HomeMy WebLinkAbout1982-09-07 City Council Regular MinutesCITY COUNCIL REGULAR MEETING SEPTEMBER 7, 1982 The regular meeting of the City Council of the City of Apache Junction, Arizona,was held on September 7, 1982, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Clarke called the meeting to order at 7:00 p.m. INVOCATION Councilman Shanks led the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Hill led the Pledge of Allegiance. ACCEPTANCE OF THE CONSENT AGENDA ) )Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED. BE IT FURTHER RESOLVED THAT THE ITEMS LISTED ON THE CONSENT AGENDA BE ACCEPTED AS PRESENTED. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. Introduction of Distinguished Guests and Visitors Mayor Clarke introduced Mr.John Bunde,Insurance Consultant to the City of Apache Junction. AWARDS,PRESENTATIONS,AND COMMUNICATIONS Mayor Clarke read a letter received from Salt River Project,donating $1,000.00 to the swimming pool fund. City Manager James Tuvell informed the Council that Mr.Lane Pew, of theSaltRiverProjectlocaloffice,had been instrumental in getting the donation. Mayor Clarke requested that a letter of appreciation be sent to Mr.Pew. PUBLIC HEARINGS PROPOSED ORDINANCE NO.146 PEED (First Reading) public. ))Mayor Clarke opened the hearing to the Director of Planning Joe Gero briefed the Council on the rezoning application,requesting a rezoning from GR General Rural to TH Trailer Homesite,by Mr.Robert Peed. Mr.Peed stated that he plans to expand the KOA campground for seasonal residents,requested that the Council approve the rezoning application. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Mr.Gero informed the Council for the record,that a letter opposing the rezoning had been received,with 23 signatures,andstatedthattheDevelopment Coordinating Committee had no objections or recommendations for this application,and the Planning and Zoning Commission recommends approval. Mayor Clarke called upon the City Clerk to read Ordinance No.146,by title only for the first reading. City Clerk Kathleen Connelly read asfollows: ORDINANCE NO.146,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-8-82 FROM GR GENERAL RURAL TO TH TRAILER HOMESITE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. Mr.Richard Rogers,1530 E.Junction Drive, Apache Junction,requested approval of the application. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Clarke closed the hearing to thepublic. Mr.Gero informed the Council of a letter in favor of the petition,and stated that the Development Coordinating Committee has no ob ections,and the Planning and Zoning Commission recommends PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. PROPOSED ORDINANCE NO.155, SMITH (First Reading) )Mayor Clarke opened the hearing to thepublic. Director of Planning Joe Gero briefed the Council on the petition for rezoning from GR General Rural to CR-5 Multiple Residence zone. Mr. A.E.Sullivan,Jr.,with Power ofAttorneyfromtheapplicant Mr.A.R.Smith,448 N. Saguaro Drive,Apache Junction,requested approval of this petition. Mayor Clarke asked i f there was anyonewho wished to speak in favor of or in opposition to the application. Ms Patricia Carr,286 N.Thunderbird Drive, Apache Junction,expressed her objection to the rezoning. There being no one else wishing to address the Council,Mayor Clarke closed the hearing to the public. Mr.Gero stated that there was a letterexpressingoppositionfrom a man living across from the indicated parcel. Mr.Joe Gero briefed the Council on Mr.Chris Gillis outlined the proposed uses of the land i f rezoned,and requested approval of the rezoning application. Mayor Clarke asked i f there was anyone else who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Mr.Gero stated that the Development Coordinating Committee and the Planning and Zoning Commission both recommend approval. Mayor Clarke called upon the City Clerk to read Ordinance No..157,by title only for the first reading. City Clerk Kathleen Connelly read as follows: ORDINANCE NO.157,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-15-82 FROM GR GENERAL RURAL TO TH TRAILER HOMESITE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. Mayor Clarke explained to public that certain areas were incorrectly zoned General Rural,and Mr.Gero would explain why. Mr.Gero stated that in November of 1974, Pinal County changed the Zoning Ordinance with regard to General Rural zoning, by creating a large number of nonconforming lots,and that many of these lots (1000 plus),cannot be built upon without either rezoning to smaller lots or avariancefrom the Board of Adjustment.This amendment would correct some of these deficiencies until the new zoning ordinance can be written. Mr.Gero briefed the Council on the application for abandonment,made by Mr.Bill J.Cogswell. of the abandonment. Mrs.Mildred Cogswell requested approval Mayor Clarke asked i f there was anyone else who wished to speak in favor of or in opposition to the application.There being no one wishing to address,the Council,Mayor Clarke closed the hearing to the public. Mr.Gero stated that the Development Coordinating Committee and the Planning and Zoning Commission recommend approval. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.82-51,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON NORTH WAGONWHEEL ROAD IS NO,LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY,BE AND HEREBY IS APPROVED. Vice Mayor Hill seconded the motion. VOTE:Unanimous The motion carried. PROPOSED RESOLUTION NO.82-49 (Abandonment) Mayor Clarke opened the hearing to the public. Mr.Gero briefed the Council on the abandonment request applied for by Snarr,Armsby,McClafflin,Peasley,Kendall,Dutton,Galbraith,Dibble,and Wilde. Ms. Jewel Peasley,322 Superstition Drive, Apache Junction,requested approval. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the petition. Mr.Frank Kendall,725 N.Chaparral,ApacheJunction,requested approval of the petition. There being no one else wishing to addressthe Council,Mayor Clarke closed the hearing to the public. Mr.Gero stated that the Development Coordinating Committee and Planning and Zoning Commission voted unanimously to recommend approval of the application to the Council. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.82-49,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED EASEMENTS FOR PUBLIC RIGHT-OF-WAY PURPOSES ON EAST CHOLLA STREET,NORTH BOWMAN ROAD, PROPOSED RESOLUTION NO.82-25 (Abandonment) ) Mayor Clarke opened the hearing to thepublic. Mr.Gero briefed the Council on the abandonment,listing the applicants as C.D.Wyatt,Jr.,Michael Kovacs, and First National Land Company, et al. Mr.Michael Kovacs,710 S. Lawson, ApacheJunction,explained the purpose of the abandonment and r equested approval of the petition. Mayor Clarke asked if there was anyone elsewho wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Mr.Gero stated that the DevelopmentCoordinatingCommittee and the Planning and Zoning Commission unanimously voted to recommend approval of the application for abandonment. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT RESOLUTION NO.82-25,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT'A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON EAST SIXTH AVENUE AND SOUTH PADRE ROAD IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY,BE AND HEREBY IS APPROVED. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. OLD BUSINESS None. NEW BUSINESS AWARD OF HEALTH INSURANCE CONTRACT )Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT WASHINGTON NATIONAL LIFE COMPANY BE SELECTED AS THE UNDERWRITER FOR LIFE,ACCIDENTAL DEATH AND DISMEMBERMENT,AND COMPREHENSIVE MAJOR MEDICAL INSURANCE FOR CITY OF APACHE JUNCTION EMPLOYEES,TO INCLUDE THE ADDITION OF THE DEPENDENT LIFE INSURANCE BENEFIT AS PROPOSED BY WASHINGTON NATIONAL. BE IT FURTHER RESOLVED THAT DELTA DENTAL PLAN OF ARIZONA BE RETAINED AS UNDERWRITER FOR DENTAL BENEFITS. Councilman Damiano seconded the motion. Councilman Damiano seconded the moticn. WORK SESSION AND EXECUTIVE SESSION,SEPTEMBER 21,1982 )Vice Mayor Hill MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT A WORK SESSION AND AN EXECUTIVE SESSION BE HELD AT THE CITY HALL COMPLEX ON SEPTEMBER 21,1982,AT 6:00 P.M. Councilman Damiano seconded the motion. VOTE:Unanimous The motion ,carHed. INFORMATION AND REPORTS (COUNCIL LIAISON REPORTS) Councilman Steelsmith reported that on September 11,1982,from 8:00 a.m. to 12:00 p.m.,there will be a Planning and Zoning Commission Work Session to begin work on the zoning ordinance. Mayor Clarke reported on the tour of western airforce bases that he,oneAirport Commission member, and a representative of the Chamber of Commerce attended. Ms Priscilla Gardner,Airport Commission Chairman presented a report on the tour. REQUESTS OF COUNCIL Vice Mayor Hill appealed to the Council to fight for the proposed airport and not give up Apache Junction's chance for industry. Councilman Damiano agreed,stating that once approval is received from the Federal Aviation Administration,procedures to complete the airport should begin.
