HomeMy WebLinkAbout1983-02-01 City Council Regular MinutesCITY COUNCIL REGULAR MEETING FEBRUARY 1, 1983 The regular meeting of the City Council of the City of Apache Junction, Arizona,was held on February 1, 1983, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Clarke called the meeting to order at 7:01 p.m. INVOCATION Councilman Shanks led the Invocation. PLEDGE OF ALLEGIANCE Councilman Damiano led the Pledge of Allegiance. ACCEPTANCE OF CONSENT AGENDA )Councilman Baljo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED. BE IT FURTHER RESOLVED THAT CONSENT AGENDA ITEM "A"BE ACCEPTED AS PRESENTED. Councilman Steelsmith seconded the motion. VOTE:6 in favor,Councilman Damiano voted "present"since he was not at the meeting in question. The motion carried. Introduction of Distinguished Guests and Visitors Mayor Clarke recognized Bob and Debbie Burd,Publisher and Co -Publisher of the Apache Junction News, and Kristi Bird a reporter from the Mesa Tribune. Mayor Clarke introduced the new Economic Development Specialist for thecity,Mr.John Schoeph. Mayor Clarke also recognized Mr.Roy Hudson,State Representative. AWARDS,PRESENTATIONS,AND COMMUNICATIONS Mr.Jay Mitchell,composer of the official City Song,presented the Mayor and Council with a record of the .song and expressed his appreication for the support given him. CALL TO THE PUBLIC None. CITY MANAGER'S REPORT None. PUBLIC HEARINGS PROPOSED ORDINANCE NO.170, COMMISSION INITIATIVEFirstReading) public.) Mayor Clarke opened the hearing to the Director of Planning Joe Gero briefed the Council,explaining that this case is a commission initiative amending Mr.Gero stated that the Planning and Zoning Commission and the Development Coordinating Committee recommend approval of the amendment. Mayor Clarke called upon the City Clerk to read Ordinance No. 170 by title only for the first reading. City Clerk Kathleen Connelly read asfollows: ORDINANCE NO.170,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE "CODE OF THE CITY OF APACHE JUNCTION, ARIZONA,VOLUME II,LAND DEVELOPMENT, CHAPTER 1,ZONING ORDINANCE"BY AMENDING ARTICLE 11,ENTITLED "CR-3 SINGLE RESIDENCE ZONE"BY AMENDING "SECTION 1111,ACCESSORY BUILDINGS" TO PROVIDE REQUIREMENTS FOR USE OF A DETACHED CARPORT OR GARAGE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. PROPOSED ORDINANCE NO.172, DERIAN (First Reading) )Mr.Joe Gero explained to the Council that the applicant wishes to withdraw his present rezoning application and amend i t to a rezoning from GR General Rural to CB -1 Local Business Zone, which wouldrequirereadvertisement and a rehearing by the Planning and Zoning Commission. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT ITEM NO.4 BE TABLED IN ORDER TO PERMIT A NEW PUBLIC HEARING AND RECONSIDERATION BY THE PLANNING AND ZONING COMMISSION. Councilman Steelsmith seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.173, ZONGLER (First Reading) ) Mayor Clarke opened the hearing to thepublic. Mr.Gero briefed the Council on therezoningrequest from GR General Rural to TH Trailer Homesite, Darold Zingler having a power -of -attorney for the applicant,Mr.Paul Settepani. Mr.Darold Zingler,representing Mr.Paul Settepani,requested approval of the rezoning. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Mr.Gero stated that the Development Coordinating Committee and Planning and Zoning Commission have no objections to the rezoning,providing there is a dedication of a thirty-three feet of right-of-way on the south side. MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-3-83 FROM GR GENERAL RURAL TO TH TRAILER HOMESITE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. APPLICATION FOR SMALL GAME BINGO LICENSE,DESERT PARK public.) Mayor Clarke opened the hearing to the Mr.Clare McRoberts,900 S. Idaho Road, Apache Junction,Arizona,requested approval of the application. Councilman Shanks questioned the corrections requested by the Fire Department. Mr.McDaniel stated that those have been complied with. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Clarke closed the hearing to the public. Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE APPLICATION FOR A SMALL GAME BINGO LICENSE,SUBMITTED BY CLARE MCROBERTS, AGENT FOR DESERT PARK,BE AND HEREBY IS RECOMMENDED FOR APPROVAL TO THE STATE DEPARTMENT OF REVENUE, BINGO LICENSING AUTHORITY. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. OLD BUSINESS APPOINTMENT TO THE BOARD OF ADJUSTMENT ) Mayor Clarke stated that some additional Talent Bank Application had been submitted for consideration. Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT TERRY BROWNE BE APPOINTED TO THE BOARD OF ADJUSTMENT TO FILL THE VACANCY CREATED BY THE RESIGNATION OF JOE JESSAMINE,SAID UNEXPIRED TERM TO EXPIRE JUNE 30,1984. Vice Mayor Hill seconded the motion. Mr.Terry Browne,980 N. Ironwood Dr., Apache Junction,gave a brief description of his qualifications. VOTE:Unanimous The motion carried. Councilman Baljo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE GENERAL STATUS REPORT AS PREPARED BY THE PLANNING AND ZONING COMMISSION,BE ACCEPTED AS PRESENTED. Vice Mayor Hill seconded the motion. VOTE:Unanimous The motion carried. NEW BUSINESS COMMUNITY QUALITY DEVELOPMENT AWARD ) )City Manager James Tuvell,stated that a cross section of the community had requested that recognition be given to developers taking the initiative towards more extensive on -site and off -site improvements. Councilman Steelsmith requested that achecklist of requirements for candidates or some comparative system be set upforselectingcandidatesforrecognition. Vice Mayor Hill agreed,stating that there should also be different categories for awards. Councilman Eidson felt that the idea of different classes according to size would be a good one. Councilman Damiano stated that businesses should also be considered for this recognition,and suggested that citizens make the decision as to whom deserves the award. Councilman Baljo urged the Council to proceed with this as soon as possible as it would encourage better looking developments. Councilman Baljo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE "COMMUNITY QUALITY DEVELOPMENT AWARD"PROGRAM IS HEREBY ADOPTED AND APPROVED. Councilman Steelsmith seconded the motion. VOTE:In Favor:Councilman Baljo,Councilman Shanks,Councilman Steelsmith, Councilman Eidson,Councilman Damiano,Vice Mayor Hill Mayor Clarke voted no on the measure. The motion carried. ROUND TABLE DISCUSSION )City Manager Tuvell stated that at the Work Session the Council had discussed February 23,1983, as a possible date, with representatives from Boards and Commissions,department heads,members of VOTE:Unanimous The motion carried. WORK SESSION,FEBRUARY 14,1983 WORK SESSION,EXECUTIVE SESSION, FEBRUARY 15,1983 )Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT A WORK SESSION BE HELD ON FEBRUARY 14,1983, AT 7:00 P.M.,IN THE CITY HALL COMPLEX. BE IT FURTHER RESOLVED THAT AN EXECUTIVE SESSION AND A WORK SESSION BE HELD ON FEBRUARY 15,1983,AT 6:00 P.M.,IN THE CITY HALL COMPLEX. Vice Mayor Hill seconded the motion. VOTE:Unanimous The motion carried. INFORMATION AND REPORTS (COUNCIL LIAISON REPORTS) Councilman Damiano reported that there will be an Airport Commission meeting February 3, 1983, at 7:00 p.m. Councilman Shanks quoted some figure on animals that have been impounded during the past month through Animal Control. Mayor Clarke read the following report: "Last month the library circulated more than 5,000 books.The community is becoming more involved with the library as we have 3 new volunteers. Story hour is continuing for Little Rec'rs and Mary Moppets Day Care Center. On February 25,at 7:30 p.m.,the Friends of the Library will hold a meeting at John Calvin Church.This is open to the public.James Swanson co-author of "Ride Through Time"will be speaking.Also a square dance demonstrationwillbegiven.Western art also will be displayed. In the future the library will be having a creative poetry workshop.This will be given by Dean Stover,who is a writer -in -residence of Pinal County.The workshop will be held on March 2 from 3 p.m. to 5 p.m. at the Community Services Building." Director of Public Works Rich Broman reported on the Street Light Improvement Program. Councilman Shanks suggested a mock Council meeting for high school students before the new council is seated,as an educational demonstration. Councilman Steelsmith congratulated the City Manager,Director of Planning, and Director of Public Works for the informative Groundwater Symposium. City Manager Tuvell further congratulated Sharon Seder for all the timeand effort she put into setting up the symposium. Councilman Shanks stated that the Lost Dutchman Days parade went very well in spite of the bad weather.
