REGULAR MEETING
FEBRUARY 15,1983
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on February 15,1983, at the Apache Junction City Council
Chambers pursuant ,to the notice required by law.
CALL TO ORDER
Mayor Clarke called the meeting to order at 7:00 p.m.
INVOCATION
Councilman Eidson led the Invocation.
PLEDGE OF ALLEGIANCE
Councilman Damiano led the Pledge of Allegiance.

ACCEPTANCE OF AGENDA
)Councilman Damiano MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT THE AGENDA BE ACCEPTED AS PRESENTED.
BE IT FURTHER RESOLVED THAT CONSENT AGENDA ITEM "A"BE APPROVED AS PRESENTED FOR
THE FOLLOWING REASONS:
A."THOSE REASONS AS SET FORTH BY THE PLANNING AND ZONING COMMISSION WHICH ARE
HEREBY ADOPTED BY REFERENCE."
BE IT FURTHER RESOLVED THAT CONSENT AGENDA ITEM "B" BE ACCEPTED AS PRESENTED.
Vice Mayor Hill seconded the motion.

Introduction of Distinguished Guests and Visitors
None.
AWARDS,PRESENTATIONS,AND COMMUNICATIONS
Mayor Clarke reminded the C ouncil that approximately a year ago,the Library
was donated to the City,with certain funds withheld until the Library Association
was certain that the city was doing a good job maintaining the Library.These
funds were now being presented to the City by the Apache Junction Library
Association in the amount of $1584.54.

PUBLIC HEARINGS
PROPOSED RESOLUTION NO.82-71,AB -82-12,

the public.
))Mayor Clarke opened the hearing to
Director of Planning Joe Gerobriefedthe Council on the abandonment of East Pioneer Street between North
Acacia and North Starr Road and East Pioneer Street between North Starr Road
and North Hilton.
Mrs.Margaret Jones requested that
the application for abandonment be approved.
Mayor Clarke asked i f there was
anyone who wished to speak in favor of or in opposition to the application.
There being no one wishing to address the Council,Mayor Clarke closed the
hearing to the public.
ABANDONMENT CASE AB -82-12 IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY
AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-
OF-WAY,BE AND HEREBY IS APPROVED AND ADOPTED.
Vice Mayor Hill seconded the motion.
Councilman Damiano commented that a
street of this kind would cost the city more to maintain than necessary as the
use is minimal.
VOTE:Unanimous
The motion carried.
OLD BUSINESS
PROPOSED ORDINANCE NO.173,
ZINGLER (Second Reading)
)Mr.Gero briefed the Council on theapplication for rezoning from GR General Rural to TH Trailer Homesite.
Councilman Eidson MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT ORDINANCE NO.173,BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE
ORDINANCE BE WAIVED.
Councilman Damiano seconded the
motion.
VOTE:Unanimous
The motion carried.
Mayor Clarke called upon the City
Clerk to read Ordinance No. 173 by title only for the second reading.

AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING
MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-3-83 FROM
GR GENERAL RURAL TO TH TRAILER HOMESITE;REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES.
Councilman Damiano wished to know i f
the 33 feet south of the parcel was deeded for public roadway purposes.
Mr.Gero answered that this is correct.
Councilman Steel smith MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT ORDINANCE NO.173,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, PINAL COUNTY,ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,
ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT

NEW BUSINESS
AWARD OF BID FOR STREET
MATERIALS,PROJECT PW-82-7
)Director of Public Works Rich
Broman,explained that previously the Public Works Department had requested
approval of funds for the street paving,but was made aware of budgetrestraintsandtheproject was postponed.Mr.Broman stated that funding
is available to complete this project on Tomahawk Road,from Broadway toSuperstitionBlvd.,and recommended awarding the bid to Union Rock and
Materials.
Councilman Damiano asked what
amount of time would be required to complete this project.
Mr.Broman stated that it would
be conducted in several phases, and once the road surface is prepared it will
take one day.
Mayor Clarke wished to know when
they would begin.
Mr.Broman stated that the road base
is in the process of being prepared now, and should be read for paving within
two weeks.
Councilman Baljo MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
HEREBY AUTHORIZES THAT THE PROPOSAL BY UNION ROCK AND MATERIALS,RECEIVED
DECEMBER 15,1982,FOR THE CITY OF APACHE JUNCTION PROJECT PW-82-7,ROAD
MATERIALS,BE AND HEREBY IS ACCEPTED.
BE IT FURTHER RESOLVED THAT THE DIRECTOR OF PUBLIC WORKS BE GIVEN AUTHORIZATION
THROUGH THE CITY MANAGER TO PURCHASE ROAD MATERIALS IN THE AMOUNT NECESSARY TO
COMPLETE THE PROPOSED PROJECT,AS PREVIOUSLY APPROVED BY THE CITY COUNCIL.
Vice Mayor Hill seconded the motion.
VOTE:Unanimous
The motion carried.
REQUEST FOR TRANSPORTATION
FUNDS FOR AMERICAN RED CROSS
)Councilman Shanks stated that ApacheJunctioniseligibleforSection18 funds as long as we remain a rural community,
and recommended that Apache Junction participate with the stipulation that thecityreceiveconfirmationthati t is eligible for Section 18 funding.
Councilman Shanks MOVED THAT BE IT
Vice Mayor Hill seconded the motion.
Councilman Eidson wished to know
i f the funds would be channelled through the Community Area Foundation.
City Manager James Tuvell statedthatthiscouldbe a stipulation i f the Council wishes,unless it's not
technically possible.
Councilman Shanks added to the motion.
2)THAT THE FUNDS BE CHANNELLED THROUGH THE APACHE JUNCTION COMMUNITY
FOUNDATION IF ITS DETERMINED TO BE LEGAL.

WORK SESSION,FEBRUARY 28,1983
EXECUTIVE SESSION,AND WORK
SESSION,MARCH 1, 1983
)Councilman Eidson MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT A WORK SESSION BE HELD ON FEBRUARY 28,1983, AT 7:00 P.M.,IN THE COMMUNITY
SERVICES BUILDING.
BE IT FURTHER RESOLVED THAT AN EXECUTIVE SESSION AND A WORK SESSION BE HELD ON
MARCH 1, 1983, AT 6:00 P.M. IN THE CITY COUNCIL CHAMBERS.
Councilman Damiano seconded the motion.
VOTE:Unanimous

INFORMATION AND REPORTS
(COUNCIL LIAISON REPORTS)
Councilman Eidson reported on the Board of Adjustment meeting of February 14,
1983.
Councilman Steelsmith reported that the Zoning Ordinance Rewrite Committee
is continuing to meet every Thursday at 7:00 p.m.,and February 22,1983, is the
regular meeting of the Planning and Zoning Commission.
Councilman Shanks stated that plans for the community swimming pool are
proceeding.
Councilman Steelsmith stated that Mr.Harvey Long, a contractor from the
community is in the process of estimating the cost of a swimming pool.
Mayor Clarke informed the Council and public that he attended the National
Association of Regional Councils in Washington D.C.,and that the moral was goodwiththefeelingthattheeconomywillbebetterinthenearfuture,with the
main theme of Economic Development.

Mayor Clarke_introduced Mr.Jim Nakagawa,the city's new Associate Planner.
