NOVEMBER 1, 1983
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on November 1, 1983, at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Clarke called the meeting to order at 7:03 p.m.

Introduction of Distinguished Guests and Visitors
Mayor Clarke recognized State Representative Roy Hudson.
Vice Mayor Eidson introduced the new pastor of Crossroads Southern Baptist
Church,Reverend Lyndall McElhaney.
AWARDS,PRESENTATIONS,AND COMMUNICATIONS

CALL TO THE PUBLIC
Mr.Jim Hironimus,601 E.Quail Avenue, Apache Junction,Arizona,addressed
rezoning Case No.PZ-23-83,requesting that the City Council return the appli-
cation back to the Planning and Zoning Commission for reconsideration until the
sewage and traffic problems are resolved.
Building Official Leo Frazier,reported on the study on the Council
Chambers's sound system,conducted by a specialist used by other cities,indicating that an entire new system is not necessary but only an equalizer and
some new wiring.Mr.Frazier stated that i t could cost betwen $1200.00 and
$1500.00.

Phoenix,requested approval of the application for rezoning.
Mayor Clarke asked i f there was anyone
who wished to speak in favor of or in opposition to the petition.There being
no one wishing to address the Council,Mayor Clarke closed the hearing to the
public.
Mr.Gero stated that the Development Co-ordinating Committee and the Planning and Zoning Commission recommend approval
of the rezoning,with dedication of rights -of -way required.

with Mr.Keith Stachar having a power -of -attorney to represent the applicants.
Mr.Keith Stachar,Superstition Realty,
representing the applicants,requested approval of the rezoning,and explained
the proposed uses for the property.
Mayor Clarke asked who is requesting the
30 feet dedication of ri ht-of-wa .
Planning/Drafting Technician Julie Reid,
showed a video of the property in question.
Mayor Clarke asked i f there was anyone
who wished to speak in favor of or in opposition to the petition.
Ms Charlotte Callahan,1980 W.Shiprock,
Apache Junction,addressed the Council in opposition to the rezoning.
Mr.Tony Vehon,230 W. Teepee, ApacheJunction,Vice -Chairman of the Planning and Zoning Commission,stated that thisparticularparcelislistedwithhis real estate office,Lake Realty,but he
does not handle this property,so there is not a conflict of interest.
Mr.Gero stated that the Development Co-ordinating Committee and the Planning and Zoning Commission recommend approval
of the application,stipulating dedication of the right-of-way.

Councilman Damiano seconded the motion.
Councilman Damiano made a statement of
his reasons for being in favor of this rezoning.
Vice Mayor Eidson stated that his onlyobjectiontothisapplication,was the subsequent traffic caused by a trailer
park in this location,asking i f this case could be sent back to the Planning
and Zoning Commission requesting a stipulation to solve this problem and place
the exit on Idaho Road.
Mr.Gero stated that the Council could
postpone until an amendment is made,and that Mr.Broman has street standard
facts which may be reviewed by the Council.
Councilman Damiano asked where the
Central Arizona College proposed location will be.
Mr.Gero informed the Council that there
are two proposed locations,Idaho and Southern,and Silly Mountain.
Acting City Manager Bill McDaniel statedthatthecostofthesiteatSilly Mountain is extremely less.
Councilman Shanks wished to know i f there
was a problem with accidents in areas such as this.
Mr.McDaniel stated that there is not a
problem with accidents in and out of trailer parks.
Councilman Taylor asked what the traffic
capacity is of Southern Avenue at this site.
Mr.Broman stated there are 800 vehicles
per lane per hour,which is extremely low.

ECONOMIC OPPORTUNITY ACTION TEAM )
)Mr.Gero stated that this item has not
been resolved,but is presently being discussed with the City Attorney and
should be further postponed.

APPOINTMENT TO LIBRARY BOARD )
) Mayor Clarke requested a recommendation
for the applicant for the Library Board,Ms Margaret Hammer.
Mr.Roy Hudson stated that Margaret
Hammer had worked in the school library.
Councilman Damiano MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,
THAT MARGARET F.HAMMER,BE APPOINTED TO THE LIBRARY BOARD TO FILL THE VACANCY
CREATED BY THE RESIGNATION OF MS LILLIAN CASTRO,SAID UNEXPIRED TERM TO END
JUNE 30,1985.

APPOINTMENT OF CITY MANAGER )

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,
THAT MICHAEL J.MCNULTY,BE HIRED AS CITY MANAGER AT A STARTING SALARY OF
$41,638.00,PER YEAR,PAYABLE IN TWENTY-SIX (26)EQUAL INSTALLMENTS, EFFECTIVE
NOVEMBER 7, 1983.

Acting City Manager/Director of Public Safety Bill McDaniel,introduced the
new City Manager,Mr.Michael J.McNulty and his wife.
Mr.McNulty addressed the Council with appreciation for their confidence.
WASTEWATER ASSESSMENT )
)Mr.Broman explained that a panel wascreated,consisting of Jim Pfieffer and Jack Barrett,to select a firm to per-
form a study on the alternatives of waste water disposal,of which there arethree firms selected.Should the Council approve these firms,staff will meet
with the first to begin contract negotiations,and when a proposal is completed
i t will be presented to the Council for approval.
Councilman Damiano MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,
THAT THE DIRECTOR OF PUBLIC WORKS IS AUTHORIZED,THROUGH THE CITY MANAGER,TO
BEGIN CONTRACTUAL NEGOTIATIONS IN ORDER TO ESTABLISH SCOPE OF WORK AND FEE FOR
CONSULTING SERVCIES TO PERFORM AN UPDATED WASTEWATER ASSESSMENT.THE
3)RGA CONSULTING ENGINEERS
UPON COMPLETION OF THESE NEGOTIATIONS,THE FINAL CONTRACT SHALL BE PRESENTED TO
THE CITY COUNCIL FOR FURTHER CONSIDERATION.

SERVICES BUILDING.
BE IT FURTHER RESOLVED THAT AN EXECUTIVE SESSION AND A WORK SESSION BE HELD ON
NOVEMBER 15,1983, AT 6:00 P.M.,IN THE CITY COUNCIL CHAMBERS.
Councilman Hill seconded the motion.

Councilman Shanks reported that Council Damiano has been putting the plates
on the gazebo.
Councilman Taylor stated that there will be a Zoning Ordinance Rewrite
Committee meeting at 7:00 p.m.,on November 3, 1983, in the Community ServicesBuilding.
