The next step in the process is for the council to hold a public hearing on the application and make a recommendation of approval or denial to the Arizona Department of Liquor License and Control. COUNCIL DIRECTION TO STAFF This item allows the mayor and city council to direct staff on specifically listed matters. L. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES M. CALL TO PUBLIC At this time the public has the privilege to address the council with requests, communications, comments or suggestions relating to city business.All speakers must have already submitted a written "Request to Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the agenda. If there is a group speaking on the same item, they should select a spokesperson.All such remarks shall be addressed to the council as a whole and not to any member thereof. E. AWARDS, PRESENTATIONS AND PROCLAMATIONS 3. 23- 00 Proclamation designating the week of October 16 through October 22, 2023 as "Arizona Cities and Towns Week". Vice Mayor Schroeder read and presented the Proclamation designating the week of October 16 through October 22, 2023, as"Arizona Cities and Towns Week." 4. 23- 08 Proclamation designating the month of October as "Domestic Violence Awareness Month." Mayor Wilson read the Proclamation designating the month of October as"Domestic Violence Awareness Month, and presented it to Chief Michael Pooley with the Apache Junction Police Department. Chief Pooley thanked the Mayor and Council for recognizing this important issue, that is dealt with on a consistent basis across the country. He also shared the various organizations that offer support for this cause, and complimented the Mayor and Council on the wearing of purple shirts at this meeting. 5. 23-509 Proclamation designating the week of October 23-31, 2023 as "Red Ribbon Week." Councilmember Heck read the Proclamation designating the week of October 23 through 31, 2023, as"Red Ribbon Week". Chief Michael Pooley accepted the Proclamation and thanked the Mayor and Council for recognizing this important initiative. He recognized the Apache Junction Police Officers in attendance, and requested they join him with the Mayor and Councilmembers in a photo. F. REGIONAL INTERGOVERNMENTAL UPDATES 6. 23-436 Brief summary of intergovernmental updates from mayor and councilmembers. Councilmember Soller recognized the Apache Junction Police Department and staff for wearing pink in honor of Breast Cancer Awareness Month during October, 2023. He also gave an update on the National Faith and Blue weekend, and invited the public to join in the resolution and reconciliation during this event. This is being hosted in an effort to build bridges and break biases.A toy drive is being offered by the Apache Junction Police Department at the Mountain View Lutheran Church on Saturday, October 7, 2023, 9:00 a.m. to 11:00 a.m., located at 2122 S. Goldfield Road, and a community picnic is being held on Sunday, October 8, 2023, from 12:30 p.m. to 2:30 p.m., hosted by the Church of the Pentecost and Amazing Grace Presbyterian, located at 1180 E. Broadway Avenue. Vice Mayor Schroeder gave an update on a recent forum that was paneled by himself, the Pinal County Supervisor, Pinal County Attorney, Mayor Wilson and City Manager Bryant Powell. Mayor Wilson also added the statistics that were shared at this meeting regarding gun violence. City of Apache Junction,Arizona Page 2 City Council Meeting Meeting Minutes October 3,2023 Councilmember Heck attended a Pinal County Housing Round Table with City Manager Bryant Powell and Management Analyst Robert Wisler. Presentations were given to help cities learn how to plan and offer more affordable housing, and explore the various opportunities and organizations that could assist with that. Make A Difference Day is an opportunity to address areas of blight and needed improvement within the City. This will be held on Saturday, October 7, 2023, from 8:00 a.m. to 11:00 a.m. All participants will meet at the City Focal Point. Mayor Wilson attended a groundbreaking ceremony at the Apache Junction Central Arizona College campus. Due to upcoming new programs being offered by the college, some of the old buildings are being torn down and new buildings will be added. Mayor Wilson also invited the public to attend the Rodeo Grounds Key Transfer event on October 6, 2023, from 5:30 p.m. to 7:30 p.m. The City has purchased this land from the Bureau of Land Management, and will now be able to offer more great opportunities for the community. Mayor Wilson also attended a butterfly release at the Apache Junction Library. This was a program offered to children to be involved from the beginning stage of a caterpillar to completion of cycle into a butterfly, and the release of the butterfly event was well attended. G. CITY MANAGER'S REPORT 7. -437 City Manager's Report. City Manager Bryant Powell thanked the Mayor and Council for their support to the Domestic Violence Awareness effort. He commented on the anticipated improvements at the Central Arizona College Apache Junction campus and the benefits of these new buildings and programs being offered for specific trades. Our community and residents will benefit from this with high quality and higher paying jobs, along with the low debt ability for our youth to obtain an excellent education. He recognized the Finance Department for achieving the Distinguished Budget Presentation Award from the Government Finance Officers Association (GFOA), and thanked the Finance Director Leslie DeReche and staff for their efforts. Chamber of Commerce held the Superstition Open Annual Golf Tournament on Friday, September 29th, 2023. Several community members and city staff participated in the event. 