SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES M. CALL TO PUBLIC At this time the public has the privilege to address the council with requests, communications, comments or suggestions relating to city business.All speakers must have already submitted a written "Request to Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the agenda. If there is a group speaking on the same item, they should select a spokesperson.All such remarks shall be addressed to the council as a whole and not to any member thereof The mayor is authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to act. The council may not answer questions of the speaker, discuss the matter with one another, but may, at the conclusion: 1)respond to criticism by a speaker, 2)ask the city manager to review a matter, 3) ask the city manager to place the matter on a future agenda. E. AWARDS, PRESENTATIONS AND PROCLAMATIONS 4. 25-139 Presentation of 25-Year Service Award to Matthew McNulty. Director of Marketing and Communications Kayla Fulmer recognized Matthew McNulty's 25 years of service with words of appreciation, and a list of his professional accomplishments. She also spoke of his family history working with the City. City Manager Bryant Powell addressed Mr. McNulty with a certificate and service award. He shared several photos and highlighted some of the larger projects that Mr. McNulty has contributed to over the years. Mr. McNulty introduced his family and friends that were in attendance and thanked everyone for the recognition. 5. 25-130 Proclamation designating April 25, 2025, as "National Arbor Day." Mayor Wilson read the Proclamation designating April 25, 2025, as "National Arbor Day." Parks and Recreation Director Liz Langenbach, and Recreation Coordinators, Jared Grimm and Elliott Anuta accepted the proclamation. Ms. Langenbach thanked the Mayor and Council and shared several activities the department has done this month to celebrate Earth day. She also stated Mr. Anuta and Park Maintenance Supervisor Shauna Hash will represent the City at the State Capital this week to receive the second year designation as a Tree City USA member. She listed projects that the Parks and Recreation department has participated in with the SRP Right Tree Right Place Program. 6. 25-150 Proclamation designating the week of April 21 st- 28th, 2025 as "International Dark Sky Week." Mayor Wilson read the Proclamation designating the week of April 21 st-28th, 2025, as "International Dark Sky Week." Senior Planner Kelsey Schattnilk and Parks and Recreation Director Liz Langenbach accepted the proclamation. Ms. Schattnilk thanked the Mayor and Council for their support of the City's dark sky efforts. She gave a brief update on the application process. REGIONAL INTERGOVERNMENTAL UPDATES 7. 25-063 Brief summary of intergovernmental updates from mayor and councilmembers. Councilmember Cross announced that he was recently appointed to serve on the board for the East Valley Partnership. He spoke about the meeting he attended which focused on data centers and changing technology. Mr. Cross also attended a monthly Pinal County breakfast where a topic of discussion included the need to power these data centers. Councilmember Heck shared the final attendance numbers for the Lost Dutchman Days event, the total amount of money raised and highlighted the organizations that helped make it a success. He thanked all the volunteers and everyone who attended. Mayor Wilson attended the Battles of the Badges which is the annual baseball game between the Apache Junction Police Department and the Superstition Fire and Medical teams. He also attended the Police Department Annual Awards Ceremony. Mayor Wilson toured the new LG facilities in Queen Creek and shared that the job training will be held at Central Arizona College, Superstition Mountain campus. G. CITY MANAGER'S REPORT 8. 25-064 City Manager's Report City Manager Bryant Powell shared photos from the Police Department Annual Awards Ceremony, highlighted the importance of their families and announced the 2024 Officer of the Year was Detective Dylan Kennard. He thanked the Police Department for all their hard work. 9. 25-065 Announcement of Current Events. Management Analyst Eli Richardson shared upcoming events: - Easter Egg Hunt on Saturday, April 19, 2025, 8:00 a.m. - 12:00 p.m. at Prospector Park Softball Complex, 3015 N. Idaho Road, Apache Junction. -April Pools Day on Saturday April 26, 2025, 10:00 a.m. - 12:00 p.m. at 1091 W. I, Chapter 8 : Business regulations concerning fortune telling businesses Following the April 24thCity Council discussion regarding fortune telling businesses and the permit fees prescribed to them in the Apache Junction City Code, Volume 1, Chapter 8 : Business, Staff coordinated with the Police Department and confirmed city policies and procedures for the business license staff reviews of fortune telling businesses . There was a question raised regarding whether the $1, 200 permit fee is necessary and if it is to be used for background checks, but we find that no background checks are performed for these businesses . The Police Department noted they would need explicit authority from the City Code to conduct background checks, such as is required by the code for specific other business types, such as sexually oriented businesses or liquor licenses . In the absence of such a requirement and practice we find no need for the city to continue charging an annual $1200 fee in addition to standard business licensing costs . Per these findings, Staff recommends a Direction to Staff to initiate a code amendment to the Apache Junction City Code, Vol . Solar photovoltaic panels installed in Arizona are subject to extreme surface temperatures, often reaching approximately 149'F. These conditions substantially exceed the optimal operational range of solar panels, typically between 59'F and 95'F. Deployment of solar facilities under such conditions poses a direct threat to local wildlife,particularly birds and bats native to the region, which may become disoriented by the reflective surfaces of the panels, mistaking them for bodies of water. This confusion could result in substantial and irreversible harm to these vulnerable species. Furthermore, the maintenance of large-scale solar installations requires significant water resources. Industry estimates indicate that approximately 20 gallons of water per megawatt-hour(MWh) are necessary for routine panel cleaning. Given Arizona's ongoing water scarcity challenges,the additional demand associated with these facilities will place further strain on already I imited water supplies, Of additional concern is the proposed development of battery storage facilities, which may require millions of gallons of water daily for manufacturing and operational purposes. The specific sources of this water have not been disclosed, Large-scale battery production facilities, or gigalactories, have substantial water footprints, and there is currently no effective recycling method for lithium-ion batteries at scale. This raises critical questions about the long-term environmental stewardship and waste management strategies associated with these projects. Equally troubling is the proposed conveyance of approximately 9,000 acres of public land—an area equivalent to 6,000 to 7,000 football fields. The state has traditionally refrained from selling or disposing of public land to individual,but only to developers or companies, Therefore,this proposed action demands fall transparency regarding the parties who stand to benefit financially, as well as a thorough Zn analysis of how this action aligns with the public interest and the states mission. This will so place this solar and storage project over an underground aquifer and if any of these batteries leak it will be devastating to the environment and the people all the way to Tuson. Given the magnitude of the potential impacts, I respectfully urge the State and other relevant authorities to halt the building of this plant. This standard license agreement between Flying Bull Internet, LLC(dba Novos Fiber) and the City of Apache Junction will allow Novos Fiber to install and maintain their telecommunication facilities within city ROW per the agreement which outlines the telecommunications rights, duties and fees.
