Consideration of approval of employment agreement with presiding
magistrate. The current employment agreement with Judge Hazel expires on
June 30, 2019. This new agreement will be for a period of two years
beginning July 1,2019 and ending June 30, 2021.

E.AWARDS, PRESENTATIONS AND PROCLAMATIONS
4.18-513 Recognition by the mayor and city council of individuals and/or organizations
who have made donations to support city activities, programs and projects.
Recipients may wish to make comments on their donation.
Fox Young provided a presentation on this quarter's donors to the various city programs and
services.
F.ANNOUNCEMENT OF CURRENT EVENTS
5.18-518 Announcement of current events from mayor and councilmembers.
Councilmember Rizzi thanked Parks and Recreation for the light parade and recognized the
large crowd in attendance this year. The 7th annual toy drive for CAAFA is this year. AJ Rocks
paints rocks in Christmas decor and hides them in the community for people to find. This same
artist is raffling off an entire village painted on a collection of rocks with proceeds going to
CAAFA. Light the Trail competition has seen an increase in participants. Watch for survey to

vote for your favorite.
Councilmember Evans mentioned the neighborhood cleanup this Saturday, December 8th at 7:30
a.m.
Councilmember Struble also recognized the Saturday winter festival and also recognized the
police and cleanup efforts post event. December 7th and 15th is open mic night at Earthheart
Park from 6 p.m. -9 p.m. He encouraged residents to come show off their musical talents.
January 27, 2019 is the 2nd annual AJ Kids Idol at Barleens.
Vice Mayor Wilson recognized the talent at the open mic night.
Mayor Serdy commented on the nice holiday parade. AZ winter visitor had welcome back bash
to welcome winter residents on Sunday at Barleens which was well attended.
G.CITY MANAGER'S REPORT
6.18-519 City manager's report.
City Manager Bryant Powell commended city staff on the holiday event
Eight people have signed up for the Citizen Leadership Institute with a month left for registration.
It is a culmination of classes where residents can interact with city leadership to learn how the
city operates. Many past participants have gone on to serve on the various city boards and
commissions.
7.18-523 Discussion and update on Apache Junction Unified School District with
Superintendent Dr. Krista Anderson.
Apache Junction Unified School District (AJUSD) Superintendent Krista Anderson provided an
update on the school district, provided statistics of post high school education need projections
for future workforces, and stating their staff wish to strengthen the education of the children in
Apache Junction. Dr. Anderson recognized the relationship AJUSD has with East Valley Institute
of Technology and commented on the lower state average test scores with a commitment to
change those. Dr. Anderson requested the city council's commitment in partnering with the
school district to do whatever it takes to educate the children in AJUSD. Dr. Anderson provided
certificates of partnership and pins for council to wear.
8.18-524 Discussion with Vicky McLaughlin, President of the Superstition Mountain
Historical Society, and introduction of Annie Vaugier, newly hired Director of
the Superstition Mountain Museum, highlighting some exciting news and
activities planned for the upcoming season.
Vicky McLaughlin, President of the Superstition Historical Society, was present to introduce
Annie Vaugier, newly hired Director of the Superstition Mountain Museum. Ms. Vaugier stated
that she looked forward to forming new relationships with business and community partners.
Mayor Serdy commented on the 2022 Founders Day event in which the Superstition Mountain
Museum will play an integral part.
H.PUBLIC HEARINGS
9.18-504 Consideration of application for a temporary extension of premises liquor
license for Elks BPOE #2349, 2455 N. Apache Trail, for the Paws 4 Life
Annual Car Show on Saturday, January 19, 2019.The next step in this

process is for the council to hold a public hearing on the application and make
a recommendation for approval or denial to be forwarded to the Arizona
Department of Liquor Licenses and Control.
City Clerk Kathy Connelly provided an overview of the proposed event and stated no city
departments or the fire district had concerns or issues with the annual event The applicant was
present for any questions. Councilmember Rizzi moved and Councilmember Evans seconded

