CALL TO ORDER Mayor Virginia Seeman called the meeting to order at 7:00 p.m. in theCityCouncilChambers. INVOCATION Councilman Eidson gave the invocation. PLEDGE OF ALLEGIANCE The presentation of the flags was given by Boy Scout Troop 184. Ms.Pat Smith,936 S.Bowman Road,Apache Junction,introduced to the Council the newly formed Superstition Horseman's Association and their board of directors.She informed the Council of the goals and philosophy of the organization as they concern the City. CITY MANAGER'S REPORT Mayor Seeman called uponCityManager Ray Lee for the City Manager's Report. City Manager Ray Lee announcedthatthesecondpayment from the U.S.Treasury Department on the General Plan Selected Elements had been received..He stated this is the Four Corners Regional Grant of $53,000.Mr.Lee then introduced Mr.Lant Haymore, of Haymore, Busby, &Dickey who would brief the Council and the public on the City's annual audit. Mr.Lant Haymore briefed the Council on the audit as of the fiscal year ending June 30,1980. He stated the examination revealed that things are in excellent shape and conformed togenerally accepted auditing standards.He stated the accounting records of the City have improved greatly over the past year. City Manager Ray Lee called upon the Director of Public Safety to discuss animal control activities. Bill McDaniel,Director of Public Safety,stated that many people in Apache Junction are not aware of the tremendous service given to the City by Dr.Mark Smith.Chief McDaniel stated Dr.Smith and Dr.Sheppard are examining the animals that are picked up at no cost to the City,and i f necessary,are disposing of animals humanelyfor $1.00 per animal.Chief McDaniel stated that during the month of September the City answered 150 calls in reference to animals;37 dogs and 32 cats were impounded;seven dogs and six cats were adopted out.He stated the City isgetting more animals now in one month than the County did in two months.Hestatedthe County,in the same month last year,picked up a total of 39 animals in the whole township.He stated people are calling more and bringing in more animals. PROPOSED ORDINANCE NO.59,PZ-10-80 GARTH ASLETT REZONING (SECOND READING) ) mayor Seeman opened the public hearing for proposed ordinance No.59,PZ-10-80,applicant Garth Aslett. She asked the Planning Director to brief the City Council and public on thepetition. Director of Planning,Joe Gero,briefed the City Council and public on the petition.He stated Mr.Matousek is representing the applicant.He stated the recommendation of the Planning and Zoning Commission was that the petition be denied by a vote of six to two. Mr.Gero also offered the alternatives to the Council for their consideration. Mr.Matousek who wished to address the petition.Mayor Seeman recognized Mr.Matousek stated he has changed the proposed use for the property to utilize i t for something along the lines of a hotel/motel,or apartment building. Mayor Seeman asked i f there was anyone in the public who wished to address the petition,either infavor of,or in opposition to. Mayor Seeman called upon the Planning Director for his recommendations. Mr.Gero stated the Planning and Zoning Commission recommended that the application be denied by a vote ofsixtotwo.He added the alternatives have been presented in the Council packets. Mayor Seeman closed the meeting to the public. Vice Mayor Granillo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT IN THE APPLICATION OF GARTH ASLETT FOR REZONING CASE PZ-10-80, ALSO KNOWN AS ORDINANCE NO.59;AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-10-80 FROM SINGLE FAMILY RESIDENCE (CR-1) TO GENERAL BUSINESS (CR-2);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY; BE,AND HEREBY IS,DENIED. the motion. UNFINISHED BUSINESS NEW BUSINESS PROPOSED ORDINANCE NO.67, INDEMNIFICATION OF OFFICERS,EMPLOYEES, AND COUNCILMEMBERS (SECOND READING) Councilman Hill seconded None. Mayor Seeman called upon the City Attorney to brief the public once again on the item. City Attorney Michael Curtis restated his explanation of proposed ordinance No.67. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE READING OF ORDINANCE NO.67,BE READ BY TITLE ONLY,AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Damiano seconded Mayor Seeman called upon the City Clerk to read the title of Ordinance No. 67 for the second reading by title only. City Clerk Rich Oesterle read as follows: ORDINANCE NO.67,AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, ADDING ARTICLE 2-10,INDEMNIFICATION OF OFFICERS,EMPLOYEES,AND COUNCIL MEMBERS,PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES,AND PROVIDING FOR SEVERABILITY. PROPOSED RESOLUTION NO.80-31 SUPPORT OF BUCKHORN-MESA FLOOD CONTROL PROJECT ) ) Mayor Seeman called upon Mr.Brase of the Flood Control District of Maricopa County. Mr.Sid Brase stated hisorganizationis one of the three sponsors of the Buckhorn-Mesa Watershed Projectalong with Pinal County Board of Supervisors and the East Maricopa Natural Resources Conservation District.Mr.Brase gave some of the background behind the project,an explanation of the project,the need for the project,and