8. 23-438 Announcement of Current Events. Public Information Officer Al Bravo covered details regarding Make A Difference Day, Saturday, October 7, 2023. Participants will meet at the City Focal Point at 7:45 a.m. for directions on projects, and will receive a t-shirt. Phoenix New Times has spotlighted the Superstition Ridgeline Trail as their"Best of Phoenix Edition" hard hike in the valley. Seed Up Meet Up is a program offered through the Apache Junction Library and Horizon Health and Wellness. More details can be found on the Library website at ajpl.org. H. PUBLIC HEARINGS 9. 23-507 Public hearing and consideration on the Fourth Amendment to Economic Development Agreement Between City of Apache Junction and Mehmood Mohiuddin as owner of the Hitching Post. Councilmember Cross moved,seconded by Vice Mayor Schroeder that the Fourth Amendment to the Hitching Post Development Agreement be approved. Yes: 5- Mayor Wilson, Vice Mayor Schroeder, Councilmember Nesser, Councilmember Cross and Councilmember Soller No: 1 - Councilmember Heck Recused: 1 - Councilmember Johnson Councilmember Johnson recused herself from this item action. City Manager Bryant Powell presented the update to the Fourth Amendment with the Hitching Post. Councilmembers had no concerns for discussion. Mayor Wilson opened the Public Hearing. George Schroeder, 2444 W. Virginia Street,Apache Junction, questioned if the 8 events are strictly for bull riding or can other types of occasions be held? He has concerns that not all businesses are being held to the same standards regarding compliance of building code requirements. City Manager Bryant Powell confirmed the new agreement of the 8 additional events are not strictly for bull riding. Donna Carr, 2178 W.Virginia Street, Apache Junction, suggested other activities for youth be offered within these 8 added events. Timothy O'Toole, 2178 E. Foothill Street, Apache Junction, queried if discussion tonight would cover the right of way request for the property involved with the Fourth Amendment Agreement. He has great concern regarding this right of way due to access on his private property. He complained he was not notified or invited to this meeting tonight. He is strongly opposed to any expansion for this business, and shared his varied reasons. Richard Beavers, 2225 N. Cortez Road, Apache Junction, expressed his opposition to any expansion to the Hitching Post. He has lived with the noise from the establishment for the past 6 years and does not want it anymore. He also commented on not receiving an invitation to this meeting until this morning in his mail. Bonnie Goldsbury, 2320 N. Apache Trail,Apache Junction, shared her concerns regarding the attention citizens are giving to the noise level from the Hitching Post, when the traffic on City of Apache Junction,Arizona Page 4 City Council Meeting Meeting Minutes October 3,2023 Highway 88 from vehicles pulling boats as well as all the ATV's creates much more noise than the establishment. She referenced the importance and sustainability of rodeo, and she is in favor of more events such as this at the Hitching Post. She commented on the upcoming events to be held at the Rodeo Grounds,just around the corner from the Hitching Post, and questioned the noise to be expected from that venue. Gail Evans, 913 S. Del Rio Court,Apache Junction, questioned the total of 8 additional events. She shared statistics of the current amount of events and how they impact residents to the east of the business. She expressed concerns on the lack of fire suppression and equipment that is not currently installed at the Hitching Post. She questioned if staff will be completing inspections prior to these additional events. She also stated she did not see anywhere in the agreement how enforcement will be given if the business owner is non-compliant. She recalled a previous Fourth Amendment Agreement that addressed several conditions, of which the business owner failed to complete regarding the required changes. Jane Brown, 35 Val Vista Road, Apache Junction, commented on the need for our youth to have events like these offered at the Hitching Post to attend, and the expansion of these events will build on our horse community and she is in favor. Andre Meek, 1327 S. Belair Road, Apache Junction, stated he drives past this establishment everyday and sees the traffic issues. He supports the idea of offering more events for the youth in our community, but has concerns with the approach the owner of the business is taking regarding compliance requirements and stated this business should be treated the same as any other and be held to the same standards. If there is a concern with the noise he suggested completing a decibel test. Receiving no further comments Mayor Wilson closed the Public Hearing. Councilmembers continued with discussion on the following topics: Types and number of events allowed, special event process, noise level concerns, economic value brought to the community, allowable event hours, current compliance status of the business, benefits of rodeos in raising polite young adults, design of the intersection and traffic concerns, previous events held without a development agreement, regulations covered