REGULAR MEETING
MARCH 1, 1983
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on March 1,1983,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Clarke called the meeting to order at 7:03 p.m.
INVOCATION
Councilman Eidson led the Invocation.

Introduction of Distinguished Guests and Visitors
Mayor Clarke recognized Mrs.Mary Fleming,from Detroit,Michigan,
Councilman •Baljo's mother-in-law.
AWARDS,PRESENTATIONS,AND COMMUNICATIONS
Mayor Clarke announced that March 12,13,and 14,1983,there will be

Mr.Andy Grenya, 1929 S. Vaquero Road, Apache Junction,addressed the
Council regarding a decision made by the Board of Adjustment.
Mr.Vern Haverfield,Box 1716 Kings Ranch Road,wished to know i f he
would be able to vote in the city election.
Mayor Clarke asked if Mr.Haverfield resided inithe City limits.
Mr.Haverifeld answered no but would like to vote on the airport issue.
Mayor Clarke replied that only city residents could vote in city elections.
CITY MANAGER'S REPORT
Director of Planning Joe Gero,informed the Council that 13 of the planned
47 fire hydrants are in service at present,and all should be installed within
two weeks.
PUBLIC HEARINGS
PROPOSED RESOLUTION NO.82-64,
STACHAR
) Mayor Clarke opened the hearing
to the public,for Resolution No. 82-64,and Ordinance No. 171.
Director of Planning Joe Gero
explained that both are similar and i t is proper to hold both public hearingsjointly.
Mr.Gero read the followingletterfromtheapplicant:
"Dear Mayor Clarke and City Council members:
To allow the City to pursue its studies concerning commercial uses in the City,
which could also impact the City Council's position on the above cases.As
part of my request,it would be understood that upon my providing,in writing,thirty (30)days notice should I wish to proceed,to allow for required publicnotice,that the City Council would again schedule the above items on theearliestpossibleagenda.

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT THE PUBLIC HEARINGS FOR PROPOSED RESOLUTION NO.82-64 AND PROPOSED
ORDINANCE NO.171,ARE HEREBY CONTINUED INDEFINITELY AT THE REQUEST OF THE
APPLICANT.IT IS UNDERSTOOD THAT UPON THE APPLICANT'S WRITTEN REQUEST THAT
THE ABOVE CASES WOULD BE ADVERTISED FOR PUBLIC HEARING AS REQUIRED,AND PLACED

anyone who wished to speak in favor of or in opposition to the application.
There being no one wishing to address the Council,Mayor Clarke closed the
hearing to the public.
Mr.Gero stated that the
Development Coordinating Committee and the Planning and Zoning Commission
recommend approval,on condition of dedication of the 33 feet right-of-way.
Mayor Clarke called upon the
City Clerk to read Ordinance No.174,by title only for the first reading.

Councilman Shanks wished to know
what the surrounding area is composed of.
Mrs.McKinley stated that there
are trailers,homes,and multiple dwellings surrounding,and there were noobjectionstotherezoningfrom any surrounding residents,and that this
rezoning will benefit the area.
Mayor Clarke asked i f there was
anyone who wished to speak in favor of or in opposition to the application.
Mr.Jack Hawkins,666 S. Warner,
Apache Junction,expressed his opposition to the rezoning.
City Engineer is at present studying a solution to the problem,which wouldrequireextensivedrainageimprovements.
Mr.Wayne McKinley,Rt.1
Box 2359,Show Low,Arizona, stated that there are some lots in the area
with three trailers on a lot,-and that in the past his lot has been an
eyesore,but he would like to build on the lot and the rezoning wouldbenefitthe neighborhood.
Mr.Gero replied to comments
made,stated that the Development Coordinating Committee and the Planning
and Zoning Commission recommend approval of the rezoning case.
Mayor Clarke closed the hearing

City Manager James Tuvell informed
the public that there will be a second reading for this case on March 15,1983.
Councilman Baljo stated that thefirstreadingisforthepurposeof a public •hearing and to receive recommendations
from the Development Coordinating Committee and the Planning and Zoning Commission
and that a decision will not be made until the second reading at the next
regular council meeting.
Mayor Clarke recessed the meeting.
Mayor Clarke reconvened the meeting at 8:18 p.m.

