CALL TO ORDER Mayor Virginia Seeman called the meeting to order at 7:00 P.M. at the Apache Junction City Hall. INVOCATION Councilman Eidson gave the Invocation. PLEDGE OF ALLEGIANCE Vice -Mayor John Granillo led the Pledge of Allegiance. Councilman Eidson seconded the motion. AWARDS,PRESENTATIONS AND COMMUNICATIONS ) Mayor Seeman presented Theron D.Adams and Arthur L.Strange with Certificates of AppreciationfortheirservicesonthePlanningand Zoning Commission. CALL TO THE PUBLIC (PETITIONS) Mayor Seeman called upon Madelene Van Arsdell,from the Bureau of the Census to speak on the 1980 Census and to answer questions of Councilmembers and the audience. Madelene Van Arsdell, Bureau of the Census,spoke on the importance of the 1980 Census and how the recordation of the population effects our community with Federal Revenue Sharing and Federal Grants and answered questions from the City Council and the audience. Madelene Van Arsdell,gave Mayor Seeman a Questionaire Reference book and a flyer with information about the census. Robert Condra, P. O.Box 515,Apache Junction,(does not reside in the City of Apache Junction) referred to the insert in the local newspaper and asked questions concern- ing the building department,stating he understood that the building codes were adopted on June 29th,1979 and questioned i f they were in effect atthistime. Mayor Seeman answered yes they are and called on staff to respond further. City Attorney Michael Curtis explained the exact content of what is in effect,is on file and is a matter of record. CITY COUNCIL MINUTES REGULAR MEETING 4/2/80 Page 3 Robert Condra stated hebrought with him a publication of the National Fire Protection Association, NFPA 70-78 and it was his understanding by reading the insert in the local newspaper that this publication was adopted for enforcement by the City of Apache Junction.His question was who,if anyone,on the City Council has read this publication,and also i f this is in effect for the residents of the City of Apache Junction,who is the electrical inspector? City Manager Lee stated we would have to refer that to the Fire District,which is another juris-diction. Mayor Seeman explainedthatfinancesaswellas space are a contributing factor as to hiring additional employees. Robert Condra inquired about City Contracts,as to who was under contract by the City on thecalibration of police and city equipment.He referred to odometer read- ings and police radar units. City Manager Lee called on the Director of Public Safety to answer Mr.Condra's questions. Director of Public Safety William McDaniel explained that all the radar units were recently calibrated by the factory less than a month ago. The factory name is CMI, and he would be happy to furnish Mr.Condra with the address and phone number of thelocationif he wants it. Mr.Condra answered he would like to address and phone number of the CMI company.Mr.Condra then asked a question in reference to his recent contact with the Police Department on why cash is not authorized by the Director of Public SafetyfortheCityinreferencetosubmittingandobtainingbail. City Attorney MichaelCurtisadvisedtheCity Council that this is a pending traffic violation and a criminal matter,and as a result of that,he would be more than happyto,i f the question is submitted in writing,give a complete explanation. He advised the City Council at this time not to engage in a public discussion on a pending criminal matter because someone could misinterpret or do otherwise with it. Mayor Seeman called on Robert Lawthe and asked i f he wished to speak on items 6, 7, and 8, atthistime since they had been deleted from the agenda. Robert Lawthe,156 N. Messer Dr.,Mesa spoke regarding multiple dwellings zoning that was initiated several months ago on Grand Street, stating he was informed by the Planning and Zoning Commission that they were trying to implement a Planned Develop- ment Zoning system in the City.He just wanted to say he was in favor of the Ordinance and found nothing wrong with it,and i f there is anything the Council could do to expedite this zoning. CITY COUNCIL MINUTES REGULAR MEETING 4/ 2/80 Page 4 Dan Andrews,1975 La Barge, Apache Junction (outside City Limits)explained his concern on the chargeforxeroxcopiesof Ordinances and felt i t is high and asked where the City obtained the rates,and i f there is anyway to amend the rates. Mayor Seeman answered that i t is a charge set by the previous Council and she would instruct staff to look into the matter. CITY MANAGER'S REPORT ) )City Manager Lee reported that the staff is pleased to announce that they did submit to the Governor's Office of Highway Safety the sign grant.The grant amount is fifty-four thousand,fifty-two dollars ($54,052)and the City staff hopes to start on that program soon. Councilman Damiano requestedthatCity Manager Lee explain to the Public where this money is coming from,stating that some citizens think their taxes are going to go up because of these signs. City Manager Lee called on the Director of Planning,Joe Gero, to answer Councilman Damiano's question. Director of Planning Gero explained that grant monies are coming from the Federal Highway's Act under the Safe