CALL TO ORDER Mayor Wilson called the meeting to order at 7:02 p.m. B. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Rizzi gave the invocation and Councilmember Nesser led the meeting attendees in the Pledge of Allegiance. C. City of Apache Junction,Arizona page 1 City Council Meeting Meeting Minutes October 18,2022 3. 22-657 Consideration of approval of Resolution No. 22-41, authorizing the city to enter into an intergovernmental agreement with the Salt River Pima-Maricopa Indian Community(SRPMIC)for the city to act as the pass-through agency for the Superstition Fire and Medical District and accept$300,683.61 in distributions from the Proposition 202 State Shared Revenue Program for Fiscal Year 2022-2023 for fire and safety equipment. E. AWARDS, PRESENTATIONS AND PROCLAMATIONS 4. 22-660 Proclamation designating the month of October as"National Code Compliance Month". Mayor Wilson read and presented the National Code Compliance Month Proclamation to Sr. Code Enforcement Officer Sikes representing the city's Code Enforcement division. 5. 22-665 Proclamation designating the week of October 16 through October 22, 2022 as"Arizona Cities and Towns Week". Mayor Wilson read and presented the Arizona Cities and Towns Week Proclamation to Mr.Al Bravo,the city's Public Information Officer. F. REGIONAL INTERGOVERNMENTAL UPDATES 6. 22-653 Brief summary of intergovernmental updates from mayor and councilmembers. Councilmember Evans thanked everyone who came out for"Make a Difference Day" on October 8th. She announced there were approximately 110 volunteers. She mentioned there were 4-40 yard roll off dumpsters used, but if it was for one of the projects or all, it was not clear. She stated the Community Development Corporation works closely with code enforcement to help Apache Junction residents that are physically or financially unable to clean up their own property. Mayor Wilson thanked the volunteers for their time and effort in making "Make a Difference Day" so successful; he was sorry he was not able to stay longer. G. CITY MANAGER'S REPORT 7. 22-651 City Manager's Report. City Manager Bryant Powell thanked his"Apache Junction family"for their support and kindness expressed to him and his family over the loss of his father. He introduced District Director Darron Anglin, from the Superstition Mountains Community Facilities District. 8. 22-633 Update and discussion with Darron Anglin, District Director, on the reinstatement of manure disposal services at Superstition Mountains Community Facilities District No. 1. Mr.Anglin announced they have re-opened the horse manure drop off program. Participants must provide proof of residency to participate, and no garbage contained in the contents.The hours to dump are from 8:00 a.m. and 2:00 p.m. City of Apache Junction,Arizona page 2 City Council Meeting Meeting Minutes October 18,2022 9. 22-652 Announcement of current events. Public Information Officer Al Bravo provided an update on the following current events: • Domestic Violence Awareness Walk-held on Saturday, October 15, 2022 at Prospector Park • Job Fair at Central Arizona College-Wednesday, October 25, 2022 from 10:00 a.m. to 1:30 p.m. • Elections- November 8,2022, Election information can be found at pinalcountyaz.gov • Fit Families Mud Run-Saturday, October 22nd at the AJ Rodeo Center • Halloween Festival-Saturday, October 29th at Superstition Shadows Park from 4:00 p.m.to 8:00 p.m. • Veterans Day Parade- Friday, November 11th starts at 9:30 a.m. at the Focal Point • Festival of the Superstitions-Saturday, November 12th in Flatiron Park • Pumpkins in the Junction- Friday, October 28th at Horizon Health and Wellness Earth Heart Park from 5:00 p.m. to 7:30 p.m. • Citizen Leadership Institute-January through April 2023, contact Mr. Bravo for more details. H. PUBLIC HEARINGS 10. 22-656 Presentation, discussion, public hearing and consideration of Ordinance No. 1529, amending Apache Junction City Code,Volume I, Chapter 3, Administration,Articles 3-2 and 3-3, Section 3-2-3(h), Powers and Duties; Section 3-2-5(a), Division within the Department; and Section 3-3-2(a) Powers and Duties, repealing any conflicting provisions; and providing for severability. Councilmember Schroeder moved,seconded by Vice Mayor Rizzi that Ordinance No.1529 be read by title only and the reading of the entire ordinance be waived. The city clerk to read Ordinance No.1529 by title only. Councilmember Schroeder moved,seconded by Vice Mayor Rizzi that Ordinance No.1529,as read by the city clerk be approved. Assistant City Manager Matt Busby stated this ordinance was presented two weeks ago.This moves the tax auditing division out of the city clerk's office into the finance department. The staff memo outlines the history of when the tax auditing division was created and why. Mayor Wilson opened the public hearing, receiving no comments, he closed the public hearing and called for a motion. I. OLD BUSINESS J. NEW BUSINESS 11. 22-661 Consideration of applicants for annual appointments and reappointments for the City of Apache Junction Boards and Commissions. Council interviewed applicants at the October 17 city council work session and may take this opportunity to fill the positions. City of Apache Junction,Arizona Page 3 City Council Meeting Meeting Minutes October 18,2022 City Clerk Jennifer Pena updated the council with a few announcements. She stated applicant Ari Kalan was in the audience, as he was unable to attend Monday night's City Council Work Session for the interview, and Council has the discretion to call upon any applicant if they had further questions. City council asked Mr. Kalan to provide a brief summary of his experience and the commission he wishes to serve on. Mayor Wilson then thanked all the applicants and their interest to serve their community and shape its future. He then began the appointment process. BOARD OF ADJUSTMENT Councilmember Evans moved, seconded by Councilmember Nesser that Tim Brechon be appointed to the Board of Adjustment for a term to expire on October 31, 2025. Yes: 7-Councilmembers Schroeder, Nesser, Evans, Heck, Johnson,Vice Mayor Rizzi, Mayor Wilson No: 0 Motion passed. Councilmember Heck moved,that Frank Schoenbeck be reappointed to the Board of Adjustment for a term to expire on October 31, 2025. Motion failed. Councilmember Evans moved, seconded by Councilmember Johnson that Michael McGraw be appointed to the Board of Adjustment for a term to expire on October 31, 2025. COUNCIL DIRECTION TO STAFF Councilmember Nesser requested the following direction to staff: 1. Contact the local construction companies and or developers and ask for interested persons to serve as the General Contractor on the Construction Board of Appeals. 2. Reassess the number of commissioners on the Health and Human Services Commission and whether the level of funding should be increased. 3. Reassess the number of commissioners on the Public Arts Commission and membership requirements. 4. The feasibility of dissolution of the Industrial Development Authority due to lack of activity. CALL TO PUBLIC George Schroeder, 2444 W Virginia St.Apache Junction,AZ 85120 made the following remarks: Mobile home park permits are no longer allowed. Mobile home parks are the most prime reality in the valley. When they are sold the city does not get one dollar per unit when they are sold. They are a dead zone in our community. He stated as the winter visitors arrive they are camping everywhere and code enforcement will do nothing on where these"campers"squat.These are illegal aliens, drug addicts, drug dealers, pedofiles, and people overstaying their visas. It is a problem and the city is doing nothing about it. N.
