HomeMy WebLinkAbout1987-07-29 City Council Special MinutesCITY COUNCIL SPECIAL MEETING JULY 29,1987 The special meeting of the City Council of the City of Apache Junction, Arizona,was held on July 29,1987,at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Hill called the meeting to order at 7:00 p.m. ROLL CALL Councilmen Present: Staff Present: PUBLIC HEARINGS Councilman Damiano Councilwoman Perkins Councilwoman Gardner Councilman Bluntschly Vice Mayor Bakkedahl Mayor Hill City Manager Bill R.Da Vee City Clerk Kathleen Connelly Controller Keith Lewis City Attorney David Alexander Director of Planning Chuck Newcomer Director of Community Services Jeff Bell Economic Development Specialist John Schoeph Operations Supervisor Doug Dobson Zoning Administrator Charles Coleman City Magistrate Corwin Brundrett RESOLUTION NO.87-41,ADOPTING EXPENDITURE ESTIMATES AND FINAL BUDGET ADOPTION FOR FISCAL YEAR 1987-88;USE OF FEDERAL REVENUE SHARING FUNDS ORDINANCE NO.582,AMENDING,REVISING, AND ADOPTING THE CLASSIFICATION PLAN FOR THE CITY OF APACHE JUNCTION (With the Emergency Clause )City Manager Bill R.Da Vee outlined SPECIAL MEETING OF THE CITY COUNCIL JULY 29,1987 PAGE 1 the financial plans for the City of Apache Junction for the Fiscal Year of 1987-88,and further recommended that the proposed Budget be approved. Mr.Da Vee also outlined the uses for the additional sales tax,and pointed out that the City Council may only decrease the budget totals previously posted. Mr.Da Vee also addressed Ordinance No.582,which is required in order to make any amendments or revisions in the City Classification Plan,and there are personnel additions included in the Budget. Councilman Damiano MOVED THAT RESOLUTION NO.87-41,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,ADOPTING EXPENDITURES ESTIMATES AND FINAL BUDGET ADOPTION FOR FISCAL YEAR 1987-88;USE OF FEDERAL REVENUE SHARING FUNDS,BE APPROVED AND ADOPTED. Councilwoman Gardner seconded the motion. Councilwoman Gardner asked i f the addition of $5,000 is included in Non -Departmental Funds. Mr.Da Vee stated that that will be attached to the Transportation Program,and part of the uses will be applied to the Handicapped Center. Vice Mayor Bakkedahl questioned the amount of $17,000 in Federal Revenue Sharing Funds. Mr.Da Vee explained that the $17,000 is unspent from last year and will be budgeted for the Transportation Program,and added that unofficially,staff has heard that we will be given a grant for that program. Councilman Damiano thanked Mr. Da Vee,Mr.Lewis,and staff for doing an upstanding job in preparing the Budget. City Attorney David Alexander informed the Council that those items on the agenda including the emergency clause will require a 116-0"vote,or they will not go into effect with the emergency clause. VOTE:Unanimous The motion carried. Mr.Da Vee explained that Ordinance No.582 is required for any changes in the Classification Plan,which includes the cost of living increase. Councilwoman Gardner MOVED THAT ORDINANCE NO.582,BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE,AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Bluntschly seconded the motion. VOTE:Unanimous The motion carried. City Clerk Kathleen Connelly read as follows: ORDINANCE NO.582,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING, REVISING AND ADOPTING THE CLASSIFICATION PLAN FOR THE CITY OF APACHE JUNCTION, ARIZONA;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. Councilwoman Gardner MOVED THAT ORDINANCE NO.582,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. Councilman Bluntschly seconded the