CALL TO ORDER Mayor Clarke called the meeting to order at 7:00 p.m. INVOCATION Councilman Eidson led the invocation. PLEDGE OF ALLEGIANCE Councilman Hudson led the Pledge of Allegiance. Councilman Shanks seconded the motion. VOTE:Unanimous The motion passed. ACCEPTANCE OF THE MINUTES OF THE REGULAR MEETING OF OCTOBER 21,1981 )Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE MINUTES OF THE REGULAR MEETING OF OCTOBER 21,1981,BE AND HEREBY ARE,ACCEPTED AS PRESENTED. Councilman Eidson seconded the motion. VOTE:Unanimous The motion carried. AWARDS,PRESENTATIONS AND COMMUNICATIONS Mayor Clarke asked Rocco Paffumi to come forward and called upon Police Chief McDaniel who stated: "Rocco Paffumi found a portable radio that was the property of the Police Department,which was worth approximately $1,500.00 and would have been a big loss to the Police Department." He thanked Rocco Paffumi and his mother for their honesty in returning it. Mayor Clarke stated:"All the volunteers are to be commendedfor jobs well done,but once in awhile an exceptional person comes along and does more than his share.Tonight,I would like to express our appreciation to an exceptional volunteer.Harvey Long has served on the Parks and Recreation Commission faithfully since November,1980,which was the beginning of that Commission. He not only has attended every meeting,but actively participated in every event sponsored by the Parks and Recreation Commission. Harvey has also taken time from his family life to serve on the Land Use Committee and Equine Committee.The Parks and Recreation Commission automatically says,"Harvey will do it,"when a volun-teer is needed.Harvey is the first one to rise when a job needs doing,and stays until the job is completed.His unwavering support of the City of Apache Junction and hours of contribution is to be commended. Harvey Long is indeed a credit to his CALL TO THE PUBLIC Mr.Theron Adams,representing the congregation of the Crossroads Southern Baptistithurch requettedLtheLCouncil' giveconsiderationto changing the meeting night of the City Council so the members of his and other churches may have the opportunity to attend Council meetings. Mr.Richard Taylor,616 S.Saguaro,outlined the recentactivitieswithregardtothe request of the Corporation Com- mission to hold another hearing on the Palm Springs water rateincrease,stating that Senator Turley has also requested a rehearing in addition to the 1,200 signatures from the residents who live in the Palm Springs service area.None of these requests have seemed to prompt the Corporation Commission to have a rehearing. The Corporation Commission has requested that basis of fact be presented to include why the increase is unreasonable,andstatingthedollarsandcents.Mr.Taylor stated that he had 35 to 45 errors and miscalulations on projections on which theCorporationCommission based their ratings on the projected income of the company.He then read to the Council some of these errors,stating he would give the City Clerk a copy after the meeting.He requested the Council,on behalf of the residents of Palm Springs service area,to re -submit a resolution with these facts oferrorsincluded. Virginia Seeman, 1352 W.Shiprock,Apache Junction,a representative to the Arizona Statewide Health Co-ordination Council (ASHCC)appointed by Governor Bruce Babbitt,-informed the Council on the Arizona Health Containment System (AHCCCS) which has been under much discussion lately.She presentedinformationontheresolutionofthe Statewide Health Coordination Council (SHCC)and stated i f the Council had questions they could contact her. Mrs.Seeman also urged the Council appoint the Community Health Commission as soon as possible. John Forsberg,269 N.Windchester Road,,spoke_toAheCCouncil regarding the Airport Commission,stating that it would be in the best interest of the commission to have two more members and urged the Council to vote favorably on this issue becauseit was difficult to have a quorum with a five member board.Mr. Forsberg further stated that he wished the Council to give con-sideration to persons outside Apache Junction,as several goodpilotshaverequestedtobe appointed to the Board. Dick Rabidue,575 W.23rd Avenue,spoke to the Mayor and Council as a member of the Charter Government Committee request-ing that the Council consider neighborhood councils.Mr.Rabidue presented the Council with information regarding neighborhoodcouncilswhichwasobtainedfrom the City of Chandler. Mayor Clarke thanked all those who spoke,and