under this agreement, zoning for this type of business, safety concerns with occupancy and fire suppression system, and lack of water volume to accommodate fire sprinklers. After Council discussion, Mayor Wilson re-opened the Public Hearing. Timothy O'Toole, 2178 E. Foothill Street, Apache Junction, strongly urged attention be given to the right of way abandonment included in this agreement. This has not been addressed tonight, and he has great concern on this, because currently traffic is allowed to cross his private property due to the design of the right of way. If the right of way is granted to this business owner then Mr. O'Toole expects to receive the same grant of property to avoid the current issue of traffic crossing through his property. He commented on the suggestions for the intersection redesign and how that would be paid for. He has great concern for the ability of drivers in this intersection due to alcohol. Mr. Powell announced this amendment is a mechanism for council to have further discussion and public hearings relating to the right of way abandonment. Donna Carr, 2178 W. Virginia Street, Apache Junction, inquired why the junior rodeo events are City of Apache Junction,Arizona Page 5 City Council Meeting Meeting Minutes October 3,2023 not being held at the rodeo grounds, where the City would make full profit rather than receiving a portion from a business owner hosting the events. She commented that everyone should have to follow all codes and remain in compliance. Mayor Wilson closed the Public Hearing. Council added: The intersection of Lost Dutchman and State Route 88 is not the responsibility of the City, it is owned and maintained by the Arizona Department of Transportation (ADOT). Requests by the City can be made to ADOT to complete traffic studies and possible improvements to the area. Mayor Wilson commented, prior to his vote, that the business owner needs to be held accountable to the zoning requirements, and be actively pursuing compliant status, including the noise level. At the completion of Vote and Roll Call, Councilmember Johnson returned to the dais. I. OLD BUSINESS J. NEW BUSINESS 10. 2 -460 Presentation, discussion, and possible consideration of contract with Dick and Fritsche Design Group (DFDG) in an amount of$169,300.00, plus a contingency of$25,700.00 for a total not to exceed $195,000.00 for long-term master planning services for city facilities. This item was approved as part of the FY2024 budget. Vice Mayor Schroeder moved,seconded by Councilmember Soller that the contract with Dick and Fritsche Design Group for long-term master planning services for city facilities in an amount not to exceed$195,000.00,approved in the Fiscal budget of 2024,be approved. Yes: 7- Mayor Wilson, Vice Mayor Schroeder, Councilmember Nesser, Councilmember Heck, Councilmember Johnson, Councilmember Cross and Councilmember Soller No: 0 Assistant City Manager Matt Busby introduced Sue Billings with Elevated Design Studio, (EDS) to present Phase 11 of the Capital Improvement Master Plan for multiple municipal buildings and sites. This will include the space needs for the new development to the south of Apache Junction. 11. 23- 14 Presentation, discussion, and possible consideration of contract with Sunland Asphalt for parking lot and sidewalk/curbing work in various locations throughout the parks. The work would be through the 1 GPA Cooperative Contract, in an amount not to exceed $350,000.00 per year. The projects will be in fulfillment of general fund projects as well as projects associated with the Land Water Conservation Fund grant. Councilmember Cross moved,seconded by Councilmember Soller that the contract with Sunland Asphalt for various projects such as parking lot and sidewalk/curbing work in various city parks, and other general fund projects associated with the Land Water Conservation Fund grant in an amount no to exceed$350,000.00 per year,to be executed starting October 3,2023,through June 30,2024,be approved. City of Apache Junction,Arizona Page 6 City Council Meeting Meeting Minutes October 3,2023 Yes: 7- Mayor Wilson, Vice Mayor Schroeder, Councilmember Nesser, Councilmember Heck, Councilmember Johnson, Councilmember Cross and Councilmember Soller No: 0 Parks and Recreation Director Liz Langenbach presented the Sunland Asphalt contract, for various parking lot and sidewalk and curbing work throughout the City's parks. This would be an umbrella contract for the entire year, rather than requesting council approval for every project. Ms. Langenbach explained several of the projects planned for the upcoming year. Staff is requesting approval for the contract, in an amount not to exceed $350,000.00. Council items of discussion included a correction to the dates in the contract, term of the contract, contingency fund clarification, and budget funding. City Attorney Joel Stern clarified the date correction to the term of the contract be October 3, 2023, through June 30, 2024. K. COUNCIL DIRECTION TO STAFF L. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES M. CALL TO PUBLIC Gail Evans, 913 S. Del Rio Court, Apache Junction, shared an announcement of the upcoming Make A Difference on Saturday, October 7, 2023. Participants are asked to meet at the City Focal Point at 7:45 a.m., and the event will be from 8:00 a.m. to 11:00 a.m. Free T-shirts will be given. Devon Kling, 1928 W. 9th Avenue, Apache Junction, commented on an incident involving him being followed by an Apache Junction Police Officer. BACKGROUND In November 2002, the voters of Arizona approved Proposition 202 which initiated new gaming compacts between the State of Arizona and the native American communities ("communities"). An important provision of Proposition 202 was the sharing of gaming revenues with the state. Henceforth, communities would be assessed by the state a percentage of their gross gaming revenue. Communities had the option of either paying all of this assessment into a state- managed fund or pay 88% of the assessment into the state-managed fund and retain 12% of the assessment for distribution as grants. The Salt River Pima-Maricopa Indian Community ("SRPMIC") exercised its option to retain and administer 12% of state-shared revenue. The program makes "distributions to cities, towns, or counties for government services that benefit the general public, including public safety, mitigation of the impacts of gaming, or promotion of commerce and economic development." (See A.R.S. § 5-601.02(H)(4)). The law also stipulates that local nonprofit entities may submit applications to tribal entities if the nonprofit organization is "sponsored" by an appropriate municipality. In such cases, the municipality agrees to act as a conduit for the grant funds. The municipality receives the grant funds from the community and in turn issues a check to the nonprofit agency. DISCUSSION The Superstition Fire & Medical District (the "District") submitted a letter of interest to SRPMIC for Proposition 202 grant funding. The SRPMIC application is by invitation only and the District was invited to apply for funding. The District submitted an application dated August 14, 2023 and on August 29, 2023 the District was awarded grant funding in the amount of $111,983.83 for the following: • Ten Motorola APZ 8000 portable radios ($99,388.14) • Technical Rescue Equipment: ropes, pulleys, harnesses ($12,595.69) RECOMMENDATION Staff respectfully recommends the city council approve the proposed intergovernmental agreement and Resolution No. 23-33. Attachment 1: Resolution No. 23-33 Attachment 2: Intergovernmental Agreement -2- INTERGOVERNMENTAL AGREEMENT BETWEEN THE SALT RIVER PIMA-MARICOPA INDIAN COMMUNITY AND THE CITY OF APACHE JUNCTION This Intergovernmental Agreement("Agreement) is entered into by and between the Salt River Pima-Maricopa Indian Community ("SRPMIC"), a federally-recognized Indian Tribe, and the City of Apache Junction ("Apache Junction" or"City of Apache Junction"), an Arizona municipal corporation, pursuant to Section 12 Payment of Regulatory Costs; Tribal Contributions ("Section 12") of the SRPMIC and the State of Arizona Gaming Compact 2002 ("Compact"), as Amended and Restated in 2021, and Article VII, § 1(h) of the SRPMIC Constitution and A.R.S. § 5-601.02. RECITALS 1. The SRPMIC and the City of Apache Junction may enter into an agreement with one another for the distribution of a portion of 12% of the SRPMIC annual contribution ("Contribution")under Section 12 of the Compact to cities, towns, or counties that benefit the general public or promote commerce and economic development and pursuant to A.R.S. § 5-601.02(H)(4). 2. The SRPMIC is authorized by Article VII, Section I (h) of the Constitution of the SRPMIC to consult, negotiate, contract and conclude and perform agreements with federal, state, local governments and Indian Tribes, as well as any person, association, partnership, corporation, government or other private entity. 3. The City of Apache Junction is authorized by A.R.S. § 11-951 through § I I- 954, to enter into agreements for the purpose of accepting distributions to cities for governmental services that benefit the general public. 4. The SRPMIC desires to convey to the City of Apache Junction a portion of its annual 12% local revenue-sharing contribution ("Contribution") required to be paid to local governments. NOW THEREFORE, in consideration of the foregoing recitals, which are incorporated herein, and the covenants and promises set forth below, the SRPMIC and the City of Apache Junction hereby mutually agree as follows: AGREEMENT 1. Purpose. The purpose of this Agreement is to set forth the rights and responsibilities of the parties with respect to the payment and distribution of the Contribution(s), as hereinafter defined. The SRPMIC shall make a one-time payment to the City of Apache Junction to be disbursed as follows (the "Contribution"): $ 111,983.83 to the Superstition Fire and Medical District for Motorola radios and safety equipment. 3. Payment and Use of Funds. a. Use of Funds for Purposes Other Than to Fulfill Agreement. The City of Apache Junction shall use the Contribution only for the express purpose contained herein. b. Inspection and Audit. To ensure compliance with this Agreement, the SRPMIC hereby reserves the right to inspect any and all records maintained by the City of Apache Junction with respect to this transaction upon seven(7) days prior, written notice to the City of Apache Junction. The City of Apache Junction shall allow the SRPMIC reasonable access to the records pertaining thereto. This section shall survive termination, cancellation, or revocations, whether whole or in part, of this Agreement for a period of one (1)year following the date of such termination, cancellation, or revocation. 