H. PUBLIC HEARINGS
Public hearings required by applicable law shall be conducted by the council and any person shall be

the mayor. This time limitation shall not apply to applicants and their agents appearing before the council.
8. 22-041 Presentation, discussion, public hearing and consideration of an
application for a class A bingo license for Kevin Osborne who resides
at Sundowner RV Resort, 105 N. Delaware Drive, Apache Junction,
Arizona. Mr. Osborne is requesting council's approval of the
application so he and other residents can hold bingo games within the
park for the benefit of its residents. City council recommendations will
be forwarded to the Arizona Department of Revenue for their final
action.

11. 22-072 Discussion on and consideration of approval of Resolution No. 22-03,
an intergovernmental agreement with Pinal County for election
services for the August primary election and, if necessary, the
November general election. This proposed intergovernmental
agreement with Pinal County is necessary in order to conduct the
August 2022 city primary and November general elections. Through
the intergovernmental agreement, we will obtain critical election and
voter-related services to include sample and final ballots, ballot
tabulation, precinct registers, early voting, and preparation and
distribution of ballots.

M. CALL TO PUBLIC
At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business.All speakers must have already submitted a written "Request to
Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the
agenda. If there is a group speaking on the same item, they should select a spokesperson.All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone
becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not
within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to
act. The council may not answer questions of the speaker, discuss the matter with one another, but may,
at the conclusion: 1)respond to criticism by a speaker, 2)ask the city manager to review a matter, 3)
ask the city manager to place the matter on a future agenda. Each speaker must approach the podium,
speak into the microphone,provide their name and address. There is a three(3)minute time limit per

Mayor Wilson and City Manager Powell welcomed Michael Pooley to the city.
City Clerk Pena swore in Michael Pooley as the Chief of Police.
Chief Pooley thanked the city council and city management for their support and said he is
looking forward to serving as the chief of police in Apache Junction.

2. 22-054 Consideration of approval of minutes of the regular meeting of January 18,
2022.
3. 22- 45 Consideration of approval of an award of contract to Viasun Corporation for

the slurry seal preservation of city streets within the Arroyo Verde Subdivision,
including portions of San Marcos Drive and 16th Avenue. The work is
scheduled to begin in mid-March and continue through April, 2022 via the Pinal
County Cooperative Contract No.175923 in the amount of$430,502.26, plus a
10% contingency for unforeseen change orders in the amount of$43,050.22;
for a total project cost not to exceed $473,552.48. This project is part of the
Fiscal Year 2021-2022 Capital Improvement and Street Maintenance Plan and
is funded by the .2% sales tax dedicated to roadway maintenance and repairs.
4. 22-052 Consideration of award of contract to Southwest Slurry Seal for the slurry seal
preservation of city streets within the Ironwood Estates I, Renaissance,
Arizona Grande and Cimmarron Superstition subdivisions. The work is
scheduled to begin in mid-February and continue through March, 2022 via the
Pinal County Cooperative Contract No. 175923 in the amount of$368,778.42,
plus a 10% contingency for unforeseen change orders in the amount of
$36,877.84; for a total project cost not to exceed $405,656.26. This project is
part of the Fiscal Year 2021-2022 Capital Improvement and Street
Maintenance Plan and is funded by the .2% sales tax dedicated to roadway
maintenance and repairs.

5. 22-055 Brief summary of intergovernmental updates from mayor and
councilmembers.
Coucilmember Schroeder announced that the counties in Arizona are still waiting for a court
ruling regarding the$70 million that were collected from the state-wide tax that was
implemented and still being held in escrow. He also said CAG Resolution No. 2022-2, the
expansion and capacity of the Superstition Mountain Community Facilities District No. 1,was
approved.
Councilmember Gremmel announced that the Greater Phoenix Economic Council (GPEC) held
their first board of directors meetingon January 20, 2022. She said the mission of GPEC is to
attract and grow quality businesses and advocate for the competitiveness of the greater
Phoenix area. She added GPEC is approaching 30 years of service. She said the greater
Phoenix area is moving away from the five 'C's (cotton, climate, copper, citrus, and cattle)to
now becoming a hub of technology and cyber security, autonomous automobiles and a
corporate nerve center. She said GPEC is becoming even move important with the growth of
the city.
Mayor Wilson shared that the Casa Grande Dispatch newpaper had a front page article and
pictures about the Apache Junction Founding Days centennial celebration.
G. CITY MANAGER'S REPORT
6. 22-056 City Manager's Report.
City Manager Bryant Powell shared that Chief Michael Pooley was sworn in as the chief of
police the previous evening.