specifically commented to Mr.Rabidue regarding the neighborhood councils,stating that he would like to wait for the Charter Government Committee recommendations before any more committees are appointed. CITY MANAGER'S REPORT effectiveness.Haymore further stated that he was concerned about the computer some months ago, however,now he understands i twillbefullyoperationalsoon. He explained how it would help as soon as the computer becomes fully operational.He reminded the Council they had received the audit report a week previous, and he asked i f they had any questions. Acting City Manager McDaniel called upon the Planning Director, Joe Gero,who introduced Mr.Dick Kaku of PRC Voorhees,Los Angeles,a Division of PRC Toups.Mr.Dick Kaku presented aslidepresentationoftheTransportationPlan to the Council and citizens who were present.Mr.Gero stated that Mr.Kaku would be available for questions in the Community Center after the Council meeting. Mayor Clarke requested a break at 8:00 p.m. The Council re -convened at 8:17 p.m. PUBLIC HEARINGS PROPOSED ORDINANCE 114 PZ-16-81, Scribner (First Reading) ) Mayor Clare opened the meeting to the public and requested the Planning Director,Joe Gero,brief the City Council on the petition. Mr.Joe Gero stated that this was a request to rezone from General Rural to CB -2 stating that thePlanningand Zoning Commission recommended approval. Mayor Clarke asked i f there were any comments by the public.There being none,Mayor Clarke closed the meeting to the public. Mayor Clarke called upon the City Clerk to read the title of Ordinance 114 for the first reading. City Clerk,Marlis Davis,read theTitleofOrdinance114 for the first reading. AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY,ARIZONA, AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFI- CATION IN REZONING CASEPPZ-16-81 FROM GENERAL, RURAL (GR)TO CB -2 GENERAL BUSINESS ZONE, REPEALING ANY CONFLICTING PROVISIONS: PROVIDING FOR SEVERABILITY:AND PROVIDING PENALTIES. PROPOSED ORDINANCE 115 PZ-17-81,Walker (First Reading)_) Mayor darke opened the meeting to the public and requested that the Planning Director brief the Council on the petition. Planning Director Joe Gero briefed the Council on the petition stating that this was a request for There being no further comments, Mayor Clarke closed the meeting to the public. Mr.Charles Golzio,936 West ApacheTrail,explained to the Council his plans with regard to the Desert Lounge and Bar. Councilman Steelsmith asked whether the parking problem had been resolved. Mayor Clarke stated that he had a memo from the zoning department indicating a resolution of that problem.Mayor Clarke asked i f there was anyone in the audi- ence wishing to address this item.There being no one, Mayor Clarke closed the meeting to the public. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE APPLICATION FOR A NEW SERIES 7 LIQUOR LICENSE FOR DESERT LOUNGE AND BAR TO MR.CHARLES L. GOLZIO, BE AND HEREBY IS,RECOMMENDED FOR APPROVAL TO THE STATE DE- PARTMENT OF LIQUOR LICENSE AND CONTROL,SUBJECT TO SATISFACTORY COMPLIANCE WITH THE APPLICABLE LAWS OF THE CITY OF APACHE JUNCTION, ARIZONA. APPLICATION FOR SMALL GAME BINGO LICENSE FOR AMERICAN LEGION POST 27 Mayor Clarke opened the meeting to thepublicaskingif anyone wished to speak in favor of or against LICENSE,SUBMITTED BY AMERICAN LEGION POST NUMBER 27,BE AND HEREBY IS,RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF REVENUE, BINGO LICENSING AUTHORITY. Councilman Hudson seconded the motion. VOTE:Unanimous The motion carried. OLD BUSINESS (None) NEW BUSINESS PROPOSED ORDINANCE 119,INCREASING MEMBERSHIP ON LIBRARY BOARD ) )Mayor Clarke called upon the City Clerk to read the title of Ordinance 119,for the first reading. City Clerk,Marlis Davis,read Ordinance 119 by title only. AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING ARTICLE2-7,INCREASING THE LIBRARY BOARD MEMBERSHIP BY ONE TRUSTEE; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES;AND PROVIDING FOR SEVERABILITY. RESOLUTION 81-16 SIDEWALK IMPROVEMENTS ) ) Mayor Clarke called upon the Director of Public Works to brief the Council on this item. Director of Public Works Rich Broman pointed out that this Resolution is directed toward all otherconstructionotherthansinglefamily construction.The developer pays the original cost of sidewalks. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.81-16,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,SETTING FORTH REQUIREMENTS FOR CONSTRUCTION OF SIDEWALKS WITHIN THE CITY LIMITS,BE AND HEREBY IS,APPROVED. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. as prosecuting attorney in these cases.He further stated that they were asking Council to authorize use of Pinal County Attorney in those cases where this kind of conflict occured. Mayor Clarke commented that he under- stood this was common practice. Attorney Alexander confirmed that i t was. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.81-18,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA, GIVING AUTHORITY TO THE COUNTY ATTORNEY'S OFFICE OF PINAL COUNTY TO PROSECUTE MISDEMEANOR CASES IN THE APACHE JUNCTION MAGISTRATE COURT,BE AND HEREBY IS, APPROVED. Councilman Hudson seconded the motion. VOTE:Unanimous The motion carried. Mayor Clarke requested a motion from the City Council to continue the meeting after nine o'clock. Councilman Eidson moved that the meeting be continued. Councilman Steelsmith seconded the motion. VOTE:Unanimous The motion carried. RESOLUTION 81-19,TRANSPORTATION ASSISTANCE FUNDS Acting Director of Finance,Rosemary Montgomery,stated that this was the appropriation for Apache Junction for money as a result of the lottery.As of July 1,1980,population estimates for Apache Junction are 10,090.The amount of $90,000.is estimated for Apache Junction for this fiscalyear.Our share could be as much as $100,000.to $110,000. Payments will •start in January in monthly increments of $15,000. to $18,000.until June,1982.Each year's allocation will depend on total money collected by the state lottery. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.81-19,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,REQUESTING THE ARIZONA DEPARTMENT OF TRANSPORTATION TO AUTHORIZE TRANSPORTATION ASSISTANCE FUNDS PURSUANT TO SECTION40-1102,ARIZONA REVISED STATUTES, BE AND HEREBY IS APPROVED. Councilman Hill seconded the motion. VOTE:Unanimous Mayor Clarke called upon the City Clerk to read Ordinance 122 by title only for the first reading. CITY COUNCIL REGULAR MEETING DATE ) )City Clerk Marlis Davis explained thatthisitem was one that was requested by Councilman Eidson,ex-plaining that the schedule of all pertinent meetings was in- cluded in the packet. Councilman Eidson suggested changing the regular meeting to the first and third Tuesday.Most council members expressed support of that date. EXECUTIVE SESSION NOVEMBER 18,1981 ) )Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT AN EXECUTIVE SESSION BE HELD AT CITY HALL ON NOVEMBER 18,1981, AT 6:00 P.M.FOR THE PURPOSE OF DISCUSSING PERSONNEL AND LEGAL MATTERS. Councilman Hill seconded the motion. VOTE:Unanimous The motion carried. INFORMATION AND REPORTS ) )Councilman Hudson reported on the Charter Government Committee stating that the minutes had been included in the council packet. Vice Mayor Hill reported on the first annual Halloween Party given by the Parks and Recreation Com-mission. Councilman Damiano reported on the Veteran's Memorial Park,explained they were going to get together and reactivate this worthwhile project,stating the need of the community for the development of this park. REQUESTS OF COUNCIL ) )Councilman Shanks reported that theCouncil,at a previous meeting,allocated money for Emergency Transportation Aid, stating that there was a need for emergencyaidfor food.She was requesting that $900 of the original $2,900. be set aside for use for emergency aid for food,adhering to the same requirements as established for emergency transportationaid. Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY OF APACHE JUNCTION, ARIZONA,THAT DIRECTION BE GIVEN THE CITY MANAGER TO EXPEND FUNDS IN THE TOTAL AMOUNT OF $900.FROM THE AMOUNT PREVIOUSLY SET ASIDE AT THE REGULAR COUNCIL MEETING OF MAY 6,1981,FOR THE TRANSPORTATION OF SENIOR CITIZENS FOR EMERGENCY MEDICAL CARE,THESE FUNDS TO BE USED WORKSESSION ON PERSONNEL POLICIES Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT A WORK SESSION BE HELD AT CITY HALL ON NOVEMBER 12,1981,AT 7:00 P.M.FOR THE PURPOSE OF REVIEWING PERSONNEL POLICIES. Councilman Hill seconded the motion. VOTE:Unanimous The motion passed. Councilman Eidson requested that the speed limit through the city be checked to see i f it would bepossibleto reduce i t to 35 miles per hour. Councilman Damiano requested that thestreetstripingonSuperstitionBoulevardand Highway 88 be looked into as i t appears the state made a mistake whenstripingit. Councilman Hudson read a letter regard-ing the "Letter to the Editor"by Councilman Steelsmith re- garding the trip to Bullhead City.
