CALL TO ORDER Mayor Clarke called the meeting to order at 7:00 p.m. INVOCATION Councilman Eidson led the Invocation. PLEDGE OF ALLEGIANCE Councilman Hudson led the Pledge of Allegiance. ACCEPTANCE OF THE MINUTES OF THE SPECIAL MEETING OF SEPTEMBER 4,1981 ) )Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE MINUTES OF THE SPECIAL MEETING OF SEPTEMBER 4,11981,BE AND HEREBY ARE,ACCEPTED AS PRESENTED. Councilman Hudson seconded the motion. VOTE:Unanimous The motion carried. AWARDS,PRESENTATIONS,AND COMMUNICATIONS City Clerk,Marlis Davis,read a letter from the Palm Springs HomeownersAssociation: Attn:Building Department,Mr.Leo Frazier Dear Mr.Frazier: The homeowners in the Palm Springs subdivision are very upset with the trash blowing around from construction sites,mainly Morvak Construction.Many residents have called Mr.Morvak,and talked to him in person, but were only told he is too busy to pick uptrash.Consequently,cement bags,roofing paper, paper cups,etc. are littering our area. Perhaps when Mr.Morvak,or others,are given a building permit, they should be told they are responsible for their litter andthattheyare requested to provide a litter wagon to "police" up their construction areas.They should also be reminded that we do have a litter law. We would like this matter given your immediate attention. Yours very truly John Schmidt,President Homeowners Association Director of Public Safety,Bill McDaniel,explained that he had obtained a list of all the builders in the area.He added that he is having police officers visit all building sites and check areas for debris. The builders will be given a warning and notified that i f i t continues beyond the first warning,they will be cited into Court. Building Official,Leo Frazier,is sending out a letter to advise all builders of the problem asking for their cooperation. Director of Public Safety,Bill McDaniel,added that Building Inspector, CALL TO THE PUBLIC Mr.Jerry Michaels,926 N. Monterey St.,stated that citizens have come to him with complaints regarding the A.J.Bayless parking lot. Mayor Clarke stated that Plaza Drive is dedicated as a publicthoroughfare,and the parking lot is private property. Director of Public Safety,Bill McDaniel,stated that this issuewillbelookedinto. Mr.Richard Taylor,616 S. Sahuaro St.,brought the Council up to date on the Palm Springs Water issue.Mr.Taylor invited the Council and public to a meeting regarding this issue at the VFW Hall,September 18, 1981,at 6:30 p.m. He presented the Council with a petition from the community with approximately 700 signatures.He stated that citizens are donating funds for taking the Palm Springs Water Company to court.He requested that the City of ApacheJunction donate funds also. Mr. Taylor complained of the pipe being laid in the Palm Springs area, which is made of asbestos fiber,which Occupational Safety Hazard Association is reputed to have prohibited the use of this type of pipe. Ms Glenda Eidson,extended an invitation to the City Council for theirsupportofthe Apache Junction Performing Arts Center which will teach dance,drama,art and music. CITY MANAGER'S REPORT Acting City Manager,Bill McDaniel,asked Mr.Leo Frazier,BuildingOfficial,to give a report on tests that were conducted for various street sections. Building Official,Leo Frazier,stated that for several months thePublicWorksDepartmenthas been conducting tests on roadway treatment. Mr.Frazier called on Operations Supervisor,Mr.Doug Dobson,to brief the Council on the tests performed. Operation Supervisor,Mr.Doug Dobson,presented a report on roadtestsconductedon16thAvenue between Ironwood and San Marcos,and Southern Avenue, which included costs,materials used,and the results of the varioustests. Acting City Manager,Bill McDaniel,called on Planning Director,Joe Gero,to give the Council an update on the Four Corners Grant. Planning Director,Joe Gero,stated that Mr.Dick Myers,Program Officer, of the Four Corners Regional Commission,wrote that the fifth increment is being released to the Ctiy.Mr.Gero briefly outlined the report provided. Bill McDaniel,stated that a car purchased by the Department of Public Safety several months ago for $500.00 has already been used by several departments and is now being renovated and will be used for a street striper. Planning and Zoning Commission unanimously recommended approval. Mayor Clarke asked i f there wasanyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Mayor Clarke called upon the City Clerk to read Ordinance No.109,by title only for the first reading. City Clerk,Marlis J.Davis read as follows: ORDINANCE NO.109,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-15-81 FROM GENERAL RURAL (GR) TO SINGLE RESIDENCE (CR-2)REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. INTERGOVERNMENTAL AGREEMENT - PINAL COUNTY SHERIFF )Director of Public Safety,Bill McDaniel,explained that this agreement would include the Pinal CountySherrif's Department,Cities of Florence, Coolidge,Casa Grande,and Apache Junction.This agreement will provide for equipment and manpower to the area as its needed. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE INTERGOVERNMENTAL AGREEMENT WITH THE PINAL COUNTY SHERIFFS DEPARTMENT FOR MUTUAL AID IN LAW ENFORCEMENT WITH THE CITY OF CASA GRANDE; CITY OF APACHE JUNCTION,COOLIDGE AND THE TOWN OF FLORENCE BE AND HEREBY IS APPROVED FOR AN INDEFINITE TERM EFFECTIVE SEPTEMBER 16,1981. Vice Mayor Hill seconded the motion. VOTE:Unanimous The motion carried. Councilman Damiano asked the Director of Public Safety,Bill McDaniel if the City of Apache Junction has a inter- governmental agreement with the City of Mesa.Chief McDaniel stated that theCitydoesnothave a formal one,but the City does have their help upon request. EXECUTIVE SESSION, SEPTEMBER 21 AND OCTOBER 7, 1981 ) )Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT AN EXECUTIVE SESSION BE HELD IN THE CITY HALL OF APACHE JUNCTION,ARIZONA, ON SEPTEMBER 21 AND OCTOBER 7,1981, AT 6:00 P.M.FOR THE PURPOSE OF DISCUSSING PERSONNEL AND LEGAL MATTERS;THE SEPTEMBER 21,1981 MEETING WILL BE AT 6:30 P.M. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. INFORMATION AND REPORTS Councilman Steelsmith reported onthe Planning Zoning Commission meeting which took place September 8,1981.The next Land Use Committee meeting is Tuesday, September 22,1981. Councilman Hudson stated that the Charter Government Committee haselectedtheirofficers,and are "off to a good start." Mayor Clarke stated that Arizona City held an election for incorporation, Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. ADJOURNMENT There being no further business to discuss,Mayor Clarke adjourned the meeting at 7:55 p.m.,into an Executive Session.