7. 22-024 Desert Vista Elementary&Avalon Elementary honor students and student
council introductions.
Councilmember Gremmel welcomed and introduced the student council and honor students
from Desert Vista and Avalon elementary schools.
8. 22-046 Presentation and discussion with Superstition Horsemen's Association Board
Chairman Darryl Cross regarding community equestrian road safety. This is
follow up discussion from the September of 2021.
Superstition Horsemen's Association (SHA) Board Chairman Darryl Cross gave a presentation
on the Safe Ride Campaign.
Vice Mayor Rizzi asked if there was a way to donate to the safe ride project. Mr. Cross said
those interested can donate on the SHA website (https://sha4u.org)through Paypal. They will
also have a booth at Lost Dutchman Days. Vice Mayor Rizzi asked if the information can be
shared on the city's website or marquee. City Manager Powell said that can be done.
Councilmember Evans thanked Mr. Cross for the information and said the information applies to
bicyclists as well.
Councilmember Tesser asked if SHA contacted the Motor Vehicle Department to include this
information for new drivers. Mr. Cross said they haven't and said it was a great idea.
Councilmember Biggs said this would be good information for school districts to include the
drivers training for students.
Chouncilmember Nesser reminded drivers that pedestrians, bicyclists and horse riders have
the right of way.
9. 22-07 Announcement of current events.
Public Information Officer Al Bravo announced the winners of the Kids Idol Contest were:

Mr. Bravo also announced that February in Apache Junction means Lost Dutchman Days. Lost
Dutchman Days runs February 25th through the 27th. There is a parade and rodeo during the
weekend as well.The Lost Dutchman Marathon is Sunday, February 20, 2022.
He also said Horizon Health and Wellness is offering vaccines.

10. 22-070 Presentation and discussion on the history and purpose of Apache Junction
city code provisions set forth under Vol. I, Article 2-11, Health and Human

Services Commission, as well as Article 2-14, Requests for Financial
Assistance [from non-profit organizations], and the follow-up to
councilmember remarks from the June 4th, 2021 retreat which was held at
the Central Arizona College. Discussion on next steps in preparation for
possible City Council Direction to Staff.
City Clerk Pena presented the health and human services funding process that was revised in
2020.
The city council and staff discussed the ability and need of a community needs assessment
and how that can help direct funds where they are needed, and organizations receiving funds
whether year after year should continue receiving funds. They also discussed that ASU
previously conducted a study about homelessness in the community and the biggest obstacle is
funding. They also discussed the possible overlapping of services and how some recipients
may go from organization to organization to receive the same type of service. They also
discussed the public's mindset of homelessness is shifting and communities are using current
resources in their communities to address the issue. They discussed using a portion of the
funds to have a community needs assessment completed.
There will be an item on the February 15th, 2022 city council agenda so council can direct staff
to proceed with the organization of a joint meeting between city council and the health and
human services commission..

In December 2021, staff and developer counsel from D.R. Horton and Brookfield,
Inc., recommended adding § 3-7-19: Job Order Contracting ("JOC") to the
existing Apache Junction City Code, Vol. I, Chapter 3: Administration, Article 3-
7: Procurement Procedure.
The JOC method of procuring construction services is authorized by A.R.S. § 34-
605, et seq., as an alternative to the traditional design-bid-build more time
consuming procurement method. JOC allows the city to select a contractor on
an "on-call" basis for construction projects utilizing a "best value" approach
based on the company's demonstrated qualifications to perform the type of
work required. The City of Apache Junction started utilizing JOC procurement
within the last ten (10) years when the statute allowing JOC was implemented
and has consistently used JOC through cooperative contracts to deliver a wide
variety of construction projects. Under state law, individual JOC projects are
limited to one million dollars ($1,000,000) unless a higher maximum amount is
approved by city council.
The one million dollar ($1,000,000) limitation from the statute is not keeping up
with the construction cost index, inflation or major project demands. The city's
two new community facilities districts ("CFDs") include very high dollar
construction projects, not limited to roadway, water plant and well construction,
which can by themselves exceed one million dollars ($1,000,000) each. Public
Works staff recommends the increase to at least three million dollars
($3,000,000) as other multiple agencies and municipalities have chosen
inclusive of Mesa, Peoria, Phoenix, Gilbert, Tempe, Scottsdale, Chandler, ASU,
NAU, and UA. Increasing the limit will also improve the interest contractors
have in various city and CFD projects.