11.18-528 Presentation, discussion, public hearing and consideration of proposed
Resolution No. 18-35, declaring as a public record that certain documents
filed with the city clerk entitled "2018 Amendments to Apache Junction City
Code, Volume 1, Chapter 9, Health and Sanitation".
Development Services Director Larry Kirch povided an overview and Building Official Dave
Zellner provided a presentation on the proposed changes to Chapter 9 of the city code.
James Stetson, resident, business owner in Apache Junction and member of the Community
Development Corporation(CDC) spoke in favor of the proposed changes to the code as it positively
impacts the efforts of the CDC and has potential to improve the community.
Charles Beal, resident of Apache Junction, reported that a property maintenance issue he
reported to the city 12 months ago still exists and that the system is flawed. Stated the city
council cannot legislate everything. If they choose to change the code they also need to fix the
problem.

Darch Oborne, resident of Apache Junction for eight years, spoke in favor of the proposed
changes but suggested two issues that should be considered.First, the number of horses which
is reasonable given the property size and to make the changes in the minimum stautory time
frame of 90 days, not wait until next July.
Kimberly Bridges, resident of Apache Junction, used to live in Tempe for 25 years who had strong
property maintenance standards spoke in favor of the proposed changes. Lived in city for last
year and lives next to property that has no regard for property maintenance laws.
James Bouregere, resident of Apache Junction, spoke in favor of the proposed changes but stated
the problem persists in the enforcement of these types of issues.
Jim Duncan, resident of Apache Junction, spoke in favor of the proposed changes and
commended staff on their research and efforts on this project
Councilmember Evans commented that in addition to hiring another code compliance officer she
would like to see code compliance a 5 -day a week operation.Mayor Serdy commented further
with an idea to stagger code compliance staff over the weekend.Councilmember Evans asked if
the 90 -day minimum period for advertising of the changes to the city code allowed sufficient time
in educating property owners on those changes that may affect them.
Councilmember Waldron commended staff on their efforts to identify those issues that needed
addressed and strengthen the code to do that

declaring as a public record that certain document filed with the city clerk entitled "2018
Amendments to Apache Junction City Code, Volume 1, Chapter 9, Health and Sanitation"be
approved.

providing for penalties and providing for an effective date.
Councilmember Rizzi moved and Councilmember Evans seconded that Ordinance No. 1467 be
read by title only and the reading of the entire ordinance be waived.
City Clerk Kathy Connelly read the full title of Ordinance No. 1467.
Vice Mayor Wilson moved and Councilmember Rizzi seconded. This motion failed by a vote of
1-5 (Yes: Vice Mayor Wilson, No: Mayor Serdy, Evans, Rizzi, Struble, Waldron)
Councilmember Waldron moved and Councilmember Evans seconded that Ordinance No. 1467 be
approved and adopted with the following amendment:that the effective date be changed to
April 1st, 2019.The ordinance with amendments passed unanimously.

1464 amending the Apache Junction City Code; Volume 1, Chapter 4: Fees,
Article 4-3, Animal Control Fee Schedule; repealing any conflicting provisions;
providing for severability; preservation of rights for current class 3 permit
holders; and establishing an effective date.
Apache Junction Police Department Captain Arnold Freeman provided an overview of the
proposed changes to City Code, Chapter 4, Animals as it relates to pot belly pigs and various fees.
Councilmember Waldron moved and Councilmember Rizzi seconded that Ordinance No. 1464 be
read by title only and the reading of the entire ordinance be waived.
City Clerk Kathy Connelly read the full title of Ordinance No. 1464.
Councilmember Waldron moved and Councilmember Rizzi seconded that Ordinance No. 1464 as
read by the city clerk be approved with the following amendments: effective date of January 5,

I.OLD BUSINESS
16.18-527 Presentation, discussion and possible council direction to staff on public art
and the establishment of a public art commission.
Sponsorship & Partners Program Coordinator Heather Patel provided a presentation to further the
discussion on public art in the community.
Councilmember Rizzi asked how the city would fund a consultant to help with the establishment
with an arts commissions and crafting of the ordinance and policies to change the city code.Ms.
Patel reported that there is $5k in the Economic Development budget to fund a consultant, who is
known to the community and could provide these services within that cost
Mayor Serdy would like to see the proposed arts commission to allow for nonresidents to serve on
the arts commission. Councilmember Rizzi and Councilmember Evans made comments in favor
of establishing an arts commission.
Councilmember Waldron moved and Councilmember Rizzi seconded that direction to staff be
given to staff for the establishment of a public art commission for art projects.

