REGULAR MEETING
AUGUST 19,1981
The regular meeting of the City Council the City of ApacheJunction,Arizona,was held on August 19_,_-i981, at the Apache Junction
Council Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Clarke called the meeting to order at 7:00 p.m.
INVOCATION
Councilman Eidson led the Invocation.

ACCEPTANCE OF THE MINUTES OF THE
REGULAR MEETING OF AUGUST 5, 1981 )
)Councilman Damiano MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE MINUTES OF THE REGULAR MEETING OF AUGUST 5,1981,BE AND
HEREBY ARE,ACCEPTED AS PRESENTED.
Councilman Hudson seconded the motion.
VOTE:Unanimous

AWARDS,PRESENTATIONS,AND COMMUNICATIONS
Councilman Shanks gave a history background on the life of Eleanor
Lewis before presenting her with a Certificate of Appreciation.
Her parents moved to Kings Ranch in 1948,and she moved to
Apache Junction in 1950. She was teaching in Safford at
the time,but this was her home then.
When Superior began their first school,she was one of theirfirstteachers.
In 1953,she was a member of the Civic Club of Apache Junction,
which was the first organization to further the interest of
Apache Junction.She also helped organize the Club and
became Secretary the first year,the next year she was voted
in as Vice President.
She was the driver of the first school bus in Apache Junction,
her own car.She picked up kids as far as Sand Tanks,and
squeezed them all into her car.
She was the first head teacher of the first school in Apache
Junction.The school consisted of two rooms,four teachers,
and she taught the first ,and second grades.Until her last
year,when she taught the sixth,seventh,and eighth grades.
She enjoyed her last year the most,as she had a great group
of kids.
She has always been interested in library work,and was
involved three years before the Library Board appointment.
She had made donations to the Library for years,for
memorials for long standing citizens.She was the firstPresidentoftheLibrary Board.
She is a member of the Lost Dutchman Retired Teacher's
Association,helped organize it,and was the first
Secretary of that organization.She is also the
Chairman of the Legislative Committee of the Lost
Dutchman Retired Teacher's Association.They also
do work with the Legislature.
"There are presently 51 citizens of Apache Junction serving on
Boards,Commissions,or Committees.They represent all walks of life.
These people give their time and knowledge to help the City grow in ahealthfulandprosperousway. These people deserve our appreciation from
time to time.
I have attended Committee meeting and worked with one person who to me
has put in more time and effort than has been required of him.This
person has studied hard.He has done his homework.This person has earned
the respect of his committee members,the public,the Council and the staff.
I believe that the Planning and Zoning Commission is probably the most
important Commission to any city.Certainly,the decisions they make
touch more of the citizens than any other Commission,Board,Committee."Mayor Clarke stated he wanted to present a Certificate of Appreciation to
George Baljo of the Planning and Zoning Commission.

CITY MANAGER'S REPORT
City Manager,Ray Lee stated that the Department of Economic Securityfacilityplansto open on September 1, 1981.
City Manager,Ray Lee called upon Mr.John Granillo who briefed the
Council and public on the purpose and uses of the DES facility stating,"It will be used for food stamps, unemployment,job service,and many
other services."

THAT THE READING OF ORDINANCE NO.105,BE READ BY TITLE ONLY,AND THE READING
OF THE ENTIRE ORDINANCE BE WAIVED.

Councilman Damiano seconded the
motion.
Councilman Damiano recommended alarge turnout of interested citizens if a rehearing is granted to be
held in Apache Junction.
Councilman Steelsmith requestedthattheResolutionbereadinorder that those present may be aware of
what was being sent to the Corporate Commission.
Mayor Clarke called upon the City
Clerk to read the entire Resolution.

RESOLUTON NO.81-14,A RESOLUTION
OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,
REQUESTING THE ARIZONA CORPORATION COMMISSION TO REVIEW THE RECENT RATE
INCREASE GRANTED TO PALM SPRINGS WATER COMPANY,A SUBSIDIARY OF CONSOLIDATED
WATER UTILITIES,AND TO CONSIDER TAKING APPROPRIATE ACTION.
WHEREAS,a substantial portion of the Palm Springs Water Companycertificatedarealieswithinthecityof Apache Junction,Arizona;and
WHEREAS,citizens of this city residing in the Palm Springs Water
Company certificated area must rely on said company for delivery of
domestic water as a basic need; and
WHEREAS,i t is commonly understood that this service is providedfor the public health,safety,and welfare but that,as a private water
company, Palm Springs Water Company is entitled to a reasonable profit;
and,
WHEREAS,numerous citizens of Apache Junction have approached andpetitionedtheCityCouncilwithregardtothenewPalmSpringsWaterrates,
such rates which these many citizens canted are beyond their economic means
and are excessive for the service provided,all matters considered;and
WHEREAS,several hundred of these citizens did attend and,through
spokesmen,made comment at the Commission's public hearing on the proposedrate increase,such comment which seems to have been made but not witheffect;and
WHEREAS,the numerous citizens are requesting the City Council topetitionthe Arizona Corporation Commission,whose duty i t is to establishfairrates,and to request a new public hearing and review of the recent
decisions;
NOW THEREFORE,BE IT RESOLVED by the Mayor and City Council of theCity of Apache Junction, Arizona,that this Council does hereby request
the Arizona Corporation Commission to review its most recent decisionwithregardto Palm Springs Water Company; and
BE IT FURTHER RESOLVED that i t is hereby requested that the Commission
hold a public meeting in Apache Junction to explain the most recent decision
and,i f permitted by law,to take further public comment and any appropriateactiondeemednecessary.