OF APACHE JUNCTION, ARIZONA, AMENDING APACHE JUNCTION

WHEREAS, On October 5, 2021, the mayor and council of the
City of Apache Junction, Arizona (the "City") adopted Resolution
Nos . 21-45 and 21-46 ordering and declaring formation of
Superstition Vistas Community Facilities District No . 1 and No.
2; and
WHEREAS, creation of community facilities districts ("CFDs")
serves as a method of reimbursing developers for certain critical
public infrastructure; and
WHEREAS, to build such infrastructure in today' s very
competitive construction industry market in an efficient manner,
the procurement of construction services can be obtained through
job order contracting ("JOC") ; and
WHEREAS, the current language of the code does not contain
guidelines for JOC provisions; and
WHEREAS, such modifications to the code were presented to
the council during a work session on February 14, 2022 and at a
public hearing on February 15, 2022; and
WHEREAS, municipalities may increase and set the maximum
allowable dollar amount per job order (currently $1, 000, 000 under
A.R. S . § 34-605, et seq. ) ; and
WHEREAS, staff and the developers who will be benefited by
the creation of the CFD have recommended an increase to the
statutory limit to meet construction industry demands .
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, AS FOLLOWS :
SECTION I IN GENERAL
That existing Apache Junction City Code, Volume 1, Chapter 3 :
Administration, Article 3-7 : Procurement Procedure, be amended by
adding new section 3-7-19 : Job Order Contracting, as follows :

A) Job order contracting procurement is permitted under this
code to maximize efficiency in high dollar construction projects .
B) Arizona law under A.R. S . § 34-605 (F) (1) sets the maximum
dollar amount of an individual job order at one million dollars
($1, 000, 000) .
C) This amount can be raised pursuant to the same statute by
the city council as long as contractual arrangements do not allow
job orders to be artificially divided or fragmented.
D) The maximum dollar amount under A.R. S . § 34-605 (F) (1) of one
million dollars ($1, 000, 000) is increased to three million
dollars ($3, 000, 000) per job order.
E) All other provisions set forth in A.R. S . § 34-605, et seq. ,
relating to job order contracting, are applicable to procurements
under this code .
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the codes adopted
herein are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion
of this ordinance or any part of the codes or regulations adopted
herein is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions
thereof.
SECTION IV PROVIDING FOR PENALTIES
Unless noted otherwise, any violation of any provisions adopted
herein, shall be punishable as a Class 1 Misdemeanor consistent
with Apache Junction City Code, Volume 1, Chapter 1 : General,
Article 1-8 : Penalty.

We have received the Election Services Intergovernmental Agreement from Pinal
County for the primary election on August 2, 2022 and the general, if needed, on
November 8, 2022. We are required to have the approved intergovernmental
agreement to the county at least 150 days prior to the election so that we both meet all
of our legal requirements.
Currently Pinal County elections department charges 75 cents per registered voter and
most services are covered in that fee.
This does not include election-related charges from Maricopa County, legal advertising
costs, Spanish translations, publicity pamphlets if necessary, postage for sample
ballots, etc.

INTERGOVERNMENTAL AGREEMENT FOR PROVISION OF SERVICES
BY THE PINAL COUNTY ELECTIONS
AND RECORDER DEPARTMENT
THIS AGREEMENT is entered into this day of , 20 ,
between Pinal County, a political subdivision of the State of Arizona, hereinafter referred to as"County",
and ,hereinafter referred to as "Municipality".
WHEREAS, A.R.S. Section 11-952 allows public agencies to contract for services and enter into
agreements; and,
WHEREAS, Municipality may hold Special/Regular elections for bond issues, recalls, overrides,
etc. pursuant to A.R.S. Sections 9-231, 9-523, 19-201 et seq., and,
WHEREAS, County is authorized,pursuant to A.R.S. Sections 11-251(3), 16-172, and 16-511, et
seq., to perform services concerning elections, and,
WHEREAS, County and Municipality have determined that the use of certain services of the
Pinal County Elections Department and the Pinal County Recorder's Office is in the public interest, and
the County agrees to provide such services.
NOW, THEREFORE, in consideration of the mutual covenants of and stipulations set forth
herein, the parties agree as follows:
1. The purpose of this Agreement is to secure the services of the County for the preparation and
conduct of election(s) to be held on