4. Disbursement of Contribution. a. Disbursing Contributions and Recordkeeping. City of Apache Junction shall have responsibility for disbursing the Contributions to the recipients in amounts consistent with this Agreement. Within a reasonable time following receipt of the Contributions from the SRPMIC, the City of Apache Junction shall distribute the Contributions in accordance with applicable City of Apache Junction policies and procedures governing the disbursement of funds. The City of Apache Junction shall keep and maintain records relating to the disbursements and this Agreement. b. Responsibilities of the City of Apache Junction Following Disbursement of Contributions. The parties agree that the City of Apache Junction is merely acting as a conduit for distribution of funds to the recipients that are not departments, agencies or offices of the City of Apache Junction ("non-City recipients"). Upon distribution of the Contribution to the non- City recipients as specified in Section 2 of this Agreement, the City of Apache Junction shall have no further responsibility to the SRPMIC with respect to such funds or the use thereof by the non-City recipients. Page 2 of 6 Therefore, upon the City of Apache Junction's payment of the contributions to the non-City recipients as provided in Section 2, the SRPMIC shall release the City of Apache Junction from any and all claims, demands, debts, liabilities, or obligations that may arise in the event that the non-City recipients fail for any reason to expend the Contributions in accordance with Section 2. The SRPMIC further agrees that the City of Apache Junction shall have no obligation to reimburse the SRPMIC the amount of the Contributions for any reason after it disburses the contributions to the non-City recipients and that the SRPMIC shall look solely to the non-City recipients for repayment of the Contributions in the event the contributions are not used for the intended purposes. 5. Notices. Any notice, communication or modification shall be given in writing and shall be given by registered or certified mail or in person to the following individuals. In the event the SRPMIC terminates this Agreement after the City of Apache Junction receives the Contribution but before the City of Apache Junction has disbursed the Contribution to the recipients, the SRPMIC shall include in the notice of termination specific instructions regarding disposition of the Contributions. 8. Indemnification. a. Indemnification. Each party (as "Indemnitor") shall indemnify, defend, and hold harmless the other party (as "Indemnitee"), its governing body, officers, departments, employees and agents from and against any and all suits, actions, legal or administrative proceedings, claims, demands, liens, losses, fines or penalties, damages, liability, interest, attorneys, consultants and accountant fees or costs and expenses of whatsoever kind and nature (collectively referred to as "Claims"),but only to the extent that such Claims which result in vicarious/derivative liability to the Indemnitee resulting from or arising out of the negligence or willful misconduct of the Indemnitor's employees or agents in performing the duties set forth in this Agreement. b. Severability. This section shall survive termination, cancellation, or revocation whether whole or in part, of this Agreement for a period of one (1)year from the date of such termination, cancellation or revocation unless a timely claim is filed under A.R.S. § 12-821.01, in which case this paragraph shall remain in effect for each claim and/or lawsuit filed thereafter,but in no event shall this paragraph survive more than five (5) years from the date of termination, cancellation or revocation of this Agreement. 9. Interpretation of Agreement. a. Entire Agreement. This Agreement constitutes the entire agreement between the parties pertaining to the subject matter contained herein, and all prior or contemporaneous agreements and understandings, oral or written, are hereby superseded and merged herein. b. Amendment. This Agreement shall not be modified, amended, altered, or changed except by written agreement signed by both parties. C. Construction and Interpretation. All provisions of this Agreement shall be construed to be consistent with the intention of the parties as expressed in the recitals contained herein. d. Relationship of the Parties. Neither party shall be deemed to be an employee or agent of the other party to this Agreement. e. Days. Days shall mean calendar days. Page 4 of 6 f. Severability. In the event that any provisions of this Agreement or the application thereof is declared invalid or void by statute or judicial decision, such action shall have no effect on other provisions and their application which can be given effect without the invalid or void provision or application, and to this extent the provisions of the Agreement are severable. In the event that any provision of this Agreement is declared invalid or void, the parties agree to meet promptly upon request of the other party in an attempt to reach an agreement on a substitute provision. 