REGULAR MEETING
OCTOBER 3, 2017
The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on October 3, 2017, at the
Apache Junction City Council Chambers pursuant to the notice
required by law.
CALL TO ORDER
Mayor Serdy called the meeting to order at 7:00 p.m.He
called for a moment of silence for the tragedy in Las Vegas to
be followed by the invocation.
INVOCATION
Vice Mayor Wilson gave the Invocation.

ACCEPTANCE OF CONSENT AGENDA
)Vice Mayor Wilson MOVED
THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED; AND
THAT APPROVAL BE GIVEN FOR THE AGREEMENT BETWEEN THE CITY OF
APACHE JUNCTION AND SOUTHERN COUNTIES OIL COMPANY DBA SC FUELS
IN AN AMOUNT NOT TO EXCEED $500,000 FOR BULK FUEL FOR A PERIOD
OF ONE YEAR WITH THE OPTION TO RENEW FOR FOUR ADDITIONAL ONE
YEAR PERIODS.
Councilmember Evans SECONDED
THE MOTION.
VOTE:Unanimous.

AWARDS, PRESENTATIONS AND PROCLAMATIONS
Councilmember Barker read a proclamation designating October
2017 as "Domestic Violence Awareness Month" and presented it to
Community Alliance Against Family Abuse Executive Director
Dorian Townsend.
Ms. Dorian Townsend thanked the council and the community for
their support and invited everyone to the kick-off event on
October 5 with numerous other events throughout the month.The
final event is on November 4.She showed the posters that were
designed for local businesses.
Mayor Serdy read a proclamation designating October 23-31, 2017
as "Red Ribbon Week" and presented it to East Valley Young
Marine Lieutenant Woods who thanked them for the proclamation
and their support.
ANNOUNCEMENT OF CURRENT EVENTS
Councilmember Struble announced parks and recreation is having
their annual Mud Run on October 21.
Councilmember Struble announced two weeks ago the high school
marching band won first place in a competition at Basha High

School.This past Saturday they won second place in a
competition.He congratulated them.
Mayor Serdy commended Councilmember Barker for being appointed
to the board of directors for Superstition Area Land Trust.
Mayor Serdy announced that Filly's is open again and encouraged
everyone to go and support them.
CITY MANAGER'S REPORT
City Manager Bryant Powell commented on the Shop Local program,
thanked the sponsors of the town hall, reminded everyone of the
upcoming retreat, honored Assistant Manager Matt Busby for his
ten years of service and commented on an award from United Way
of Final County for first place in municipal employee donations.

Connelly briefed the council on the item.
Mayor Serdy requested the
applicant address the council.
Mr. Bill Kimball with the
Fraternal Order stated they do this every year and all the money
they raise goes towards cancer research.He requested their
approval so they could donate to cancer research.
Mayor Serdy commented he
wanted to encourage them to bring KISS back.The concert they
had a few years ago was very interesting.
Mr. Bill Kimball stated that
was not Kiss.They were fake.
Mayor Serdy commented they
had him fooled.He thought it was the real KISS.

Councilmember Barker asked
what time the event would be.
Mr. Bill Kimball stated from
noon to 5 p.m.
Mayor Serdy opened the public
hearing on the item.There being no one wishing to speak, he
closed the public hearing and reopened the item to council
discussion.There being no further discussion, he called for a
motion.

THAT THE APPLICATION FOR A TEMPORARY EXTENSION OF PREMISES FOR
FRATERNAL ORDER OF EAGLES #3850 FOR NOVEMBER 4, 2017, SUBMITTED
BY WILLIAM KIMBALL, BE RECOMMENDED FOR APPROVAL TO THE ARIZONA
DEPARTMENT OF LIQUOR LICENSES AND CONTROL.

Connelly briefed the council on the item.
Mayor Serdy commented they
would do the Construction Code Board of Appeals first.He
called for a motion on the first one.

Councilmember Struble
commented because they are lacking applications for these
particular positions, he asked about Jesse Gage, also on the
parks and rec commission and the sewer district, who is also a
mining engineer.He asked staff to check and see if that would
qualify to fill in the engineer position on this board.
Mayor Serdy asked if he would
like to nominate him.
Councilmember Struble
commented he wanted to know first of all if he is eligible.
City Manager Bryant Powell
asked the city attorney if he is eligible.
City Attorney Joel Stern
stated it does not really say in the code whether it can be a
mining engineer.It just says architect or engineer.He
believes that is a form of an engineer so he would say he can
nominate him for that.
Councilmember Waldron asked
if Jesse Gage wants to do it.
Councilmember Struble
commented he talked to him today and he agreed.
Mayor Serdy called for a
nomination for him with a term to expire October 31, 2018.