J.NEW BUSINESS
17.18-450 Discussion and possible council direction to staff on the process for filling the
upcoming Planning and Zoning Commission vacancy.
City Manager Bryant Powell expressed interest in receiving council's feedback on how they wish
to fill the upcoming vacancy on the Planning and Zoning Commission due to Councilmember
Elect Schroeder's transition to city council at the January 15, 2019 city council meeting.
Vice Mayor Wilson moved and Councilmember Rizzi seconded that city staff begin the process for
filling the upcoming vacancy on the planning and zoning commission by advertising now,
conduct the interviews at the February 4th work session and appoint the member at the February
5th council meeting.

M.CALL TO PUBLIC
Apache Junction resident Gary Moody expressed concern regarding the safety of the streets due
to people blowing through the stop sign at 12th Ave and Palo Verde. School buses and teenagers
speed through the neighborhood.Mr. Moody stated he complained several times to Apache
Junction Police Department and nothing has been done so he questions the police department's
ability to police.Mr. Moody stated the police department is not doing their jobs in enforcement
and witnessed a young person run a stop sign in front of a patrol car who did nothing.Mr. Moody
suggests speed bumps be placed in the street to slow drivers down.

5.18-554 Announcement of current events from mayor and councilmembers.
Councilmember Evans recognized volunteers and staff who provided assistance with the
Community Development Corporation neighborhood cleanup which saw five dumpsters filled.
She also attended two neighborhood meetings.
Councilmember Struble recognized the police department volunteer dinner he attended last
week.He also attended the annual employee breakfast. He gave a reminder about AJ Kids Idol
on January 27th at Barleens.
Councilmember Rizzi thanked all of the volunteers and donators in the community and reminded

Mayor Serdy commended police department staff who responded to the cruel prank at the high
school last week. He stated as long as he remains on council the horse community properties will
remain the same.
G.CITY MANAGER'S REPORT
6.18-555 City manager's report.
City Manager Byrant Powell recognized and thanked law enforcement response and
collaborative effort to the incident at Apache Junction High School last Friday. Mr. Powell also
read aloud a letter from a resident who commended the efforts of code compliance in a recent
property maintenance issue.
7.18-534 Presentation and discussion on the monthly financial update.
Assistant City Manager Matt Busby provided a monthly report on the city finances.
H.PUBLIC HEARINGS
8.18-558 Consideration of application for a special event liquor license for Superstition
Mountain Rotary Club #1246 for the Apache Junction Rodeo Grounds, 1590 E.
Lost Dutchman Blvd., Apache Junction, Arizona, for Lost Dutchman Days,
February 22, 23 and 24, 2019. The next step in this process is for the council
to hold a public hearing on the application and make a recommendation for
approval or denial to be forwarded to the Arizona Department of Liquor
Licenses and Control.
City Clerk Kathy Connelly described the event and stated no departments had issues with the
event.The applicant was present to answer any questions from council. Councilmember Rizzi
moved and Councilmember Evans seconded that the application for a special event liquor license
submitted by Superstition Mountain Rotary Club #1246 for the Apache Junction Rodeo Grounds,

