CALL TO ORDER Mayor Clarke called the meeting at 7:03 p.m. INVOCATION Councilman Eidson led the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Hill led the Pledge of Allegiance. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. AWARDS,PRESENTATIONS AND COMMUNICATIONS Mayor Clarke presented a Certificate of Appreciation to the Rock Shadows Ecology Group for their efforts toward improving the appearance of the City along Highway 60. Mr.and Mrs.Bob Hallock, representing the Group,accepted theCertificateandexpressedtheir appreciation for the recognition. CALL TO THE PUBLIC None. CITY MANAGER'S REPORT City Manager James Tuvell,provided a letter from the Apache JunctionLion's Club to the Council,explaining that the Lion's Club would like toplanttwotreesnearthe City Hall Complex as a part of an international program they are performing.Mr.Tuvell stated that the staff would likepermissionfromtheCouncilto work with the Lion's Club in designating the types and locations of the trees. Mayor Clarke suggested planting one evergreen tree as a permanent Christmas tree. Mayor Clarke asked the Council i f there were any objections to thestaffproceedingwiththis matter.As there were no objections,Mayor Clarke directed the staff to work with the Lion's Club. Mr. Tuvell reminded the Council of a Planning and Zoning Commission Work Session on the General Plan to take place Thursday,February 18,1982, at 7:00 p.m.in the Community Services Building,which will be open to the public. Mr. Tuvell introduced the new Library Director,Elizabeth Burks,to the Council. Mr.Tuvell asked the Council for ideas regarding the community development block grant proposals,as applications to Central Arizona Association of Governments are required in the near future. Director of Planning Joe Gero,noted that Central Arizona Associationof Governments recommend a limitation of $75,000.00 per recipient. Mr.Tuvell stated that if any members of the Council or the public had ideas for a project,the list of criteria is available to the public. Mr.Tuvell called on Lieutenant Mercer Weiskotten,to briefl update would be expensive. Lieutenant Weiskotten confirmed that there has been communication with the citizens and that there is no concrete answer to the problemas yet,but that he will continue to investigate the alternatives. Councilman Damiano suggested a rubber curtain to subdue the sound. Lieutenant Weiskotten agreed that a curtain is possible except for the possibility of it being destroyed easily,but that he would investigate this suggestion. Mr.Tuvell informed the Council that the Arizona Revised Statutes requires the City to conduct an annual audit,and that he will be preparing proposals to solicit bids to perform the audit. Mr.Tuvell suggested holding Work Sessions in a round table manner,and asked i f this was acceptable.There were no objections to this suggestion. Acting City Clerk,Kathleen Connelly,suggested appointing an Ad -Hoc Committee to bring recommendations to the Council regarding small home- occupation businesses within mobile home parks,giving an example of acitizenoperatingabusinesswithinamobilehomeparkwho was in violation to the zoning ordinance and the "Home Occupation"regulation. Mr.Tuvell informed the Council that the zoning inspection of applicationsfor Business Licenses is part of the procedure and,i f in violation,the license must be denied.Mr.Tuvell stated that the Committee would set up specific requirements with certain guidelines. Mr.Tuvell stated that the staff need some specific guideline to go by,either to license all businesses within the parks or just businesses from outside the parks. •Councilman Hudson asked if CB and CB -2 are the only correct zones for businesses,and if mobile home parks are not zoned in those,than there should not be any businesses operating in mobile home parks. Director of Planning Joe Gero,explained that the "Home Occupation" Section 433 of the Zoning Ordinance,states that the occupation is operated from within the home,with requirements. Mr.Tuvell stated that the Zoning Administrator is saying this exactly,that no one can be licensed without the correct zoning,and there needs to be some specific guidelines to follow. Councilman Steelsmith asked i f the citizens are complaining that,byfollowingtheZoningOrdinance,we are violating their rights. Mr.Tuvell stated that the businesses outside the mobile home parks are complaining that the businesses inside the parks aren't required to have licenses. