City Manager Bryant Powell introduced the Fiscal Year 2025-2026 budget and stated that Staff has been working diligently since the Council Retreat to make sure Council goals and objectives for the community are met. He thanked the Finance team for helping to correlate where the budget ended last year, to current revenue and expenditures, while trying to forecast where things will be going. He shared that some of the upcoming challenges will be expenditure limitations and San Tan Valley's possible incorporation. The population growth has been faster than the expected consumer price index so the base budget may need to be reviewed in the future or home rule may be need to be considered. Mr. Powell stated with proper planning and timing and the continued support of the sales tax, the City has been able to maintain the service the community has come to expect in spite of the challenges. He also announced several proposed budget items. Finance Director Angelie Hawley shared key budget assumptions of positive activity with sales tax, the full impact of the urban shared income tax will create an estimated decrease of$2.1 million, the rental tax was eliminated effective January 2025,which resulted in lost revenues of $1.5 million, employee compensation increases and capital projects will proceed as planned for the General and Special Revenue Funds. Ms. Hawley presented various slides that reflected the budget summary, general fund revenues and expenditures, special revenue fund revenues and expenditures, capital projects for FY 2026, and some of the before and after completed capital projects for FY 2025. Councilmembers commented on the hard work that staff has done to answer their questions in a timely manner and to create a balanced budget. Assistant City Manager Matt Busby stated next steps are the classification and compensation plan and the pension funding policy for public safety retirement. These items will be on the agenda for the Special Meeting for Tentative Budget Adoption to be held Monday, May 19th, 2025. Mayor Wilson read the proclamation designating May 17, 2025, as"Kids to Parks Day." He presented it to Recreation Superintendent Jamie Sullivan. She spoke of the importance of this day and the vital role that parks play in childhood. F. REGIONAL INTERGOVERNMENTAL UPDATES 7. 25-144 Brief summary of intergovernmental updates from mayor and councilmembers. Councilmember Cross attended the Central Arizona Project(CAP)annual dinner meeting. They discussed the concerns with CAP water due to a lack of rain fall last year. He encouraged the public to speak to their representatives to help come up with a solution to serve everyone. Councilmember Soller also encouraged the public to speak to their representatives regarding CAP water. He also announced that May 15, 2025, is the National Peace Officers Memorial in Washington D.C. He asked the public to keep law enforcement in their thoughts and prayers. Councilmember Nesser stated the Arizona League of Cities and Towns have selected her to represent Apache Junction on the Public Safety, Military Affairs, and Court Policy Committee. CITY MANAGER'S REPORT 8. 25-145 City Manager's Report City Manager Bryant Powell shared photos from the Building Safety Month Expo and thanked Development Services Staff for their efforts. He spotlighted Lesley Castillo for putting together such a great event. Mr. Powell thanked Staff for their involvement in the Lost Dutchman Marathon and shared a photo from their awards presentation. He shared statistics for the Easter Egg Hunt this year and thanked Parks and Recreation for their hard work. Mr. Powell recognized Kimberly Wilson and Code Compliance Staff for their help with multiple inoperable vehicles and supporting a clean, safe community. Mr. Powell stated the household hazardous waste event was a success with well over 200 community members participating. He also shared the new neighborhood Radiance celebrated their one-year anniversary with a big party. 9. 25-219 Presentation and update on the Youth Advisory Council. Recreation Coordinator Jody Dutra presented the history of the Youth Advisory Council (YAC). She introduced the members of YAC and they presented the year end review. They took turns sharing photos and information about events they have participated in over the last year. The graduating seniors of YAC were honored by the City and the VFW. They were each presented with a plaque from Irene Nowack of VFW#9399 and Heather Lyn of VFW#7968. 10. 25-20 Economic Development update with director, Ryan Kaup. Economic Development Director Ryan Kaup presented an update on the department. This included a demographic overview for the City, East Valley build out percentage, the increase in single family permits, housing affordability, US-60 momentum and the downtown redevelopment. Mr. Kaup also stated his goals for the future with the department. Councilmember concerns included multifamily apartment complexes in the downtown area, converting commercial properties to residential, the size of downtown, and a possible location City of Apache Junction,Arizona Page 3 City Council Meeting Meeting Minutes May 6.2V25 for a data center. Counoi|mombor Cross and Counni|mombor SoUer No: O Planner Nick Leftwich presented a recap regarding fortune telling businesses and the permit fees prescribed to them in the Apache Junction City Code, Volume 1, Chopter8: Business. Following the April 24, 2025, City Council discussion, Planning Staff coordinated with the Police Department and confirmed city policies and procedures for the business license staff reviews of fortune telling businesses. There was a question raised regarding whether the$1,200 permit fee is necessary and if it is to be used for background checks, but it was found that no background checks are performed for these businesses. The Police Department noted they would need explicit authority from the City Code to conduct background checks, as is required by the code for specific other business types, such as sexually oriented businesses or liquor licenses. In the absence of such a requirement and practice staff finds no need for the city to continue charging an annual $1.200 fee in addition to standard business licensing costs. Planning staff recommends a Direction to Staff to initiate a code amendment to the Apache Junction City Code, Vol. |. Chapter 8: Business, § 8-1-1 Definitions and §8-2-7Permits; Fees to remove the$1.200 permit and fee for fortune telling businesses. Councilmember concerns included the permit fee for circus and carnivals and the reason for the background checks. This agenda item is only for fortune telling businesses. L. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES M. CALL TO PUBLIC Donna Carr, 2178 W.Virginia Street, Apache Junction, encouraged the community to attend the Pinal County Zoning Board meeting and oppose construction for a solar development project. Catherine Meek, 1327 S. Belair Road, Apache Junction, expressed her love of the community and shared her concern for the potential of apartments downtown. Andre Meek, 1327 S. Belair Road, Apache Junction, shared his experience at the Building Safety Expo and suggestions for next year. N. City of Apache Junction,Arizona Page 1 Printed on 511512025 RESOLUTION NO. 25-08 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE CITY OF APACHE JUNCTION TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT TO CONTRIBUTE TO THE MAINTENANCE OF THE ARIZONA CONTINUOUSLY OPERATING REFERENCE STATION (AZCORS) PROGRAM WITH THE ARIZONA DEPARTMENT OF WATER RESOURCES (ADWR) . WHEREAS, AZCORS is a network of 51 reference stations (36 State-managed and 15 managed by others) providing highly precise coordinate information that is a critical component to the City' s mapping efforts . The equipment consists of a mounting pole, GPS receiver, GPS antenna, cellular router and other associated electronics . WHEREAS, the city will contribute annually to support the operation and maintenance of the AZCORS program. In return ADWR shall provide access to the AZCORS network and technical support with data related issues . WHEREAS, pursuant to A.R. Purpose The purpose of the Intergovernmental Agreement ("IGA" or"Agreement") is to facilitate maintenance of Continuously Operating Reference Station sites between the Arizona Department of Water Resources and the City of Apache Junction. 2. Parties and Definitions a. The parties to this agreement are the Arizona Department of Water Resources ("ADWR") and the City of Apache Junction("Apache Junction") (collectively, the "Parties"). b. "AZCORS" shall mean Continuously Operating Reference Stations C. "GNSS" shall mean global navigation satellite system. 3. Scope a. This IGA shall cover all issues relating to Apache Junction's cooperative efforts in supporting the AZCORS network. b. This Agreement is fully integrated and governed by the four corners of this IGA. 4. Effective Date This IGA will become effective upon the completed execution hereof. 5. Duration a. This IGA shall have a duration of five (5) years with no option to extend the term by amendment. A new IGA must be entered into prior to the expiration of the current term. b. Duties 6.1 Apache Junction a. Apache Junction shall pay ADWR$5,000 to contribute to the operation and maintenance of the AZCORS Network. 6.2ADWR a. Non-Discrimination The Parties shall comply with Arizona State Executive Orders Nos. 2023-09, 2023-01, 2009-09 and 75-5, and any and all other applicable federal and state laws, rules and regulations, including,but not limited to,the Americans with Disabilities Act. 8. Indemnification Each Party (as Indemnitor) agrees to indemnify, defend and hold harmless the other Parry (as Indemnitee) from and against any and all claims, losses, liability, costs or expenses (including reasonable attorney's fees) (hereinafter collectively referred to as "Claims") arising out of bodily injury of any person (including death) or property damage, but only to the extent that such Claims which result in vicarious/derivative liability to the Indemnitee are caused by the act, omission, negligence, misconduct, or other fault of the Indemnitor, its officers, officials, agents, employees, or volunteers. ADWR, through the State of Arizona, is self-insured per A.R.S. § 41-621. 9. Waiver Waiver of any of the terms of this IGA shall not be valid unless it is in writing and signed by all Parties. Failure of either Party to enforce the provisions of this IGA or require performance by the other Party of any of the provisions shall not be construed as a waiver of such provision or affect the right of each Party to thereafter enforce the provisions of this IGA. Termination a. Either Party may terminate the IGA with or without cause. b. If a Party wishes to terminate the IGA before the expiration of the IGA, a thirty (30) calendar day written notice shall be given to the other Party. C. This IGA may be cancelled pursuant to A.R.S. § 38-51.1, the terms of which are incorporated herein. 11. Severability If any provision of this IGA is determined to be invalid, illegal or unenforceable, the remaining provisions of the IGA remain in full force and effect. 12. Limitations Nothing in this IGA shall be construed as limiting or expanding the statutory responsibilities of the Parties. 13. Construction This IGA is the result of negotiations between the Parties and has been reviewed by each of the parties hereto and their respective counsel. Accordingly, this IGA shall be deemed to be the product of all of the Parties hereto, and no ambiguity shall be construed in favor of or against any one of the Parties hereto. 14. Conflict of Interest This Agreement is subject to cancellation by the State under A.R.S. § 38-511. 15. Choice of Law This contract shall be governed and interpreted by the laws of the State of Arizona. 