cur ents and
compilations as public" records, on file in the office of the
city clerk,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF AP C E JUNCTION, ARI T FOLLOWS :

SECTION I IN GENERAL

is hereby declared to be a public record, and shall be

available for public use and inspection .
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All resolutions and parts = f resolotions in conflict with the
provisions of this resolution or any cart of the codes adopted
herein, are hereby repealed.
SECTION III PROVIDING FOR SE` E A ILIT
If any section, subsection, sentence, phrase, clause or portion
of this resolution or any past of the codes r regulations
,ns
adopted herein is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining rtions thereof.

"A" = Administrative Use Permit. An "A" indicates that the use and/or structure is permitted within the
respective zoning district following review and approval of an administrative permit by the Development
Services Director or designee in accordance with §1-1 -12 C ,
if-44 = Prohibited Uses. A "--" indicates that the listed use type is expressly not allowed within the
respective zoning district.

1. Where land use category definitions are not provided or unclear,the Zoning Administrator shall
be responsible for interpretation.
I An ancillary manufacturing use is a subsidiary or secondary use or operation connected to the
main use of a building.Ancillary manufacturing rises shall be allowed in the -1, -2 or 3-3 zoning
districts if incidental and subordinate to the primary retail, office, public or quasi public use,
provided that not more than 5 %, yip to a maximum of 1,500 square feet,of the floor area of the
business is engaged in these ancillary manufacturing activities, No outside manufacturing,
processing,repair or equipment/inventory storage shall be allowed for ancillary uses(see Section
1-6-26)a
Ancillary manufacturing uses proposed to be greater than 1,500 square feet and/or 5 %of the
total floor area may be approved as a conditional use by the Planning and Zoning Commission
(see Section 1- -26 .

processing and/or storage shall require conditional use permit approval even if identified in Table

This definition of commercial uses shall be interpreted in a broad sense to include all typical retail,
commercial and office uses,