Mr.Gero briefed the Council
and public on the rezoning request from GR General Rural to TH Trailer Homesite

Councilman Damiano wished to know
what access was available.

Mr.C.T.Parks, Mountainview,Missouri,stated that there are parking spaces for 12 patrons.
Mayor Clarke asked how many feet
is in the entire area.
Mr.Parks replied 500 square feet.
Councilman Shanks expressed a
concern over the access to the establishment.

)Director of Planning Joe Gero,briefed the Council and public,explaining the request for interpretation in
the CB -1 zoning district as per Section 1501 (b)of the Zoning Ordinance,but
is not a rezoning.

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT RESOLUTION NO.83-05,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT RECREATIONAL VEHICLE AND AUTO
STORAGE AND PARKING ARE.NOT MORE OBNOXIOUS OR DETRIMENTAL THAN THOSE PERMITTED
USES AS SET FORTH IN THE CITY OF APACHE JUNCTION, ARIZONA,ZONING ORDINANCE
SECTION 1501 (b)OF THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BE AND

STAGGERED TERMS FOR COUNCIL MEMBERS
)City Clerk Kathleen Connellyexplainedthatthisresolutionis worded to provide for four-year overlapping
terms with the three council persons being elected but receiving the lowest
number of votes holding office until 1985, and the four council persons
SUBMITTED TO THE VOTERS OF SAID CITY THE QUESTION AS TO WHETHER OR NOT
STAGGERED TERMS FOR MEMBERS OF THE CITY COUNCIL SHALL BE ADOPTED IN THE
CITY OF APACHE JUNCTION;PROVIDING FOR THE GIVING OF NOTICE OF SAID
ELECTION AND THAT ALL QUALIFIED VOTERS OF APACHE JUNCTION SHALL BE ENTITLED
AND QUALIFIED TO VOTE AT SAID ELECTION,BE AND HEREBY IS APPROVED AND ADOPTED.

OF ELECTION DATE,POLLING PLACES,VOTING

) Ms Connelly stated that State
law requires that twenty days prior to an election certain resolutions need
to be adopted informing the public where the polling places are and appointing
the election board members which are combined in this resolution -polling
places,designation of election officials,and informing the voters by which
means they will be voting.

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT RESOLUTION NO.83-06,A RESOLUTION OF THE MAYOR AND CITY COUNCIL

the Police Department was held and the results were that Daniel Scott and
Leo Frazier,Sr.,be reappointed to serve on the Public Safety Personnel
Retirement Board.

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE FOLLOWING PERSONS BE REAPPOINTED TO THE PUBLIC SAFETY
PERSONNEL RETIREMENT BOARD IN ACCORDANCE WITH ARIZONA REVISED STATUTES §38-847:
LEO FRAZIER,SR.,SAID TERM TO EXPIRE MARCH 4, 1987;AND DANIEL M.SCOTT AS

PUBLIC HEARINGS FOR ALTERNATIVE
EXPENDITURE LIMITATION (HOME RULE OPTION))
)City Manager James Tuvell
informed the Council that the legal requirements for placing the Home Rule
Option on the May 17 General Election are for :the Council to hold two public
hearings,and vote on the proposed action.Mr.Tuvell stated that the two
Special Meetings are scheduled for March 7, 1983, at 7 p.m.and March 15,
1983, at 7 p.m.

IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT A SPECIAL MEETING FOR THE PURPOSE OF HOLDING A PUBLIC HEARING
ON THE PROPOSED LOCAL ALTERNATIVE EXPENDITURE LIMITATION -HOME RULE OPTION -
BE HELD ON MARCH 7, 1983, AT 7:00 P.M.,IN THE CITY COUNCIL CHAMBERS,AND A
SPECIAL MEETING FOR THE SAME PURPOSE BE HELD ON MARCH 15,1983, AT 7:00 P.M.,
IN THE CITY COUNCIL CHAMBERS.
Councilman Steelsmith seconded
the motion.
Mr.Tuvell further explained
that the Council should recess from the regular meeting of March 15,1983,into a Special Meeting for the actual vote and then reconvene afterwards.

