REGULAR MEETING
March 18,1981
The regular meeting of the City Council of the City of Apache Junction,Arizona,
was held on March 18,1981 at the Apache Junction Council Chambers pursuant to notice
required by law.
CALL TO ORDER
Mayor Seeman called the meeting to order at 7:00 p.m.
INVOCATION
Mr.Theron Adams led the invocation.
PLEDGE OF ALLEGIANCE
The Council and public participated in the Pledge of Allegiance.

ACCEPTANCE OF THE MINUTES OF

THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
AWARDS,PRESENTATIONS,AND COMMUNICATIONS
There were no awards,presentations,or communications.
CALL TO THE PUBLIC
Mr.Allen F.Lloyd,1019 E.Granado Avenue,addressed the practice within
the City of attaching advertising material to door -knobs.He stated that thepolice department advises residents to make their homes appear lived in i f they
are going to be away from home for awhile.He stated when paper is stuck behind
the door -knob for several days i t is an invitation to vandalism and burglary.
Mr. Lloyd requested that this type of activity be discouraged.
Director of Public Safety Bill McDaniels stated he does not think there is
anything in the City's ordinances prohibiting people from passing out materials;
nor was there anything in the ordinances requiring the issuance of permits for the
passing out of handbills.He stated a permit is only issued for the purpose ofsolicitingorpeddling.He stated he felt this was something that should be re-searched with legal staff to ascertain whether or not there was any legal way to
prevent anyone from passing out printed materials.
Mayor Seeman directed staff to research the necessary information and bring
i t back to the City Council to see what rights there are with regard to the question
of passing out printed materials.
CITY MANAGER'S REPORT
City Planner Joe Gero stated the street map recently approved by the Council
has been mylar reduced,i t is about 16 inches square,and is available to the
public for $.50 which is the cost of reproduction.
Director of Public Works Rich Broman stated the installation of street -signs
is nearing completion.He explained some of the problems that have been encountered
in the project and asked that the Community grant the City the benefit of a few
months to correct a situation that has existed within the City for many years.
Director of Public Works Rich Broman stated the Community Services building
is nearing completion and will be occupied for official business by Monday. He
thanked Mr.and Mrs.Castro for the use of their workshop facilities to build
counters for the main entrance to the Community Services building.He further
thanked Leo Frazier and Richard Keller for their work on pulling the effort together.

PROPOSED ORDINANCE NO.86,PZ-1-81,
AMENDING THE ZONING ORDINANCE,SECTION 2503,
PUBLIC HEARINGS,(FIRST READING WITH EMERGENCY CLAUSE))

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT THE READING OF ORDINANCE NO.86 IN ITS ENTIRETY BE WAIVED.

the motion.

THAT BE IT RESOLVED BY THE. MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT IN ZONING CASE PZ-1-81,APPLICATION BY COMMISSION INITIATIVE,ALSO
KNOWN AS ORDINANCE NO.86,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION ZONING ORDINANCE BY
AMENDING SECTION 2503 PUBLIC HEARINGS; REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY,BE AND HEREBY IS,APPROVED
AND ADOPTED.BE IT FURTHER RESOLVED THAT THE REASONS FOR APPROVAL OF THIS MOTION
ARE THOSE REASONS AS SET FORTH BY THE PLANNING AND ZONING COMMISSION WHICH ARE
HEREBY ADOPTED BY REFERENCE.

The motion carried.
The reasons provided by the Planning and Zoning Commission was that Ordinance No.86
would correct a provision in the City Ordinance in conflict with a State Statute.
OLD BUSINESS
INDUSTRIAL DEVELOPMENT AUTHORITY,
ELECTION OF A BOARD OF DIRECTORS

THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION THAT
THE RESIGNATIONS OF VIRGIL JOHNSON,DOROTHY JOHNSON,AND RUBY MAE FORSBERG FROM THE
APACHE JUNCTION INDUSTRIAL DEVELOPMENT AUTHORITY HERETOFORE TENDERED TO THE CITY
COUNCIL BE,AND HEREBY ARE,ACCEPTED.

THAT PURSUANT TO A.R.S.9-1155,THE FOLLOWING SLATE OF DIRECTORS OF THE APACHE JUNCTION
INDUSTRIAL DEVELOPMENT AUTHORITY BE,AND HEREBY ARE,ELECTED BY THE CITY COUNCIL TO
SERVE ON THE BOARD OF D_IRECTORS OF THE APACHE JUNCTION INDUSTRIAL DEVELOPMENT AUTHORITY:
WILLIAM WRIGHT,RICHARD METZ,JOHN DRUMMOND, WALTER KESTELOOT,DR.DEAN SEEMAN,AND
SAM GARDOM.BE IT FURTHER RESOLVED THAT DR.DEAN SEEMAN AND WILLIAM WRIGHT SHALL
HOLD OFFICE FOR SIX YEARS,THAT SAM GARDOM AND RICHARD METZ SHALL HOLD OFFICE FOR
FOUR YEARS,AND THAT JOHN DRUMMOND AND WALTER KESTELOOT SHALL HOLD OFFICE FOR TWO
YEARS AND THAT THEREAFTER ALL TERMS OF THE DIRECTORS SHALL BE FOR SIX YEARS.

THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT BRISCOE,INC. BE AWARDED THE BID FOR PROJECT NO.PW-81-1,PARKING
IMPROVEMENTS TO THE CITY HALL COMPLEX -ROAD EXTENSION TO MAINTENANCE YARD AND
ANIMAL CONTROL SHELTER,IN THE AMOUNT OF $8,732.70,CONDITIONAL TO THE AVAILABILITY
OF FUNDS.

APACHE JUNCTION, ARIZONA,THAT AN EXECUTIVE SESSION REGARDING PERSONNEL AND LEGAL
ADVICE BE HELD ON APRIL 1,1981,AT 6:00 P.M. IN THE CITY MANAGER'S CONFERENCE
ROOM.

There was no information and there were no reports.
REQUESTS OF COUNCIL
Councilman Damiano read from a recent article in the Apache Sentinelreferringtothe method the Disincorporation group intends to use to dispose of
the local government.He outlined the requirements within the Arizona Revised
Statutes for general law cities and stated the structure proposed by the Disincor-
poration Committee would be in violation of the Statutes.
