HomeMy WebLinkAbout1980-01-02 City Council Regular MinutesCITY COUNCIL MINUTES REGULAR MEETING JANUARY 2, 1980 A Regular Meeting of the City Council of Apache Junction was held on the 2nd day of January at the Apache Junction City Hall, pursuant to the notice as required by law. CALL TO ORDER Mayor Virginia Seeman called the meeting to order at 7:10 p.m. at the Apache Junction City Hall. PLEDGE OF ALLEGIANCE Cub Scout Dens 3 and 4, Troup 184 and Boy Scout Troup 184 led the Pledge of Allegiance. INVOCATION Councilman Eidson gave the Invocation. ROLL CALL Councilmembers Present:Mayor Virginia Seeman, Vice -Mayor Granillo, Norman Hill, Marie Shanks, Jimmy Eidson, Jerry Burgess, Thomas Damiano Councilmembers Absent :None Others Present :Bill Ellis, 1670 S. Councilman Damiano seconded the motion. VOTE: Unanimous - Motion carried. ACCEPTANCE OF THE MINUTES OF THE REGULAR MEETING OF DECEMBER 19, 1979 )Councilman Burgess MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE MINUTES OF THE REGULAR MEETING OF DECEMBER 19, 1979 BE ACCEPTED AS PRESENTED. AWARDS, PRESENTATIONS AND COMMUNICATIONS PUBLIC PETITION - FOUR-WAY STOP SIGN ) )Mayor Seeman called upon Planning Director Gero to brief the Council on this matter. Planning Director Gero reported that his office had received a petition signed by numberous persons located in the vicinity of South Idaho and Broadway, requesting the Council to consider a four-way stop sign at that intersection.This is currently being investigated by City officials and there will be a report submitted to the Council at a future meeting. Councilman Damiano reported that he had traveled the area being petitioned and that it is his feeling that there does exist a safety hazard at that particular intersection. ORDINANCE NO. 20, PERTAINING TO PROSTITUTION, HOUSES OF PROSTITUTION AND RELATED OFFENSES (FIRST READING) )Mayor Seeman explained that a letter from Mr. Robert M. Dugger, Chairman of the Pinal County Libertarian Committee, was delivered that afternoon, addressed to the City Council.One of the items discussed in the letter is Ordinance No. 20, regarding prostitution. Mayor Seeman asked if anyone from his affiliated party was present and wished to read the letter.There was no response from the audience. Councilman Damiano read the portion of Mr. Dugger's letter referring to Ordinance No. 20. Mayor Seeman called upon the City Clerk to read the title of Ordinance Number 20 for the first reading. City Clerk Ballard read as follows. Ordinance Number 20, an Ordinance of the Common Council of the City of Apache Junction, Arizona Amending Chapter 10, Apache Junction City Code, by Amending Section 10-1-17, Pertaining to Prostitution,Houses of Prostitution, and Related Offenses and Providing for Penalties and Providing for Severability. ORDINANCE NO. 18, BUSINESS LICENSE (SECOND READING) )Mayor Seeman reported that this is the second reading of Ordinance No. The Council discussed the reasons for the Business Licensing and the revenues that would be forthcoming and the protection afforded the businesses within the City. Regular Meeting -Jan. 2, 1980 Page 4 Persons expressing their views and asking questions regarding Ordinance No. 18 are as follows: Dan Andrews, 1975 N- LaBarge, not a City resident Bill Ellis, 1670 S. Saguaro, Mesa, Business Manager of the local Greyhound Track C.T. Parks, 1283 S. Cedar, Apache Junction Arthur Strange, 1173 Escondido, Apache Junction The general consensus of their comments were that if they would be charged a business license fee, how much would they be charged and would the Mayor and Council consider charging a lesser quarterly fee. Mayor Seeman reported that the City Council, in their Work Session, reviewed and made comparisons of fee schedules from other cities of comparable size. The general feeling at the Work Session was that the Council should look at this license for six months and see if there has been too much charged, or not enough: we should not make money on it, as it is only a method of control. Councilman Eidson reported that he had talked to some of the local small businessmen and every one of them had felt that the fees were reasonable and would prefer an annual charge, which might help to eliminate some of the vendors who come in to sell on a very short term basis and move on. Councilman Shanks reported that she feels a token $5.00 fee would be adequate for the local businesses and that exceptional fees be imposed upon outside peddlers or undesirable business applications. Councilman Hill pointed out that a business license fee is tax deductable. Vice -Mayor Granillo reported that these fees may be reviewed on a yearly basis and any necessary adjustments can be made. Assistant City Attorney Goodwin reported that, in regard to a General Law City, by Statute the license cannot be for a period of more than one year and it cannot be for less than $10.00 per year nor more than $5,000.00 per year: and these are the only provisions that State Statutes have for General Law Cities on business licenses Vice -Mayor Granillo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE READING OF ORDINANCE NUMBER 18 BE READ BY TITLE ONLY AND THAT THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Ordinance No. 18, An Ordinance of the City of Apache Junction, Pinal County, Arizona Providing for a Licensing of any Person, Firm, Corporation or Association for Carrying on any Trade, Business, Game or Amusement, Calling, Profession or Occupation and Fixing the Amount of License Taxes Providing for Payment of Public Utility Taxes; Amending Chapter 8 and Adding Article 8-5; Providing for Penalty Clause and Severability Clause.