1.0. Non-Waiver of Sovereign Immunity. Nothing in this Intergovernmental. Agreement or any associated Funding Agreements shall be construed to waive the Sovereign Immunity of the SRPMIC. ' Page 2of6 Motorola Radio Upciradel Replacement The Superstition Fire& Medical District is seeking funding for 10 Motorola APX 8000 portable radios. Motorola has discontinued and canceled production of the APX 7000 as of February 2019, However, SFMD has continued to use these radios for as long as possible, but time is running out. We have been taking parts from existing radios past their life cycle to keep others working. But ultimately, we are at the point where new 8000 series radios must be purchased to ensure an appropriate number of radios in good working order. No other mission-critical communications tool keeps our firefighters and community safer. When firefighters are fighting a fire, they must have a radio that keeps them connected instantly and continuously, no matter the situation, regardless of background noise,weather, or long hours. Furthermore, they will also allow our Medic units (ambulances) to operate on VHF radio channels which are explicitly used for hazard zone communications. Our current medic unit radios do not have this ability and are sub-optimal technology. The medic units must remain in their ambulance using the apparatus radio to maintain effective communications. Suppose the paramedic team is needed in a forward position to treat either a victim or firefighter injury. During that time, they will not be in contact with anyone else on the fire ground, causing a dangerous delay in potentially life-saving treatment. If this grant were awarded, it would provide our apparatus with newer technology with an immediate impact. Proper communication equipment is crucial to our firefighters and citizens' safety. Again, these new portable radios will replace obsolete equipment currently in use by our firefighters and paramedics. Motorola has notified SFMD that they will not support the 7000 model moving forward and encourages SFMD to upgrade to the 8000 model. The Superstition Fire and Medical District also annexed 10 square miles within our District boundaries, slated for 10,000 new homes over the next few years. While we anticipate opening a new fire station with an additional engine company and medic unit, this will all be required before receiving tax revenue from the service area One of the most significant expenses is our portable radios and their charging systems. These radios are one of the most critical pieces of equipment we carry. Poor communication during emergency service delivery can lead to firefighter injuries and fatalities. Proper portable radio equipment is vital to maintaining safe and effective firefighting efforts. Update to Technical RescueGear to Conform to New ROC Standard The Superstition Fire& Medical Technical Rescue Team (TRT)was recently alerted to significant upcoming changes implemented valley-wide for ROC members and Auto Aid partners. For many years, regional TRT Teams have outfitted their standard gear cache with 13mm rope. However, the ROC decided to change course and switch to 11 mm rope as its new standard. This is a massive change as teams now not only have to purchase new rope, but also hardware that is designed for and compliant with the smaller diameter rope. This large financial undertaking is not something we can viably budget for on short notice in order to be compliant with our Automatic Aid and ROC partners. SMFD is asking for assistance in outfitting E262 and U262 with the 11rnm rope and hardware to be compliant with the new standard. This change does render much of our existing gear(13mm specific) obsolete for use in emergency settings for TRT response. Upon receipt of any new 11 mm gear, we can immediately be compliant with the new standard and be deployed seamlessly on responding TRT units: SFMD does have a plan, however, to use our currently serviceable 13mm equipment for training in the district and to outfit our REMS (Wildland TRT) as it is still compliant with United States Forest Service and AZ Department of Forestry and Fire Management standards. E262 is currently our only unit able to perform rope rescue with its complement of 13mm rope and gear, but a large percentage of these emergencies require the utilization of our Auto-Aid partners, making it vitally important that our gear and rope be compatible with theirs. U262 is dispatched for larger, Auto-Aid incidents with valley fire partners, also requiring a fully outfitted apparatus. Page 3 of 6 ! City permits for this Work will be provided to Contractor at no cost. Contractor represents and warrants at any license necessary to perform the work under this Agreement is current and valid. Contractor understands that the activity described herein constitutes "doing business in the City of Apache unction" and Contractor agrees to obtain a business license pursuant to Chapter 8 of the Apache Junction City Code,Vol. 1, and keep such license current during the term of this Agreement and after termination-of this Agreement any time work is performed pursuant to the warranty provisions set forth in Section s. Coverage shall be on an occurrence basis With a limit not less than $1,000,000 per occurrence, and the policy shall be issued by the same Insurance company that Issues Contractor's Commercial General Liability Insurance. 