REGULAR MEETING
MARCH 19,1980
A Regular Meeting of the City Council of the City of Apache Junction
was held on March 19,1980, at the Apache Junction City Hall,pursuant to the
notice as required by law.
CALL TO ORDER
Mayor Virginia Seeman called the meeting to order at 7:00 P.M. at
the Apache Junction City Hall.
INVOCATION
Councilman Eidson gave the Invocation.

CALL TO THE PUBLIC (PETITIONS) )

Palo Verde,Apache Junction,in behalf of the Tr -Chairman of the Lost Dutch-
man Days and the Chamber of Commerce presented the City of Apache JunctionwithaRecognition Award for all the help the City gave on Lost Dutchman Days.
Also presented was a Recognition Award for Galen Monson who worked for the
City donating time helping out at the Rodeo Grounds.
CITY MANAGER'S REPORT )
)City Manager Lee,reportedthathe had three items,first he reported on the Public Works security fence
on the State Land location was complete,which will enhance the capability of
the Public Works Department.

City Manager Lee called
on the Building Official,Leo Frazier,to give a status report on the fee
schedule that is currently under consideration.
Building Official Frazier
reported that the new fee schedule was prepared and ready for the Panning
and Zoning Commission to review.
Mayor Seeman brought to
the attention of the City Council that the fee schedule being proposed was
included in the City Council Agenda Packets.
City Manager Lee reportedthat during the explosive growth of your City the first year,the employees
have been examining their job rolls and descriptions on a constant basis.One
of our most dedicated and loyal employees, Ms.Ballard,has requested that the
following letter be read into the record and that her resignation as City Clerk
and acceptance of the position of Deputy City Clerk be noted. Mr.Lee read theletter as follows:
Dear Madam Mayor and Council:After a career path evalua-tion in the most rapidly expanding City in the State and counseling with friends
and the help of Mr.Lee,I believe it will be in my best career interest with
the City of Apache Junction i f I today submit my resignation as City Clerk and
assume an appointment as Deputy City Clerk/Secretary to the City Clerk.
This move I believe will
help me accomplish my personal goals as a member of the City management team.
I respectfully request my
resignation be effective immediately,so I may assume the new position as
Deputy City Clerk/Secretary.Sincerely,signed Isabel
C.Ballard
Mayor Seeman reported that
the City Council as a whole would like to present Ms.Ballard with a Certifi-
cate of Appreciation as the City's first City Clerk.
PUBLIC HEARINGS
SMALL GAME BINGO LICENSE/GOLD DUST MOBILE
HOME RESORT
) Mayor Seeman opened the
Public Hearing for the Gold Dust Mobile Home Resort on "Small Game"Bingo
License.The applicant Marvin Halbert was asked to speak on behalf of thepetition.
Alice Benson, the ActivitiesDirectoroftheGoldDust Mobile Home Resort reported she Was representing Mr.
Marvin Halbert.
Vice -Mayor Granillo asked
questions of Mrs.Benson on conducting Bingo Games and i f there was adequate
parking space.
Mrs.Benson reported there
was a problem with parking during the Lost Dutchman Days being a new park,but
there hasn't been any since and they don't expect any problems in the future.

MENT OF REVENUE THE QUALIFIED ENDORSEMENTOF THE GOLD DUST MOBILE HOME RESORT
"SMALL GAME"BINGO LICENSE TO BE CONDUCTED AT THE GOLD DUST MOBILE HOME RESORT,
202 N.MERIDIAN ROAD IN THE CITY OF APACHE JUNCTION, ARIZONA.THE QUALIFIED
ENDORSEMENT IS THAT THE BUILDING IN WHICH THE BINGO GAMES WILL OCCUR SHALL NOT
HAVE MOTOR VEHICLES PARKED IN THE VICINITY OF SAID BUILDING IN A MANNER THAT
THE VEHICLES'PRESENCE WOULD BECOME A HAZARD TO THE PUBLIC HEALTH, SAFETY,AND

time to review the reports submitted by the AD HOC Committee.

A RESOLUTION OF THE MAYOR
AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,PINAL COUNTY,ARIZONA,ENDORS-
ING AND ENCOURAGING THE DEVELOPMENT OF RECREATIONAL FACILITIES WITHIN THE CITY
OF APACHE JUNCTION.
WHEREAS,there is a need
for recreational facilities within the City of Apache Junction;and
WHEREAS,recreationalfacilitiesforcitizensof Apache Junction to develop physical and mental ,potentials;and
WHEREAS,this resolution
does not suggest or bind the City to any financial obligations or other obli-
gations of any kind;
NOW,THEREFORE,BE IT
RESOLVED that the City of Apache Junction hereby endorses and encourages the
development of recreational facilities within the City of Apache Junction.