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE FINAL SUBDIVISION PLAT FOR "ROADHAVEN RESORTS OF APACHE
JUNCTION -PHASE II",SAID PLAT BEING LOGGED IN SUBDIVISION FILE SD -2-82,
AND WHICH IS A COMPANION CASE TO REZONING CASE PZ-19-82,A REZONING TO TH/PD
TRAILER HOMESITE BY PLANNED DEVELOPMENT IS FOUND TO BE IN GENERAL COMPLIANCE
WITH THE SUBDIVISION ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA,AND
THE CITY COUNCIL DOES HEREBY GRANT (CONDITIONAL APPROVAL SUBJECT TO THE ABOVE

AIRPORT INITIATIVE PETITIONS )
)City Clerk Kathleen Connelly
reported that the Airport Initiative Petitions have met the legal requirements
and that the Council should now take action to place this on the May 17 GeneralElectionballot.
Councilman Baljo MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,
THAT DIRECTION BE GIVEN THE CITY CLERK TO PLACE THE ESTABLISHMENT OF AN
AIRPORT FOR THE CITY OF APACHE JUNCTION ON THE BALLOT FOR THE CITY'S MAY 17,
1983,GENERAL ELECTION IN ACCORDANCE WITH INITIATIVE PETITIONS SIGNED BY QUALIFIED
ELECTORS OF THE CITY OF APACHE JUNCTION AND IN ACCORDANCE WITH STATE LAW.

TRAFFIC CONTROL,BROADWAY
AVENUE AND IDAHO ROAD
)Director of Public Works Rich
Broman,stated that after traffic counts and accident records had been reviewed
i t has been determined that a four-way stop sign is warranted at the inter-
section of Idaho and Broadway Roads.
Mayor Clarke expressed his opinionthatacertainamountof accidents should not be a requirement before anintersectionis made safe.
Councilman Eidson requested that
a sign be posted to warn traffic of the change.
Mr.Broman stated that this is
normal procedure.
Councilman Damiano suggested that
Councilman Baljo MOVED THAT BE
IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT WARRANTS HAVE BEEN SUFFICIENTLY MET TO REQUIRE THE ESTABLISHMENT
OF A FOUR-WAY STOP AT THE SINTERSECTION OF IDAHO ROAD AND BROADWAY AVENUE.
BE IT FURTHER RESOLVED THAT THE DIRECTOR OF PUBLIC WORKS AND THE DIRECTOR OF
PUBLIC SAFETY ARE HEREBY GIVEN DIRECTION THROUGH THE CITY MANAGER TO RESPECTIVELY
INSTALL AND ENFORCE THE TRAFFIC CONTROLS.
Vice Mayor Hill seconded the

DISCUSSION OF APPOINTMENTS TO
THE ECONOMIC DEVELOPMENT CITIZENS
ACTION COMMITTEE
)Mr.John Schoeph, Economic
Development Specialist,explained the procedures for appointing a committee
and training the committee for action.
Mr.Schoeph presented the
Council with a format for the training program.
Councilman Damiano MOVED THAT
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THERE IS HEREBY CREATED AN "ECONOMIC DEVELOPMENT ACTION TEAM"
TO PROMOTE THE PLANNED ECONOMIC GROWTH WITHIN THE CITY OF APACHE JUNCTION,
ARIZONA,AND TO COOPERATE TO PROMOTE PLANNED ECONOMIC GROWTH IN THE AREA.
BE IT FURTHER RESOLVED THAT THE FOLLOWING PERSONS ARE HEREBY APPOINTED TO
THE ECONOMIC DEVELOPMENT ACTION TEAM:

AND DEVELOPMENT AS STAFF ADVISOR,AND TO ASSIGN THE DEPARTMENT OF PLANNING
AND DEVELOPMENT TO PROVIDE STAFF ADMINISTRATIVE SERVICES.