motion. VOTE:Unanimous The motion carried. City Attorney David Alexander suggested reconsidering Resolution No.87-41,and allow for a public hearing. Vice Mayor Bakkedahl MOVED THAT ITEM NO.3,RESOLUTION NO.87-41,ADOPTING THE EXPENDITURE ESTIMATES AND FINAL BUDGET ADOPTION FOR FISCAL YEAR 1987-88;USE OF FEDERAL REVENUE SHARING FUNDS,BE RECONSIDERED. motion. VOTE:Unanimous The motion carried. SPECIAL MEETING OF THE CITY COUNCIL JULY 29,1987 PAGE 3 Councilman Damiano seconded the Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the resolution.There being no one wishing to address the Council,Mayor Hill closed the hearing to the public. Mr.Da Vee explained that due Federal Revenue Sharing Funds available,public comment is required,and stated that the available amount i f $17,000 which is planned to attend that for the Transportation Program,specifically to benefit the elderly,economically disadvantaged and handicapped people. Councilman Damiano MOVED THAT RESOLUTION NO.87-41,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,ADOPTING EXPENDITURE ESTIMATES AND FINAL BUDGET FOR FISCAL YEAR 1987-88;USE OF FEDERAL REVENUE SHARING FUND,BE APPROVED AND ADOPTED. Councilwoman Gardner seconded the motion. VOTE:Unanimous The motion carried. PROPOSED RESOLUTION NO.87-43,DECLARING THE PINAL COUNTY SANITARY CODE AS A PUBLIC RECORD PROPOSED ORDINANCE NO.586,ADOPTING SPECIFIC PORTIONS OF THE PINAL COUNTY SANITARY CODE BY REFERENCE (With the Emergency Clause) )Mr.Da Vee explained that advise has been received from Pinal County that the City review the Pinal County Code,and consider the adoption of that Code. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the item.There being no one wishing to address the Council,Mayor Hill closed the hearing to the public. Councilwoman Gardner MOVED THAT RESOLUTION NO.87-43,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING AS A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH THE CITY CLERK AND ENTITLED PINAL COUNTY SANITARY CODE,SPECIFIC PORTIONS OF WHICH,IF ENACTED BY SAID COUNCIL,WILL BE THE BASIS FOR AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF APACHE JUNCTION AND THE PINAL COUNTY HEALTH DEPARTMENT FOR SPECIFIC HEALTH SERVICES,BE APPROVED AND ADOPTED. SPECIAL MEETING OF THE CITY COUNCIL JULY 29,1987 PAGE 4 Councilman Bluntschly seconded the motion. Councilman Damiano objected to "Food Handlers"enforcement not being in the Pinal County Sanitary Code. City Attorney David Alexander explained that Pinal County will only enforce those items in their Code. Mayor Hill suggested going ahead with the agreement,and discussing amendments at a work session. Mr.Da Vee explained the "Food Handler"procedures to the public. Councilwoman Perkins stated that this is an important regulation,as many diseases are transmitted by food handlers. City Clerk Kathleen Connelly stated that should this Code not be adopted,the Health Department will only enforce, within the City limits,those health regulations that are required by State law. Mayor Hill stated that the City could add this regulation on it's own at a later time. Councilwoman Gardner added to the motion: AND THAT ORDINANCE NO.586,BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE,AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. AND I FURTHER MOVE THAT INTERGOVERNMENTAL AGREEMENT BETWEEN PINAL COUNTY, ARIZONA,AND THE CITY OF APACHE JUNCTION,ARIZONA,APPROVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,ON JUNE 16,1987,BE AMENDED AS FOLLOWS: 1.AS TO THOSE ENUMERATED SERVICES TO BE PROVIDED BY PINAL COUNTY,ARIZONA,AS CONTAINED IN THE ORIGINAL AGREEMENT THAT ENVIRONMENTAL HEALTH SERVICES,TO INCLUDE SEPTIC TANKS PLAN REVIEW,INSPECTIONS,CODE ENFORCEMENT BE MADE PART OF THE PROVIDED SERVICES. 