Highways Program and are administered through the Governor's Office of Highway Safety.The grant amount is over $54,000 and the local match is $6,000 for a total cost of $60,000 to put up signs throughout the com- munity at the intersections,primarily to give locations for the emergency vehicles and also to be a convenience to the local public. RESOLUTION NO.80-10 ZONE OF INFLUENCE ) Mayor Seeman called upon the City Clerk to read the entire Resolution No.80-10. Acting City Clerk Ballard read as follows: RESOLUTION NO.80-10 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING ITS INTENTION TO CONSIDER THE FUTURE ANNEXATION OF CERTAIN AREAS CONTIGUOUS TO AND IN THE CITY'S ZONE OF INFLUENCE AND PROVIDING NOTICE THEREOF. WHEREAS,the City of Apache Junction contains an areas of approximately twelve (12)square miles;and WHEREAS,certain areas which lie outside the City limits are nevertheless contiguous to the City and are located within the City's zone of influence;and WHEREAS,good land use planning requires that different land uses which are contiguous to each other be compatible with each other;and WHEREAS,good land use planning will ultimately attract a good commercial and industrial tax base to serve the public interest and needs and will insure the fiscal soundness of both the City and the Apache Junction School District;and WHEREAS,in the interest of good land use planning the City is preparing a General Plan for the areawithintheCityandforthose areas contiguous to and in the City's zone of influence. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT: 1. The City of Apache Junction declares its intention to consider the future annexation of those lands contiguous to and in the City's zone of influence. 2.Further,the City of Apache Junction requests its municipal neighbors to refrain from annexingterritoryinPinalCountycontiguousto Apache Junction and in its zone of influence. 3.Further,the City Clerk is hereby instructed to provide notice hereof the publishing and postingthisresolutionand by sending certified copies to the Governor of the State of Arizona,the Commissioner of the Arizona Land Department, the Arizona Director of the Bureau of Land Management,the Central Arizona Association of Governments,the Mayors of the cities of Mesa,Chandler, and Gilbert,to Pinal County Board of Supervisors,and to the Base Commander of Williams Air Force Base. CITY COUNCIL MINUTES REGULAR MEETING 4/2/80 Page 6 Councilman Damiano asked if George Baljo wished to speak on this matter on behalf of the Planning and Zoning Commission. George Baljo,Chairman of the Planning and Zoning Commission stated that the Commission is aware of this matter and they are in favor of it. Vice -Mayor Granillo requested that the Zone of Influence be explained. Planning Director Gero explained that the Zone of Influence would be that area in which the City could reasonably expect the future development of the City to grow to and extend the City's services. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.80-10,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING ITS INTENTION TO CONSIDER THE FUTURE ANNEXATION OF THOSE LANDS CONTIGUOUS TO AND IN THE CITY'S ZONE OF INFLUENCE AND PROVIDING NOTICE THEREOF,BE AND IS HEREBY ADOPTED. AWARD OF BID,DEPARTMENT OF PUBLIC SAFETY,PROJECT NO.001-80 )Councilman Shanks requested a brief description of what a Recorder -Logger is. Director of Public Safety William McDaniel explained that the Recorder -Logger is a device set up in the communications section of the police department to record all incomingcallsand to record all radio messages received by or given out by thepolicedepartment.McDaniel further explained how helpful the Recorder- Logger is in the instance of a crime. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE BID FOR THE DEPARTMENT OF PUBLIC SAFETY,PROJECT NO.001-80,DPS, IN THE AMOUNT OF $11,040.00 BE AND IS HEREBY AWARDED TO DICTAPHONE,120 OLD POST ROAD,RYE,NEW YORK 10580 AS THE RESPONSIBLE BIDDER. the motion. VOTE:Unanimous Motion carried. Councilman Hill seconded CITY COUNCIL MINUTES REGULAR MEETING 4/2/80 Page 7 RESOLUTION NO.80-11,BOARD OF APPEALS ) Mayor Seeman requestedthattheCity Manager call on the Department Head to explain the Board of Appeals and how it will relate to the Board of Adjustment,stating they are two different functions. City Manager Lee called upon the Director of Public Works Richard Broman. Director of Public Works Broman explained that in creating the Board of Appeals,i f there is adifferenceof opinion in reference to code interpretation and construction methods,that they could be arbitrated by an impartial board and staff does not anticipate many of these cases,therefore,staff requests that the Board of Adjustments take that responsibility as the Board of Appeals.Bromanfuther explained that the Board of Appeals would hear those matters before them and then they would adjourn and the Board of Adjustment would hear thosematters before them,possibly using the same meeting night. Joe Barroco,688 No.San Marcos,-Apache Junction,requested to speak on the Recorder -Logger and stated that he had not had a chance to speak.. Councilmembers and staff re -explained the use