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT AN AD -HOC COMMITTEE BE ESTABLISHED TO STUDY THE PROBLEM AND MAKE RECOMMENDATIONS ON THE LICENSING REQUIREMENTS FOR MOBILE HOME AND BE IT FURTHER RESOLVED THAT THIS COMMITTEE MAKE THEIR RECOMMENDATIONS TO THE CITY COUNCIL BY AUGUST 17,1982. Councilman Hudson seconded the motion. VOTE:Unanimous The motion carried. PUBLIC HEARINGS PROPOSED RESOLUTION NO.82-03, SUBDIVISION ORDINANCE AS PUBLIC DOCUMENT ) )Mayor Clarke opened the hearing to thepublic. Director of Planning Joe Gero,statedthat at the Council's direction the staff drafted a Subdivision Ordinance, and the purpose of this Resolution is to declare the Subdivision Ordinance a public document. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. BE IT FURTHER RESOLVED TO PROVIDE FOR COMMUNITY INPUT IN THE REVIEW OF AND DETERMINATION OF ANY NECESSARY AMENDMENTS. The motion carried. Mayor Clarke offered the Council's appreciation to Mr.Earl Laabs and Mr.Clay Worst,for volunteering their time to this Committee. Mayor Clarke recessed the meeting. Mayor Clarke reconvened the meeting at 7:55 p.m. PROPOSED ORDINANCES NO.135, HANDICAPPED FIRE LANE PARKING(First Reading) the public. Mayor Clarke opened the hearing to Representing Director of Public Safety,Lieutenant Mercer Weiskotten,briefed the Council and public on thepetition,stating that this Ordinance allows enforcement of the Fire Lane and Handicapped parking. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Mayor Clarke called upon the City Clerk to read Ordinance No.135,by title only for the first reading. Councilman Damiano suggested that thelocalbusinessesbeencouragedto use upright and visible signs to designate handicapped parking areas. Councilman Damiano seconded the motion. Councilman Eidson asked i f Mr. Peterson was aware that he needs a City Business License. Acting City Clerk,Kathleen Connelly, stated that Mr.Peterson has purchased a Business License. Councilman Hudson stated that the Department of Public Safety and Department of Public Works haveinvestigatedthe application and location and have recommended approval. Director of Public Works Rich Broman,stated that the parking is sufficient for the residents of the mobile home park to participate in the Bingo games. Councilman Eidson reported to the Council on the Board of Adjustments meeting. Vice Mayor Hill informed the Council of Mr. Jerry Castro's death,and suggested that a Veteran's Brick be put in the gazebo in Mr.Castro's memory for devoting his time and efforts to the City of Apache Junction. Vice Mayor Hill requested that American Cable TV come to the next Council meeting and give a presentation on Cable television. Councilman Hudson reported on the Charter Government meeting. REQUESTS OF COUNCIL Councilman Damiano called on Superintendent of Community Services, Jeff Bell,to brief the Council on the Veteran's Memorial Park. Mr.Bell recommended approval of designating a section of City Complex land to the Veteran's Memorial Park for the gazebo,as this would be a valuable asset to the community. Councilman Damiano corrected the Statement of Understanding, Section III Item B.,to read "Approve all additions and improvements made to the parkfacilities";instead of "Improve". Vice Mayor Hill suggested that the Department of Public Works overlay a whole section of road,rather than every pothole. Director of Public Works Rich Broman,stated that this time ofthe year,the roads are the worst,and the holes will get worse.Mr.Broman explained that the Department of Public Works is limited by budget and manpower where road repair is concerned,and previously several intersections had been scheduled for repair,but the funds and manpower are not available at this time.Mr.Broman stated that a five year repair plan will be hopefully presented for the next years budget. Vice Mayor Hill stated that if Cable Television was installed in theCity,the extra revenue would greatly expand the road repair possibilities. Councilman Hudson stated that many citizens have complained on thecondition of local streets and recommended rebuilding the blacktop onstreets ratherthan patching separate holes. City Manager,James Tuvell,stated thatat the next meeting there would be a street inventory presented to the Council and definite steps can be decided upon at that time. Councilman Hudson requested that if funds are not available thatalternativesforfundsbe found. Mr.Tuvell stated that one crew is available to make repairs andallotherprojectscometo a stand still. Mayor Clarke stated that something must be accomplished with street repair and means must be found to proceed with this.