2. The Services provided by the County Elections Department are:
a. Prepare ballot formats for the Municipality to be approved by the Jurisdiction.
b. Provide the sample ballots with the Municipality measures' positions according to
precincts within the boundaries of the Municipality.
c. Provide sample ballots, if required, for public distribution and issue them through the
Municipality.
d. Provide ballots to be used in each precinct, which will allow qualified electors to vote for
the Municipality Candidates and/or Measures.
e. Conduct logic and accuracy tests as required by law and publishing all legal notices in
connection therewith.
f. Tally official results of the election(s), utilizing paper ballots or electronic ballot counting
equipment as mutually agreed upon between Municipality and County.
g. Cause the precinct election boards to utilize the copies of precinct registers,prepared from
the records of the County Recorder, for the purpose of identifying the electors qualified to
vote in the above-mentioned election(s).
3. The Services provided by the County Recorder are:
a. Provide copies of precinct registers of qualified electors for precincts contained partially or
wholly within the Municipality limits. Said registers shall be prepared from the voter
registration records of the County Recorder
b. Early Voting—Indicate only one below:
Municipality authorizes County Recorder to handle all Early Voting
Functions.
Municipality will be handling Early Voting functions. The County Recorder
will provide the following:
♦ A list of qualified electors who are eligible to vote early: such lists are to be
used solely by the Municipality for Early Voting, or such other election related
purposes as may be specifically authorized by law.
♦ A list of permanent early voters within the Municipality that are to
automatically be mailed an early ballot. Said lists shall be generated from the
voter registration records of the County Recorder.

4. Obligation of Municipality. The Municipality or designate thereof agrees to:
a. Provide the Elections Department with a certification of the measures to appear on the
official ballot for the Special/Regular election.
b. Provide a certified list of measures and the order of appearance of the measures to the
Elections Department ninety(90) days prior to the election.
c. Provide nomination petitions and other necessary information to prospective candidates for
council positions.
d. Accept candidates' nomination documents for filing.
e. Accept candidates' financial disclosure statements.
f. Accept all campaign finance statements and expenditure reports from candidates and/or
candidates' campaign committees.
g. Provide the County Elections Office with the names of any Write-in candidates as
prescribed by law.
h. Prepare and Issue certificates of the result of the election.
i. Publish all legal notices in connection with a municipal election with the exception of the
logic and accuracy test notification as described in Section 2(e) of this agreement.
j. If the Municipality chooses to conduct their own early voting, provide the County
Recorder, upon receipt and prior to processing early ballots, copies of the complete
Applications of Early Ballots for signature comparison by the County Recorder or other
officer in charge of elections as required by A.R.S. Section 1.6-550(A). These copies can
be provided by mail, hand delivery, or fax as time constraints dictate.
k. Pay to County, on a reimbursable basis, all costs of personnel, election materials, and
supplies expended by County pursuant to this Agreement. Municipality will make said
payment to County within fourteen (14) days after presentation by County of demand for
said payment.
1. If the Municipality chooses to conduct their own early voting, a list of all"Inactive Status"
electors who voted in the election pursuant to A.R.S. Section 16-583 shall be provided to
the County Recorder.
m. Agree to be a point of contact regarding conditional provisional ballots —in that a voter of
a conditional provisional ballot can take an acceptable type of personal identification to
qualify the subject conditional provisional ballot; document what type of identification is
provided indicating any identification numbers and issue dates; provide a daily receipt of
identification forms from conditional provisional ballot holders by the Municipality