of the Recorder -Logger. City Attorney Michael Curtis explained that from the city prosecutors point -of -view and from the prosecutor's in general,the importance to a prosecution case isoftentime,being able to identify when and where a conversation occurred or incident arose so that one can lay what is know as a "foundation"andthistypeof machine) Madam Mayor is a machine which as been used in prosecu-tion before and therefore,this particular model machine is one which staff can rely on from the prosecutor's point of view. Joe Barroco stated that the City could purchase a machine that could do the same job for less money. He realized that the machine takes messages in and out,and was sure that there are a lot of machines that record messages in and out. Mayor Seeman explainedthatthespecificationsof the Recorder -Logger were sent out to bid as required by our ordinance. Joe Barroco asked i f he could ask another question as i t seems that •'he couldn't get a chance totalkbefore.He said that he would like to know i f the City of Apache Junction has a contractors license. City Manager Lee answered no. Joe Barroco asked then why at the City Complex, does the permit say as "contractor"the City of Apache Junction? CITY COUNCIL MINUTES REGULAR MEETING 4/2/80 Page 8 Building Official Frazier answered that governmental agencies,(municipalities)are allowed to do work for themselves without a contractors license,as are certain other organizations,such as churches.I t happens in this case that the City can do its own contracting under State Law. Joe Barroco asked why theCity won't accept cash for bail,he stated that he has no criminal charges against him. Mayor Seeman referred Mr. Barroco to the Ctiy Attorney's Office and he will give his answer to you,if you wish to direct your question to him in writing.. Joe Barroco said he is not asking the City Attorney he is asking the Council why the City will not accept cash for bail.City Attorney Michael Curtis told Mr.Barroco that he would be happy to respond in writing. Curtis stated that he has also examined the record,and Mr.Barroco has refered consistently to the fact that he has not been afforded the opportunity to speak when the request that he filed,which,was filed late,does not contain any specification of any item on the agenda he wished to talk on, therefore,the mischaracterization that may go on the tape recordings,press and others is an erroneous one.Curtis stated that he thought that this document that Mr.Barroco filed ought to be made clear,that he has been afforded a chance to speak and they City Attorney's Office will deal with Mr.Barroco's question in writing,in the same amount of time,5 days. The City Attorney's Office will send Mr.Barroco a copy of the letter thatwillbesentto Mr.Condra. Mayor Seeman requestedthat Mr.Barroco refrain from the rest of his questions until Requests of Council,as the City Council was in •the middle of a discussion item of which Mr.Barroco's questions were not pertinent. Mayor Seeman continued with Resolution No.80-11 and called upon the City Clerk to read thetitleofResolutionNo.80-11. Acting City Clerk Ballard read as follows: RESOLUTION NO.80-11 A RESOLUTION OF THE CITY COUNCIL OF APACHE JUNCTION CREATING A BOARD OF APPEALS PURSUANT TO SECTION 204 -OF THE UNIFORM BUILDING_CODE,1979 ADOPTED BY THE CITY COUNCIL BY , REFERENCE. Robert Condra asked the Council i f they were going to have a Board of Appeals,he would like to know if qualified people would be on the Board of Appeals.If you have a mechanical contractors license,have a man qualified or individual qual-ified under the mechanical code.If you have an electrical problem before the Board of Appeals on an electrical installation,he suggested to the Council that it would be in the Council's behalf to have an electrialindividual expertise in an electrical situation. RESOLUTION NO.80-12 DEPARTMENT OF PUBLIC SAFETY ) Mayor Seeman asked i f the City Council understood the Resolution or they would like to go into furtherdetail. Councilman Shanks requestedthattheResolutionbebriefly explained. Director of Public Safety William McDaniel explained that the Resolution is authorizing him to enterintoanagreement with the Arizona Department of Public Safety to borrow vehicles for the use of under cover work and rotate the vehicles whenever they need another one.The City will have to provide insurance on thevehicle.The vehicles are State equipment used by the City at no cost to the City. Mayor Seeman called upon the City Clerk to read Resolution No. 80-12 by title only. EXECUTIVE SESSION, APRIL 16,1980, 6:00 P.M.) )Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT AN EXECUTIVE SESSION REGARDING PERSONNEL AND LEGAL ADVICE, BE HELD ON THE 16TH DAY OF APRIL, 1980, AT 6:00 P.M. Vice -Mayor Granillo seconded the motion. VOTE:Unanimous Motion carried. INFORMATION AND REPORTS Councilman Damiano read the following letters commending the City Staff on the News letter insert. Dear Marlis: I am writing in reference to the recent publication "NEWS FROM YOUR CITY".I find the issue inform-ative and interesting.I feel i t is a useful and necessary tool to inform citizens about their government. coming. Please keep