16. Other Agreements a. This IGA in no way restricts either Party from participating in similar activities with other public or private agencies, organizations, and individuals. On February 10, 2025, the Apache Junction Public Art Commission ("Commission") asked that the Apache Junction Youth Advisory Council ("YAC") chose a theme for a future competition with AJHS, and work with the selected artist to complete the design. Staff reasoned that it would be a great opportunity for the winner of the design and YAC to showcase their art skills by painting the traffic cabinet together. On April 3, 2025, AJHS, the Commission, and YAC released a school wide competition (Exhibit 1) to design artwork for a city traffic cabinet located on the northeast corner of S . Ironwood Drive and W. Southern Avenue with the theme of "AJHS Pride", with the intent that it would be painted by the selected artist, if available and interested, with the help of YAC. The entry deadline for the contest was April 23, 2025, for which five (5) submissions were received. The YAC reviewed the submittals (artist names removed) and ranked them for the Commission. On April 30, 2025, the Commission was asked to recommend their favorite design for City Council consideration. Y # t Y i � a Ual} i p J i fi f ti 1 #4 ; t { f L ,1C COMMISSION CITY OF APACHE JUNCTION AJHS PRIDE I TRAFFIC CABINET PUBLIC ART CONTEST Apache Junction High School ('AJHS") students are encouraged to participate in a school wide competition to create a design that best represents AJHS pride.The winning design will become part of the City of Apache Junction's collection of public art by being painted on a traffic cabinet near AJHS on the northeast corner of Ironwood Drive and Southern Avenue (in front of Circle K). Please note that this is a temporary public art project and likely has a lifespan of up to five (5) years. If the art is damaged and repair is not feasible, the art will be removed. COMPETITION TIMELINE Entry Deadline April 23, 2025 Winner Notified ( �May 21, 2025 Painting Can Begin I May 24, 2025 AWARDS & PRIZES The winner will receive a s1oo gift certificate and be featured on the City's website, social media accounts,and in a press release.The winnerwill also be given the opportunityto helpthe Apache Junction Youth Advisory Council ("YAC") paint their design on the traffic cabinet. The five (5) designs are presented to the Apache Junction Public Art Commission ("PAC"),who will then recommend a winning design to the Apache Junction City Council ("Council"). 3. The recommended design is presented to Council during a work session and then voted on during the Consent Agenda the following night at a regular meeting. TERMS OF ENTRY • Open to all currently enrolled students at Apache Junction High School. • All backgrounds, skill levels, and styles accepted. • All 2D visual media accepted. • Images must be original work created by the submitting artist. Copyright-protected imagery will be disqualified. • Students need to include designs for all four(4) sides. • Students should consider the perspectives of both pedestrian and vehicular traffic. • Artwork that contains political, negative, or inappropriate imagery will not be considered. BACKGROUND On October 1, 2024, the Apache Junction City Council ("Council") requested that a traffic cabinet near the Apache Junction High School ("AJHS") include a design that represents AJHS . On February 10, 2025, the Apache Junction Public Art Commission ("Commission") asked that the Apache Junction Youth Advisory Council ("YAC") chose a theme for a future competition with AJHS, and work with the selected artist to complete the design. Staff decided that it would be a great opportunity for the winner of the design and YAC to showcase their art skills by painting the traffic cabinet together. On April 3, 2025, AJHS, the Commission, and YAC released a school wide competition (Exhibit 1) to design artwork for a city traffic cabinet located on the northeast corner of Ironwood Drive and Southern Avenue with the theme of "AJHS Pride", which will be painted by the selected artist, if available and interested, with the help of YAC. I, Chapter 8 : Business regulations concerning fortune telling businesses Following the April 24th City Council discussion regarding fortune telling businesses and the permit fees prescribed to them in the Apache Junction City Code, Volume 1, Chapter 8 : Business, Staff coordinated with the Police Department and confirmed city policies and procedures for the business license staff reviews of fortune telling businesses . There was a question raised regarding whether the $1, 200 permit fee is necessary and if it is to be used for background checks, but staff found that no background checks are performed for these businesses . The Police Department noted they would need explicit authority from the City Code to conduct background checks, such as is required by the code for specific other business types, such as sexually oriented businesses or liquor licenses . In the absence of such a requirement and practice we found no need for the city to continue charging an annual $1200 fee in addition to standard business licensing costs . On May 6, 2026, the City Council gave Direction to Staff to review and consider updates to the Apache Junction City Code, Volume I, Chapter 8 : Business regulations concerning fortune telling businesses and the permit fees prescribed for them. Over the past two years,the following efforts have been made to improve the safety and consistency in events ran throughout the city: 1. Inter-departmental Special Event Task Force created to review and support public and private city-wide special events 2. Special Event applications and processes have been updated 3. A Special Event Handbook has been created to streamline the process for event-planners 4. The city-wide Special Event Liaison role has been added to Parks and Rec Management Analyst, Riley King's, position so that event-planners have one point of contact for assistance The Special Event Task force has identified items within current special event ordinances to be updated and re-considered, as well as items needing to be included. Staff will share market research on neighboring cities'special event policies and share sections of the city code that have been identified for updates/additions. Staff request Direction to Staff to review and recommend updates to the city code, related to special event processes.
