CALL TO ORDER Mayor Virginia Seeman called the meeting to order at 7:00 p.m.at the Apache Junction City Hall. INVOCATION Councilman Eidson gave the invocation. PLEDGE OF ALLEGIANCE Vice -Mayor Granillo led in the Pledge of Allegiance. ACCEPTANCE OF THE MINUTES OF REGULAR MEETING,JUNE 4, 1980 ) Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE MINUTES OF THE REGULAR MEETING OF JUNE 4,1980,BE AND HEREBY ARE ACCEPTED AS PRESENTED. AWARDS,PRESENTATIONS AND COMMUNICATIONS ) Mayor Seeman presented aCertificateof Appreciation to Muriel Swiegard for her contribution to the Swimming Pool Fund. Mayor Seeman presentedCertificates of Appreciation to George Baljo,Susan Sharp,and Ilene Taylor upon completion of their first term on the Planning and Zoning Commission. Mayor Seeman presentedCertificatesof Appreciation to Bill Furness and Bill Vaughn for servingtheir term on the Board of Adjustment. Mayor Seeman presented a Certificate of Appreciation to the Apache Junction Lions Club for theirpresentationof a commemorative coin to the City. A Certificate of Appreciation was also presented to the Democratic Club for their donation to the Swimming Pool Fund. The Chamber of Commerce was presented with Certificates of Appreciation for hosting the City's 16th Annual Lost Dutchman Days,for participation in the Town Hall Meeting onDisciplineand Career Education Day, and for participation in the 1979 Arizona State Fair Booth as a civic advertising arm of the City of Apache Junction. CALL TO THE PUBLIC (PETITIONS) ) Mayor Seeman pointed outthatthefirstreadingson Ordinance No. 50 and 51 are not public hearings and that i t is the second reading of Ordinances that are public hearings.After a first reading,the public may read an Ordinance and/or obtain a copy at City Hall. Mayor Seeman stated that anything the City Council does,public hearings are afforded.Ordinance 32, 33,and 34 had many work sessions,public hearings and will,again,appear on a future Council Agenda. Mayor Seeman called uponMartinKirk. Martin Kirk,Phoenix, spoke in opposition of Ordinance No. 34. Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT ORDINANCE NO.53,AN ORDINANCE OF THE CITY OF APACHE JUNCTION, PINAL COUNTY,ARIZONA,PROVIDING FOR THE REPEAL OF ORDINANCE NO.34;PROVIDING FOR A SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY BE ADOPTED. George Baljo,1070 Navajo, Apache Junction,Chairman of the Planning &Zoning Commission spoke in regard to Ordinance No.34,giving some history and background information concerning the reasons for this Ordinance. Mayor Seeman called upon Don Brooke. Don Brooke,1532 W. PalominoLn.,Apache Junction requested to go on record as being opposed to Ordinance No.50,Business License Fee Schedule. Mayor Seeman called upon Dan Andrews. Dan Andrews, 1975 N.LaBarge, Pinal County,spoke in opposition of Ordinance No.50. Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE APPLICATION FOR ORIGINAL APPLICATION FOR SPIRITUOUS LIQUOR LICENSE,SERIES 11,OFF -SALE RETAILER'S LICENSE TO SELL BEER,BY APPLICANT REVCO DRUG CENTER NO.641,BE AND HEREBY IS RECOMMENDED FOR APPROVAL TO THE DEPARTMENT OF LIQUOR LICENSE AND CONTROL. the motion. RESOLUTION NO.80-19,REDUCING TRAFFIC HAZARD POTENTIAL AT INTERSECTION OF HIGHWAY 88 AND U.S.HIGHWAY 60/89 ) The Director of Public Safety reported on the traffic problems and hazard potential referred to in Resolution No.80-19. The Council directed staff to send Resolution No. 80-19 to the State Representatives and Senators as well as the Governor and perhaps at the Federal level also. Mayor Seeman called upon the City Clerk to read the title of Resolution No.80-19. Mayor Seeman called the meeting back to order after a fifteen minute recess. City Clerk Oesterle read as follows: ORDINANCE NUMBER 51,AN ORDINANCE OF THE CITY OF APACHE JUNCTION,PINAL COUNTY,ARIZONA,PROVIDING FOR THE GOVERNING OF OPERATIONS OF SWAP MEETS:AMENDING CHAPTER 8 AND ADDING ARTICLE 8-6;AND PROVIDING FOR PENALTY CLAUSE AND SEVERABILITY CLAUSE. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT RESOLUTION NO.80-20,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH THE DEPARTMENT OF ECONOMIC SECURITY FOR THE YOUTH EMPLOYMENT PROGRAM,BE AND HEREBY IS ADOPTED. APPOINTMENT OF DEPUTY MAGISTRATE )Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT MR.LEO COOMBS BE APPOINTED DEPUTY MAGISTRATE TO INSURE UNINTERRUPTED SERVICES DURING THE INTERIM PERIOD UNTIL THE COUNCIL APPOINTS A FULL-TIME MAGISTRATE. Councilman Hill seconded the motion. VOTE:Unanimous CITY COUNCIL MINUTES REGULAR MEETING 6/18/80 PAGE 7 INFORMATION AND REPORTS )Councilman Burgess asked the City Manager about the status on the AORCC Grant for the ball parks and tennis courts. City Manager Lee reportedthat Mr. Short's office has stated that the Architects will be finished withthierpartof the work by the end of the month and then the City will put a bid package in motion. Mayor Seeman statedthatshe will,personally,not support any legislation that will initiate a property tax for the people of Apache Junction. REQUESTS OF COUNCIL ) Councilman Shanks requestedthatananswer be given to the lady with the trailer that has been "red tagged" by the Building Department. City Manager Lee reportedthatstaffisobligatedbyOrdinancetoadministerthoseOrdinances,however, should the Council wish to suspend a particular action or issue,staff is prepared to follow that direction. Mayor Seeman requested areportfrom staff to Council on the issue involving the particular incident in question.Any further action in regard to this matter will be delayed on anadministrativelevel.
