SPECIAL MEETING
NOVEMBER 8,1986
The special meeting of the City Council of the City of Apache Junction,
Arizona,was held on November 8,1986,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Hill called the meeting to order at 8:45 a.m
ROLL CALL
Councilmen Present:Councilman Eidson
Councilwoman Gardner
Councilwoman Taylor
Councilman Baljo
Vice Mayor Bakkedahl
Mayor Hill
Staff Present:Acting City Manager/City Clerk Kathleen Connelly
City Attorney David Alexander
AUTHORIZATION FOR CITY ATTORNEY TO
SETTLE PENDING LITIGATION
)City Attorney David Alexander
explained that in the beginning of 1986,he,as City Attorney,was sued.
Mr.Alexander further explained that every city and county attorney in the State
was sued because the State of Arizona passed a law requiring attorneys to notify
parents of plans of an individual to terminate a pregnancy,which Federal Court
found to be unconstitutional and has issued a permanent injunction against every
attorney in the State,and the Court can award attorney's fees to the
complainant.Mr.Alexander requested approval to settle this pending litigation
should those fees be awarded.
Mayor Hill MOVED THAT THE CITY
ATTORNEY BE AUTHORIZED TO SETTLE PENDING LITIGATION REGARDING 85-2118 CIVIL LAW
SUIT.