AN ORDINANCE OF THE CITY
OF APACHE JUNCTION,PINAL COUNTY,ARIZONA,AMENDING CHAPTER 8,SECTION 8-5-23,
TO INCLUDE UTILITY AND/OR PUBLIC SERVICE COMPANIES ENGAGED IN FURNISHING GAS OR
ELECTRICITY FOR LIGHT, FUEL, OR POWER,PROVIDING FOR PENALTY CLAUSE AND SEVER-
ABILITY CLAUSE;AND DECLARING AN EMERGENCY.
SECTION 8-5-23 PUBLIC
UTILITY TAX Utility and/or public service companies,who do not have a
franchise agreement with the City of Apache Junction,engaged in furnishing
gas or electricity for light,fuel or power, or in furnishing what for irriga-tion or domestic purposes,fire protection or other public or private purposes,
or in transmitting messages or furnishing public telegraph or telephone services,
shall pay,in addition to the quarterly business tax,a sum equal to two percent
(2%)of the gross receipts of said utility or public service company from salesforresidentialand/or commercial purposes within the corporate limits of theCityof Apache Junction.Such payments to be due and payable quarterly.Tax
shall not apply to gross sales or gross income from sales to the United States
Government,its departments or agencies which shall not be considered in the
computation of tax.

INFORMATION AND REPORTS )
) Mayor Seeman reported that
on KSTM Radio Station,beginning April 2nd and on each Wednesday thereafter,the
Department Heads will be giving a City Hall talk for the public.Also i f thepublichasquestionsthatthey would like answered on this program,to send them
to the City of Apache Junction,P. O.Box K,Attention:Office of the Mayor.
The Councilmen will be participating as well as the Department Heads.
Mayor Seeman further reportedthat Talent Bank Applications are needed to fill the newly formed Commissions.

City Council when they wished to have a Work Session or a Special Meeting on
the Business License Ordinance to study the AD HOC Committee's recommendations.

Councilman Eidson expressed
his concern on the strip annexation by the City of Mesa,and stated his reasons
for his concern.
Councilman Eidson MOVED
THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT DIRECTION BE GIVEN TO THE CITY MANAGER TO CONDUCT A STUDY INTO THE
FEASIBILITY OF FORMALLY DECLARING THE CITY OF APACHE JUNCTION'S ZONE OF INFLUENCE
TO INSURE THE FUTURE PROTECTION TO ALL CITY RESIDENTS.
Councilman Eidson asked the
City Manager to explain the Zone of Influence.
City Manager Lee explained
that the Zone of Influence is described as that 3 mile radius outside the Citylimits.The Influence would include the potential site the City is interested
in for the airport,which the City is pursuing a grant.This would also helpsatisfythe problem the City has with developers trying to comply with a Mesa
Code, Apache Junction Code, and a Pinal County Code. The City would have Zone
of influence for the protection of the public.They can not come in with that
noxious industry on property contiguous to the City of Apache Junction and
give problems with property values,etc.The City would not be annexing that
area but simply performing a study that would determine whether or not it would
be a prudent course for the Council to consider.
Councilmembers discussed
at lengths the recent annexation by the City of Mesa and the pros and cons inrelationtotheCityof Apache Junction.
City Manager Lee recommended
that the City Council consider a formal resolution,outlining the Zone of Influ-
ence so that the City of Apache Junction can go on record with the other Cities
that we intend to explore that Zone of Influence to see what value i t has to
the City of Apache Junction.This would minimize any problem to the North,
South,and East as an attempt to circle the City.The City of Apache Junction
would send this Resolution to the City of Mesa and put their Council on notice
that the City of Apache Junction is in the process of conducting a study andwillcomeup with an impact on the residents of the City of Apache Junction for
the next 15 to 20 years.Mr.Lee felt this should be staffed through the Planning
and Zoning Commission for their recommendations.
City Manager Lee said that
the staff can draft the Resolution based on the motion.
Councilman Hill seconded
the motion.

Ray Prue complained on a
pond of water on the street in front of Johnny Below Zero's and stated that
i t is a health hazard and he has complained to City Hall,with nothing being
done.

Director of Public Works
Broman answered that the staff is aware of the problem,and it appears that i t
was created during the construction of the business in that area,which at the
time,it was under the jurisdiction of Pinal County.The City has to take some
action by contacting the property owner to see what action he would take to
correct the problem.Mr.Broman further explained that the City can not justfillinthedipasit will not correct the problem,it would cause problems
elsewhere and the City can not go on private property.
Mayor Seeman thanked the
Business License AD HOC Committee, Chairman Don Brooke,Earleen Andrews,TomLester,Martha Wright and Samford Gardom for the many hours spent,and invited
them to come to the March 27th Work Session.