9.18-580 Presentation, discussion, public hearing and consideration of Resolution No.
18-43, case SD -1-18, by AJ 40 LLC and ITOW LFP, represented by Dan
Kauffman of Kauffman Homes, proposing a preliminary subdivision plat for a
+/-259-lot conventional homes subdivision with public and private streets and
resident amenities, to be called Superstition Vista.
Senior Planner Rudy Esquivias provided a presentation on the rezoning and preliminary plat
request by Kauffman Homes LLC for the proposed 259 -lot subdivision Superstition Vista.
Mayor Serdy responded to previous concerns mentioned and stated that no off -road driving could
take place on the surrounding state land.He also asked if there had been any commercial
interest in the property prior to this proposal.Mr. Esquivias responded no, that he was unaware
of any interest in the property for commercial purposes in numerous years.
The applicant, Dan Kauffman, was present to address the city council on the project and also
stated he and his wife own horses and are horse friendly.
Councilmember Evans inquired about placement of no parking signs to prevent an increase in
street signs.Councilmember Evans inquired if the HOA will allow homeowners to extend their
driveways to allow for a third car in the driveway for families with teenage drivers.Mr. Kauffman
answered yes unless specific properties were prevented due to fire hydrants.
Resident Charles Beal informed city council that certain environmental testing should be done
due to proximity to the dump and that the developer should indemnify the city for any damages
as a result of carnicogens or other health hazards due to proximity to the dump.Mr. Beal
expressed his desire for a moratorium on any lot sizes under 5,000 sq ft. and that the proposed
subdivision would equate to 30 people per acre and over 1,000 people in the subdivision and only
behooves the developer and not the city.Mr. Beal stated that Mr. Kauffman has built
relationships with city staff in his previous projects which may have skewed the real goal of the
city.Mr. Beal asked city council to consider if this and other high density development is the right
direction for the city.
Mr. Kauffman stated soil testing among other tests are conducted prior to development and that
the proposed subdivision is upstream from the dump.Mr. Kauffman stated he is not the current
property owner for the subdvision but will be closing in the next month and that the previous
owner and any property tax issues have nothing to do with the city and everything to do with the
county.
AJUSD Superintendent Dr. Krista Anderson stated her support for development that brings
affordable housing and more children into the school district, further stating they have lost over
1,000 students in the last five years.
Business owner Audrey Oulette spoke in favor of development that brings more business to
Apache Junction.
Twelve year resident Heidi Galvess-Young stated that recognizing growth is important to the city
and voiced her support for the development Ms. Galvess-Young stated her family which consists
of two small children rely on good schools and thriving businesses within the city.

Coucilmember Waldron expressed this proposed development may present an opportunity for
movement on future development in the surrounding state land in the city's planning area.Vice
Mayor Wilson concurred.
Councilmember Evans made clarifying statements on engineer sign -off required on development
in and around flood plain, the city's reliance on sales tax since the city does not assess a property
tax, and larger lot sizes with larger scaled housing would price the Apache Junction resident out
of the buying market Councilmember Evans maintained mixed density is vital for community
growth and has been in the plan for the planning area in the south for years.

a resolution of the mayor and city council of the City of Apache Junction, Arizona, approving a
preliminary subdivision plat for the "Superstition Vista" subdivision, in Case SD -1-18, by AJ 40

M.CALL TO PUBLIC
Resident and Chairman of the Superstition Horsemen's Association Darrell Cross commended the
city council for the hardwork they do to remain a horse -friendly city.Mr. Cross provided
examples of the benefits the city and community gain through various contributions of horse
property owners.
Resident Kathy Dierdoff continued Mr. Cross' dialogue on the benefits horseowners bring to the
city.Ms. Dierdoff shared a comedic top ten list of reasons to own a horse instead of a dog.

Resident Douglas Matthewson expressed Apache Junction is a unique town that is horse -friendly
that receives tax revenue from horseowners.
Resident and City Board Member Frank Schoenbeck responded to the city council regarding their
discussion on ethical behavior of city board and commission members. Mr. Schoenbeck stated
he along with a couple of other city board members attended the American Planning
Association's session on ethical behavior last week which consisted of the same information they
received prior from City Attorney Joel Stern. Mr. Schoenbeck suggested more education on the
influence of social media and the addition of Robert Rules of Order information for board
members.