theconstructionschedulefortheproject.He stated that Apache Junction would have no responsibility as far as operating and maintaining the structure. Mr.Eidson asked to whatextentPinalCounty would be participating in the project and i f they did whattheir responsibilities would be. Mr.Brase stated i t ispossibletheCounty would pass a resolution supporting the project.He stated he is not asking for funding --the three sponsors will operate and maintain the project so there would be no financial responsibility placed upon the City. Mr.James Karam,Pinal County Board of Supervisors,addressed the Council on the project.He asked Mr.Brase about maintaining the structure;he stated there would be continual upkeep problems.He stated the maintenance of the channels have not been addressed and asked whose responsibility it would be to maintain them. Mr.Brase stated Maricopa County is responsible for the entire project except Weeks Wash. Mayor Seeman called upon the City Clerk to read the title of proposed Resolution No.80-31. City Clerk Rich Oesterle read as follows: RESOLUTION NO.80-31,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA TO SUPPORT THE BUCKHORN-MESA FLOOD CONTROL PROJECT. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL THAT RESOLUTION NO.80-31,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA, TO SUPPORT THE BUCKHORN-MESA FLOOD CONTROL PROJECT BE APPROVED. Councilman Hill secondedthe motion. VOTE:Unanimous The motion carried. AWARD OF BID,PROJECT CC -80-2 DATA PROCESSING EQUIPMENT ) Mayor Seeman called upontheCity Clerk to brief the Council on the recommendation. City Clerk Rich Oesterlereferredto the memo of September 29 which outlined a number of proposed usesfor data processing equipment.He stated those uses are either currently done manually or in some cases not being handled at all due to lack of staff or the current work load on staff.He stated that •data processing equipment becomes a very cost effective means to provide timely information due to its storage capacity and its almost instantaneous retrieval of information.He stated that the cost outlined in the Council packet is for the first twelve months of operation of the lease/purchase agreement;that the second through the fifth year costs decrease by about $3800 a year and then beginning the sixth year the costs decrease an additional $10,000.He stated from the sixth year on the cost of maintenance and software equipment of the data processing equipment runs around $7000 to $8000, so when the cost is being measured over a period of years,i t becomes very noticeable that based on today's cost ofsalaries,payroll burden,and overhead,the data processing equipment becomes a means by which necessary reports and information can be generated in the most cost efficient manner possible. Mayor Seeman asked i fthere were any questions. Vice Mayor Granillo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT IBM BE,AND HEREBY IS,AWARDED THE BID FOR A FIVE YEAR LEASE/PURCHASE FOR PROJECT NO.CC -80-2,DATA PROCESSING EQUIPMENT, FOR AN APPROXIMATE ANNUAL AMOUNT OF $21,240.26 FOR THE FIRST TWELVE MONTHS WITH A DECREASING COST FACTOR THROUGH THE NEXT FIVE YEARS AND OTHER DECREASES LATER ON,FROM ACCOUNT NO.5.0272, AN FY 1980-81 BUDGET ITEM. Councilman Damiano seconded EXECUTIVE SESSION,OCTOBER 15,1980 ) Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT AN EXECUTIVE SESSION REGARDING PERSONNEL AND LEGAL ADVICE BE HELD ON OCTOBER 15,1980,AT 6:00 P.M. IN THE CITY MANAGER'S CONFERENCE ROOM. Councilman Eidson secondedthe motion. VOTE:Unanimous The motion carried. INFORMATION AND REPORTS Mayor Seeman reminded the public that KSTM radio this Sunday at 7:00 a.m. and 8:30 p.m.would be a discussion with Rich Oesterle and Marlis Davis on overall administration of the City,personnel matters,and elections. Councilman Damiano reminded the public that Saturday, October 4th the Apache Junction Supporters would be in the Superstition Inn parking lot with a free Bar-B-Oue,visiting dignitaries, local officials,etc.She stated an open invitation has been extended. Chief McDaniels commended the Department of Public Works on the fine job being done on the highway and on the improvement:of the streets. Chief McDaniels commendation. Judge Coombs echoed Councilman Damiano commended the staff and employees on their dedicated service to the community and the City. REQUESTS OF COUNCIL Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE DIRECTION BE GIVEN TO THE CITY STAFF TO AMEND THE UNIFORM BUILDING CODE TO EXEMPT APPLICATIONS FROM PAYING PERMIT FEES FOR CONSTRUCTION UNDER $700. Councilman Eidson statedwiththis motion,the individual would still have to get a permit to do any work; however, i f the cost is under $700 it would be at no cost to the applicant. Councilman Damiano secondedthe motion. VOTE:Unanimous The motion carried. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT DIRECTION BE HEREBY GIVEN TO THE CITY MANAGER TO HAVE THE STAFF INVESTIGATE THE NEEDS TO DETERMINE METHODS WHEREBY THE ZONING PROCEDURES MIGHT ADJOURNMENT •There being no further business the meeting was adjourned by the Mayor at 9:05 p.m. APPROVED THIS 15th AND CITY COUNCIL.