the publication Respectfully,James R.Craig Dear Ray:It was with a great deal of pleasure that I have read the first copy of "NEWS From Your CITY".Virginia Seeman dropped one off on my desk this very day and also left a number of copies in the lobby to be distributed to the public. The articles will do morefortheimageof you people at Town Hall than anything that I have seen in the form of releases in the newspaper or any other media since Apache Junc- tion became a city.Obviously,a great deal ofeffortandcarefulplanning went into this news letter and I know that,properly distributed,the community will, for the first time,have an opport- unity to review the facts as they are. issue. Looking forwared to the next signed,Robert DeBow CITY COUNCIL MINUTES REGULAR MEETING 4/2/80 Page 11 REQUESTS OF COUNCIL )Councilman Hill explained the need of purchasing a front-end loader equiped with a Rotary broom,sweeper, mowing machine,post hole digger,and rear blade. Councilman Hill MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE PURCHASE OF A "CASE 580C LOADER LANDSCAPER"IN THE AMOUNT OF $18,073.00,PLUS TAX,FROM ACCOUNT NUMBER 03-780,HIGHWAY USER FUND,BE AND IS HEREBY APPROVED IN ACCORDANCE WITH THE PUBLISHED GOALS AND OBJECTIVES AND AS RECOMMENDED BY THE DEPARTMENT OF PUBLIC WORKS. Vice -Mayor Granillo seconded the motion. A question was asked by a person in the audience on who the front-end loader was being purchased from.Director of Public Works Broman answer that the equipment was being purchased from Case Power and Equipment.Vice -Mayor Granillo added that the City had been paying $100.00 per day for the rental of equipment simular to the one proposed to be purchased. City Manager Lee addedthattheCityisobligatedtoprovidethatnecessarystreetequipmenttoservicetheneeds of the community. Those funds must be spent on streets or street related equipment. Mayor Seeman requested the question by roll call. VOTE:Unanimous Motion carried. Mayor Seeman requested the appointment of two people to the Planning and Zoning Commission taken from the Talent Bank Applications.The two people are Ronald.E.Kell,860 E.Desert Avenue and John P.Hutchens,666 S.Delaware and entertained a motion for the appointment of these two people to the Planning and Zoning Commission. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA THAT JOHN P.HUTCHENS AND RONALD E.KELL ARE HEREBY CONFIRMED TO BE AND ARE HENCE FURTHER APPOINTED "MEMBER"OF THE PLANNING - AND ZONING COMMISSION OF THE CITY OF APACHE JUNCTION,ARIZONA FOR TERMS TO END JUNE 30,1982.Vice -Mayor Granillo seconded the motion. VOTE:Unanimous Motion carried. CITY COUNCIL MINUTES REGULAR MEETING 4/2/80 Page 12 Arlie Myers,528 So. Meridian requested the Council to look into the possibility of allowing the Building Official the right to release or give permits on smalladditionssuch as patios,500 square feet or less,stating something that be done within 5 or 10 minutes without going to the Planning and Zoning Commission for every thing. Building Official Frazier answered that he was probably referring to that fact that all building permits are also checked and cross-checked to make sure that they are con-sistent with zoning set backs and use intended.People are told they would get them back in a week to ten days,depending on the case load. Mayor Seeman asked how long does i t take to get a permit in Mesa.Arlie Myers answered 30 minutes. Mayor Seeman expressed the difference between Mesa and Apache Junction,stating Mesa is one hundred years old,they have developed their departments and have theexpertiseonboard.Mayor Seeman asked Mr.Myers to be patient with theCity,and stated she knew that things are taking longer than they should, but someday the City will be able to cross that bridge and you will be able to walk into Apache Junction City Hall 100 years from now and get a permit within 30 minutes. Robert Dugger,710 S. Lawson #17,Apache Junction made reference to Mr.Damiano's statement on the fact the Federal funds were not costing the taxpayer's any money.Dugger stated that City,County,State,Federal,i t is all his money and the City should not rely on Federal dollars. It will cost the City money in the long run,so Mr.Dugger requested the City to be very careful about relying on Federal money, as it could be very dangerous and end up costing the City a great deal of money in the future.The City gets Federal money now for a project,the City has to pay the maintenance later. Robert Dugger further commented on the Recorder -Logger and stated he was familiar with recorders and was able to install on a private phone system with five lines,intercomcapability,music on hold,the whole thing was considerably less. Joe Morvak,122 So. Doran Mesa,stated that he is attempting to do his best to attempt to help create a tax base for the City building homes,only within the City of Apache Junction at this point and time.Mr.Morvak expressed his appreciation in cutting down the length of time of paper work due to the rising costs and interest rates. Mayor Seeman reminded the audience that the staff may answer many questions and many of the Councilmembers are available during the day to answer questions and giveinformation.