6 A mtomobile Liability Contractor shall maintain Commercial/Business Automobile Liability Insurance with a combined single limit for bodily injury and property damage of not less an $1,000,000 each occurrence with respect to Contractor's owned, hired, and non-owned vehicles assigned to or used in performance of Contractor's Work. Coverage will be at least as broad as coverage code 1, "any auto", (insurance Service Office, Inc. Policy Form CA 00011129S, or the equivalent thereof). Such Insurance shall Include coverage for loading and off-loading hazards. If hazardous substances, materials or wastes are to be transported, CS 90 endorsement shall be included and $5,000,000 per accident limits for bodily injury and property damage shall apply. SLIDs are created by the initial submittal of a petition to the city to form a SLID, and the subsequent approval of three separate resolutions: 1) the intent to form a SLID; 2) ordering the installation of streetlights within the SLID, and 3) setting forth the initial annual SLID budget. The 554 residential parcels of Blossom Rock Phase 1 have been approved. All 554 lots within Phase 1 are currently owned by Brookfield Properties Development who submitted to the city a Unanimous Petition for the SLID along with an exhibit showing the boundary of the SLID. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION ARIZONA, AS FOLLOWS : 1 . Acceptance and Findings . A petition (the "Petition") for the formation of the City of Apache Junction Street Lighting Improvement District ("SLID") No. 2023-SV-BR-1 (the "District") (see Map of District Boundaries, respectively Exhibit A) to purchase, and not generate, energy for street or public park lighting within the District and adjacent streets, has been filed with the city clerk and presented to the mayor and city council at the meeting at which this resolution was adopted. The Petition purports to be signed by all of the real property owners in the proposed District, exclusive of mortgagees and other lienholders . After verification of such ownership, the mayor and city council find pursuant to Arizona Revised Statutes ("A.R. S . ") § 48-615 (A) that the Petition was signed by all of the real property owners in the proposed District, exclusive of mortgagees and other lienholders . 2 . Declaration of Intention to Order Formation of the District . The public interest and convenience require and it is the intention of the mayor and city council to order the work through formation of the District pursuant to A.R. S . Title 48, Chapter 4, Article 2 . The District' s sole purpose shall be the purchase, not generation, of energy to operate the street lighting system as it now exists or is hereafter enlarged. The phrase "street lighting system" shall mean all publicly owned street and traffic lights and all wire, apparatus and other facilities now in place or hereafter constructed or acquired for the lighting of public streets and parks within the District and on adjacent streets . For purposes of this resolution and of all resolutions, RESOLUTION NO. 23-26 Page 1 of 3 ordinances and notices pertaining hereto, the SLID shall be known as and is hereby designated "City of Apache Junction Street Lighting Improvement District No. 2023-SV-BR-1" . 3 . Statutory Authority; Payment of Incidental Expenses . All proceedings pertaining to the District is authorized by A.R. S . Title 48, Chapter 4, Article 2, and all amendments thereto including, without limitation, §§ 48-616 and 48-617 . All incidental expenses shall become the obligation of the District, unless paid for by the signers of the Petition. The phrase "incidental expenses" shall mean the costs of posting, publication, recording and legal fees associated with the formation of the District and the annual levy of taxes . 4 . Protests, Objections, Waiver. In the Petition, the signers have made written consents and waivers pertaining to the ordering of the work and to the formation of the District and have specifically waived all protests and objections against formation of the District . City staff has verified such ownership and the mayor and city council find as a fact that all property owners within the District signed such Petition. Therefore, pursuant to A.R. S . § 48-617 (A) , no publication or posting of any notice pertaining to formation of the District will be made which is normally required under A.R. S . §§ 48-575 (C) and 48-578 . 5 . Engineer' s Estimate . As financing for the acquisition and construction of the initial street lighting system has been provided, the District' s sole purpose will be to purchase, and not generate, energy to operate the street lighting system. All owners of land within the District who signed the Petition waived the filing of an engineer' s estimate and no engineer' s estimate has been filed with the city clerk. 6 . Determination of Type of Lighting and Consideration of the Rate to be Paid. The type of lighting shall be the type now in place within the District which now comprises the street lighting system or such lighting facilities as may be required in the future by city engineering staff or some other entity for use within the District . The mayor and city council agree that the current rate to be paid for purchasing energy for the proposed district per street light per month and per kilowatt hour is set by the public service entity which provides the energy to light the streets (currently Salt River Project) and may be increased as they or their successors so determine in the future . The estimate of the District' s costs and expenses of purchasing energy for the operation of the street lighting system is subject to change or RESOLUTION NO. 23-26 Page 2 of 3 correction when the actual costs of operation are known and is subject to change due to inflation, new construction or acquisition of additional portions of the street lighting system. 