2.PINAL COUNTY,ARIZONA IS AUTHORIZED TO CHARGE AND COLLECT THOSE FEES CUSTOMARILY CHARGED AND COLLECTED PURSUANT TO THE FEE SCHEDULE WHICH IS INCORPORATED AS ATTACHMENT #1 TO THE PINAL COUNTY SANITARY CODE. Councilwoman Perkins seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.587,AMENDING THE APACHE JUNCTION CITY CODE, CHAPTER 5 MAGISTRATE COURT,PERTAINING TO THE APPOINTMENT OF A MAGISTRATE PRO-TEM (With the Emergency Clause) )Mr.Alexander explained that a circumstance has arisen where neither City Magistrate will be available,and i t is suggested that there be a specific City Code amendment to allow for the appointment of a temporary magistrate. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the ordinance.There being no one wishing to address the Council,Mayor Hill closed the hearing to the public. City Clerk Kathleen Connelly read as follows: ORDINANCE NO.587,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,CHAPTER 5,MAGISTRATE COURT,ARTICLE 5-2 PRESIDING OFFICER,SECTION 5-2-2 ASSISTANT MAGISTRATE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. Vice Mayor Bakkedahl MOVED THAT ORDINANCE NO.587,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. motion. VOTE:Unanimous The motion carried. Councilman Damiano seconded the CONSIDERATION OF EMERGENCY MEASURE PROPOSED RESOLUTION NO.87-47,REQUESTING THE STATE TRANSPORTATION BOARD AND THE ARIZONA DEPARTMENT OF TRANSPORTATION TO MAINTAIN THE PRESENT DESIGN AND CONSTRUCTION SCHEDULE FOR THE SUPERSTITION FREEWAY )Ms Connelly explained that recently the Mesa City Council took action to request that the freeway extension to the Pinal County line be recessed and that additional interchanges and bridges be provided,and this proposed resolution would be provided to highway officials requesting that the current design and construction schedule for the Superstition Freeway be maintained.Ms Connelly further stated that because this resolution was placed on the agenda by emergency procedure less than 24 hours prior to the meeting,i t is necessary for reasons to be included in the motion,and post those within 24 hours of passage. Mayor Hill recessed the meeting. Mayor Hill reconvened the meeting. Vice Mayor Bakkedahl MOVED THAT RESOLUTION NO.87-47,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,REQUESTING THE STATE TRANSPORTATION BOARD AND THE SPECIAL MEETING OF THE CITY COUNCIL JULY 29,1987 PAGE 7 • ARIZONA DEPARTMENT OF TRANSPORTATION TO MAINTAIN THE PRESENT DESIGN AND CONSTRUCTION SCHEDULE FOR THE SUPERSTITION FREEWAY,BE APPROVED AND ADOPTED. I FURTHER MOVE THAT RESOLUTION NO.87-47 BE CONSIDERED AS AN EMERGENCY MEASURE UNDER A.R.S.§38-431.02 FOR THE FOLLOWING REASONS: 1.THE NEED FOR SAFE AND ADEQUATE TRANSPORTATION FOR OUR CITIZENS 2.OUR DEMONSTRATED WILLINGNESS TO COMPROMISE FOR THE SAKE OF COST SAVINGS AND GOOD CONSTRUCTION PLANNING 3.THE EXTENSIVE AMOUNT OF CITIZEN INPUT ALREADY PUT INTO THE CURRENT DESIGN 4.THE ADDITIONAL COST ALREADY BORNE BY APACHE JUNCTION RESIDENTS FOR THE NECESSARY ROADWAY IMPROVEMENTS IN ANTICIPATION OF THE FREEWAY 5.THE DEVASTATING ECONOMIC IMPACT THAT ADDITIONAL DELAYS IN THE COMPLETION OF THE FREEWAY WILL CAUSE FOR APACHE JUNCTION AND OUR SISTER CITIES TO THE EAST AND WEST,ALREADY ADVERSELY IMPACTED BY THE DECLINE IN THE COPPER INDUSTRY. 6.THE NEED TO ENABLE GILA AND PINAL COUNTY AND APACHE JUNCTION RESIDENTS TO REACH VITAL SERVICES AND EMERGENCY CARE FACILITIES AS QUICKLY AND IN AS SAFE A MANNER AS POSSIBLE.