Clerk's office that will be forwarded to the Voter Registration Department of the Pinal
County Recorder. This can be done by fax or hand-carried.
5. Manner of Financing and Budgeting. Each party represents that it has sufficient funds
available in its current fiscal year budget to discharge the funding obligation imposed by this
Agreement, and agrees that such funds shall be solely available therefore.
6. Termination. This Agreement shall terminate upon all matters connected with the election
being resolved, legal challenges excepted or upon written notice by either party to the other
within thirty (30) days of the effective date of this Agreement. Should the election herein be
challenged or questioned for any reason whatsoever, then, in such event, Municipality shall be
solely responsible for defending, legally or otherwise, said election.
7. Indemnification of County. To the extent allowed by law, the County agrees to indemnify
and bold harmless the Municipality from all injuries to persons or property caused by the acts
or omissions of the County arising out of the County's activities under this Agreement. To
the extent allowed by law, the Municipality agrees to indemnify and hold harmless the
County from all injuries to persons or property caused by the acts or omissions of the
Municipality arising out of the Municipality's activities under this Agreement.
8. Conflict of Interest. The parties have been advised of and are aware that the Pinal County
Attorney's Office represents both Pinal County and also the Municipality and have been
informed to seek the advice of outside counsel. The parties expressly and mutually waive any
adverse interest that may exist and also waive any allegations of conflict of interest by the
Pinal County Attorney's Office and expressly approve of the Pinal County Attorney's Office
dual representation.
9. Effective Date and Term of Agreement. This Agreement shall be effective upon approval
by the Pinal County Board of Supervisors, and shall terminate as provided in 6 above.

10. Nondiscrimination. The parties shall comply with Executive Order 2009-9 and all other
applicable State and Federal employment laws, rules, and regulations, mandating that all
persons shall have equal access to employment opportunities, and that no person shall be
discriminated against due to race, creed, color,religion, sex,national origin or disability.
11. Severability. If any provisions of this Agreement or application thereof to the County,
Municipality, person or circumstances is held invalid; such invalidity shall not affect other
provisions or applications of this Agreement, which can be given effect, without the invalid
provision or application and to the end the provisions of the Agreement are declared to be
severable.
12. E-Verify/Immigration. The parties warrant and represent to each other that they are in
compliance with the Federal Immigration and Nationality Act (FINA), A.R.S. Sections
41-4401 and 23-214, and all other federal and state immigration laws and regulations.
13. Cancellation. This Agreement may be canceled by either party for conflict of interest
pursuant to A.R.S. Section 38-511.
1.4. Governing Law. This Agreement shall be construed under the laws of the State of Arizona
and by applicable federal law.
1.5. Entire Agreement. This Agreement contains the entire agreement between parties concerning
its subject matter and any amendment to this Agreement shall not be made except by mutual
written agreement of the parties.
16. Notices. All notice required by this Agreement, such as notice of termination, shall be
sent by U.S certified mail, return receipt requested, or delivered by hand to the party at
the address indicated or such other address requested by notice to the other party. A
notice shall be considered given when received.

Notwithstanding the above, any routine communications between the parties that do not affect
the rights of obligations of the parties, such as communications regarding the election(s),

1.7. Waiver. A waiver by either party of any of the terms, conditions and covenants to be
performed by the other shall not be construed to be a waiver of any succeeding breach, nor of

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, PROVIDING NOTICE OF THE PRIMARY AND
GENERAL ELECTIONS TO BE HELD ON AUGUST 2, 2022, AND
NOVEMBER 8, 2022, RESPECTIVELY; DESIGNATING THE PURPOSE
OF THE ELECTION AND THE DEADLINE FOR VOTER REGISTRATION;
DESIGNATING THE PLACE AND DATE FOR CANDIDATES TO FILE
NOMINATION PAPERS; AND AUTHORIZING THE CITY CLERK TO
ENTER INTO ANY AGREEMENTS NECESSARY TO PROVIDE SERVICES
FOR SUCH ELECTIONS .
WHEREAS, the holding of Primary and General Elections is
enabled by law and prescribed by the City of Apache Junction, and
WHEREAS, the current term of the mayor and three
councilmembers will expire in January 2023; and
WHEREAS, the next mayoral term expires in January 2025 and
three councilmembers terms will expire January 2027 .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Apache Junction, Arizona, as follows :
Section 1 . That August 2, 2022, has been set as the time for
holding the Primary Election in the City of Apache Junction for
the purpose of electing the mayor and three councilmembers . Any
candidate for the office of mayor and the office of councilmember
may be declared elected at the Primary Election if he/she receives
a majority of the votes cast . If at the Primary Election there are
any offices to which no candidate was declared elected, then a