TEMPORARY SIGN PERMIT
)Rich Broman,Director of Public Works,briefed the Council and public on the application.He stated that thelocationsofthesignswould be approved by the Director of Public Safety
before they are allowed to be placed.
Councilman Eidson MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT A PERMIT BE GRANTED TO MR.JIM URBAN FOR THE TEMPORARY
PLACEMENT OF SIGNS IN THE CITY RIGHTS -OF -WAY,AS DESCRIBED AND ACKNOWLEDGED
PER ATTACHMENTS DATED AUGUST 11,1981.

BUDGET ALTERNATIVES FOR
FUNDING OF SPRINKLER SYSTEM )
)City Manager,Ray Lee briefed the
Council on completing the sprinkler system at the joint ballfield projectlocated at the Apache Junction High School.He stated that the ApacheJunctionSchoolswillbe matching the amount provided by the City of ApacheJunction.
Councilman Hudson MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT FUNDS IN THE AMOUNT OF $6,000.00 BE SET ASIDE IN ACCOUNT NO.542.21.11
GENERAL FUND CONTINGENCY, TO COMPLETE THE SPRINKLER SYSTEM AT THE JOINT
CITY/SCHOOL BALLFIELD SITE.
Councilman Damiano seconded themotion.

APPOINTMENT OF PERMANENT
PERSONNEL BOARD
)Councilman Shanks MOVED THAT ITEM NO. 9,
APPOINTMENT TO THE PERSONNEL BOARD,BE TABLED UNTIL THE REGULAR COUNCIL MEETING
OF SEPTEMBER 2,1981.
Councilman Damiano seconded themotion.
VOTE:Unanimous
Mayor Clarke suggested that the
amount requested be increased,because the amountrequested would only
provide for the absolute necessary space and the City would probably have
to expand again in the next few months.
Councilman Eidson requested Chief
McDaniel to tell him the additional amount necessary to accomplish the
expanded size suggested by Mayor Clarke.
Mayor Clarke stated that he believedthattheamountnecessary was estimated at $4,000.00.
Councilman Eidson MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE CITY MANAGER BE AND HEREBY IS,AUTHORIZED TO EXPEND
FUNDS IN ACCORDANCE WITH THE PROVISIONS OUTLINED IN THE CITY CODE FROM
ACCOUNT NO.005-114-533-12-72,IN THE AMOUNT OF $14,000.00 TO PURCHASE
MATERIALS TO CONSTRUCT A ROOM ADDITION FOR THE DEPARTMENT OF PUBLIC SAFETY.
Councilman Damiano seconded the
motion.
City Manager,Ray Lee,suggested to
add to the motion an authorization for him to transfer funds from the
Congingency Account as the Public Safety Capital Outlay account did notcontainfundsfor the additional amount.
Councilman Hudson MOVED THAT THE
MOTION BE AMENDED BY ADDING "AND FROM CONTINGENCY ACCOUNT NO.001-105-512-
06-76."

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT AN EXECUTIVE SESSION BE HELD IN THE CITY HALL OF APACHE
JUNCTION, ARZIONA, ON SEPTEMBER 2,1981,AT 6:00 P.M.FOR THE PURPOSE
OF DISCUSSING PERSONNEL AND LEGAL MATTERS.

•INFORMATION,REPORTS, AND REQUESTS OF COUNCIL
Director of Planning,Joe Gero,statedthat the City of Apache Junction wants to notify the Bureau of Land Management
of our definite interest in the 200 acres that is available as a recreationalpark.The purchase price now is $2.50 an acre,and beyond March of 1982,theprice will be full market value,at which time the land will be offered to the
State Land Department.

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,
THAT RESOLUTION NO.81-15,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA,EXPRESSING THE CITY INTEREST TO APPLY, BY
A RECREATION AND PUBLIC PURPOSES APPLICATION,FOR CERTAIN BUREAU LAND MANAGEMENT
LANDS CONTINGUOUS TO THE CITY LIMITS.
Councilman Damiano seconded the motion.
Councilman Hudson asked i f the land
purchased by the City would automatically become part of the City incorporation.
City Attorney,David Alexander,informed
the Council that purchasing the land would not mean it was annexed.The City
would have to go through the necessary channels for annexation.

Councilman Shanks gave a brief report on
the Parks and Recreation Commission.She stated that Apache Junction should
have a chance for some of the Social Service grants opportunities available to
most of the valley,but at present Apache Junction has been overlooked.
Councilman Hudson introduced Mr.Jim Urban
to describe his boxing programs. Mr.Urban briefed the Council with regard to his
programs stating that September 16,1981,Mayor Clarke and Joe Jessamine will be
boxing each other.
Mayor Clarke MOVED THAT BE IT RESOLVED
BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT
THE CITY ATTORNEY BE AND HEREBY IS,DIRECTED TO PREPARE THE NECESSARY PAPERWORK
ON BEHALF OF THE CITY OF APACHE JUNCTION IN ORDER FOR THE LIBRARY ASSOCIATION
TO DONATE THE EXISTING LIBRARY, IF THAT ASSOCIATION IS LEGALLY CAPABLE OF
TRANSFERRING ITS ASSETS TO THE CITY OF APACHE JUNCTION, SAID PREMISES BEING LOCATED
AT 122 EAST 2ND AVENUE,TO THE CITY OF APACHE JUNCTION;BE IT FURTHER RESOLVED
THAT THE FOLLOWING STIPULATIONS, BE INCLUDED:
(1)THAT THE LIBRARY REMAIN A COMMUNITY LIBRARY;AND(2)THAT IF THE CITY BUILDS ANOTHER LIBRARY IT BE A
PERMANENT BUILDING.
Councilman Steelsmith secondedthe motion.
VOTE:Unanimous

Mayor Clarke recognized Mr.Richard Taylor,
ADJOURNMENT
There being no further business to discuss,Mayor Clarke adjourned
the meeting at 8:26 p.m.