7 . Compliance with City Outdoor Lighting Code . The District shall comply with the provisions of the Apache Junction City Code, Vol . BACKGROUND The creation of a Streetlight Improvement District ("SLID") is a means whereby the power expenses of streetlights are paid by the levy and collection of taxes based on the number of properties within the SLID. SLIDs are created by the initial submittal of a petition to the city to form a SLID, and the subsequent approval of three separate resolutions: 1) the intent to form a SLID; 2) ordering the installation of streetlights within the SLID, and 3) setting forth the initial annual SLID budget. The 554 residential parcels of Blossom Rock Phase 1 have been approved. All 554 lots within Phase 1 are currently owned by Brookfield Properties Development who submitted to the city a Unanimous Petition for the SLID along with an exhibit showing the boundary of the SLID. The above three described resolutions will be on the consent agenda at the October 17, 2023 city council regular meeting for final approval. BACKGROUND The creation of a Streetlight Improvement District ("SLID") is a means whereby the power expenses of streetlights are paid by the levy and collection of taxes based on the number of properties within the SLID. SLIDs are created by the initial submittal of a petition to the city to form a SLID, and the subsequent approval of three separate resolutions: 1) the intent to form a SLID; 2) ordering the installation of streetlights within the SLID, and 3) setting forth the initial annual SLID budget. The 554 residential parcels of Blossom Rock Phase 1 have been approved. All 554 lots within Phase 1 are currently owned by Brookfield Properties Development who submitted to the city a Unanimous Petition for the SLID along with an exhibit showing the boundary of the SLID. The above three described resolutions will be on the consent agenda at the October 17, 2023 city council regular meeting for final approval. WHEREAS, in accordance with the provisions of Arizona Revised Statutes ("A.R. S . ") § 48-616, the Street Lighting Improvement District 2023-SV-BR-1 (the "District") , the mayor and city council received the proposed District budget prior to October 17, 2023; and WHEREAS, notice of the hearing on the statements and estimates of expenses of the District (the "Budget") was duly published and the hearing conducted, all as required by law; and WHEREAS, the mayor and city council intend to adopt the fiscal year 2024 - 2025 final budget for the District; and WHEREAS, upon fixing, levying and assessing the amount to be raised by ad valorem taxes on all the real and personal property in the District or apportioned equally upon the number and classification of properties within the District, the city clerk is hereby directed to transmit a certified copy of this resolution to the assessor, recorder and board of supervisors of Pinal County, Arizona, with a request to collect such taxes in the same manner as general city taxes . NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION ARIZONA, AS FOLLOWS : 1 . Budget Adopted. The District budget attached hereto in Exhibit A in the amount of $3, 843 . 36 is hereby adopted as the budget of the District for fiscal year 2024 - 2025 . 2 . Amount to be Raised by Taxes . The amount of the District budget set forth in Section 1 of this resolution is hereby fixed, levied and assessed as the amount to be raised by the levy of ad valorem taxes on all the real and personal property in the District or through an equal apportionment of taxes based on the number and classification of properties within the District . There is hereby levied on each one hundred dollars ($100) of assessed value on all property, both real and personal within the District not exempt RESOLUTION NO. 23-28 PAGE 1 OF 3 from taxation, a tax rate sufficient (not greater than one dollar and twenty cents ($1 .20) ) to provide a fund for the annual expenses of the SLID, said amount to be collected in the same manner as the collection of general city taxes . 3 . No Invalidation of Proceedings . No irregularity in the fixing, levying or assessing the amount to be raised by ad valorem taxes or omission in the same, or irregularity of any kind in any proceedings shall invalidate such proceeding or invalidate any action to collect such taxes, including the conveyance of title by any tax deed, nor shall any failure or neglect of any officer or officers to perform any of the duties assigned to him or to them on the day within time specified will be an invalidation of any proceedings or of any action to collect such taxes or affect the validity of the assessment of the budget amount and levy of taxes or of the judgment or sale by which the collection of the same may be enforced, or in any manner affect the lien upon such property for the delinquent annual taxes unpaid thereon, and no overcharge as to part of the taxes or of costs shall invalidate any proceedings for collecting of the taxes or the foreclosure, and all acts of officers de facto shall be valid as if performed by officer de jure. 4 . Notice of Levy. The city clerk and city finance director are each authorized and directed to provide the certified duplicate copies of this resolution and such other documents as may be necessary to cause Pinal County to levy, assess and collect the amounts described herein from ad valorem property taxes, including the budget, to the Pinal County Board of Supervisors, County Assessor and County Treasurer. 5 . Conflicting Resolutions Repealed. All resolutions and parts of resolutions in conflict are hereby repealed.