THAT JESSE GAGE BE APPOINTED TO THE CONSTRUCTION CODE BOARD OF
APPEALS IN THE CATEGORY OF PROFESSIONAL ARCHITECT OR ENGINEER
FOR A TERM TO EXPIRE OCTOBER 31, 2018.

it should be 2019.

stated he is filling a position that had been vacant so it
should be 2018.

stated they are looking at the possibility of not getting a
quorum.
Councilmember Barker
commented they could go out again.

stated they could go out again.But if they do not have a
quorum then they still could meet because they did not fill it
because of the impossibility, if they want to call it an
impossibility, because they cannot come up with a name.

they could fill it with one of the people that have been
currently nominated.

stated that is correct.
Mayor Serdy asked if anyone
would recommend that we send this back out for more volunteers.

he would.
Mayor Serdy commented they
could do that in the interim and try it again in a month or so.
City Manager Bryant Powell
stated they could maybe tie that in for a council direction to
staff because of a sewer district letter he received.They can
come back in a few weeks.They can include this one when they
go out to recruit.
Councilmember Struble
commented when they advertise for that particular board they
specifically say what the city specifically needs.

stated that is correct.

commented they need to put in big, bold letters "attention
contractors, you are needed".

stated to give them some perspective, this board has not met
since Camboni.It has been a while.

stated it almost did during the Blue Bell incident with the
wall.

stated they could certainly do that.

There was general discussion
among the council regarding the applicants and when this board
meets.
Councilmember Barker
commented she was ascertaining that it does meet once a year.
Councilmember Struble
commented the last time they did appoint people from other
boards into this to be other board members.They did not
necessarily apply for them.He asked if they could do that here
if the people were okay with that.He had talked to a couple of
people that would be willing to do it.
Councilmember Barker
commented they should put this out for applications for those
people and have them fill the application out for when they do
the sewer district for their person and when they do the
Construction Code Board of Appeals.

thinks they may have one nomination and they will have one more
that they have to put out.

the three spots on the Construction Code Board of Appeals, one
on the Municipal Property Corporation and then the one on the
sewer board.

CALL TO THE PUBLIC
Major Kris Suarez, 605 E. Broadway, Apache Junction, addressed
the council regarding donations for the Christmas Angels program
for the Salvation Army, volunteer recruiting and looking for a
new facility.
Mr. Thomas Aulik, 503 E. Montebello, Apache Junction, addressed
the council regarding his concerns about things to attract
millennials, lowering taxes and requesting state land across
from Gold Canyon.

AWARDS, PRESENTATIONS AND PROCLAMATIONS
Mayor Serdy read a proclamation designating October 15-21, 2017
as "Arizona Cities and Towns Week" and presented it to Public
Information Officer Al Bravo.
ANNOUNCEMENT OF CURRENT EVENTS
Vice Mayor Wilson announced the Mud Run will be at the rodeo
grounds this weekend.
Councilmember Evans announced two weeks ago the council met with
the local multiple listing service board, the political watchdog
over cities to make sure the city is not overstepping its
bounds, for an exchange of information.She called their leader
today and he informed her they like coming to Apache Junction
out of all the cities in the southeast valley the most because
at those meetings each side asks questions and interacts.The
other cities appear to put on airs and show what they
accomplished with no real dialogue.It shows the city is more
approachable.
Councilmember Waldron reminded everyone of the annual Veterans'
Day Parade on November 11.
Councilmember Waldron announced November 11 is also the weekend
for the Festival of the Superstitions.It is at Flatiron Park.
Mayor Serdy announced there are 21 new trees planted and some
boulders on Royal Palm that have been donated by the residents.
Mayor Serdy announced the new Fry's will be opening up on
October 27 with a ribbon cutting at 7:30 a.m.The gas pumps
will open up next week.

City Manager Bryant Powell commented on the Halloween event, the
Veterans' Day Parade, the Holiday Light Parade and Officer of
the Year Wes Kelly.
Assistant City Manager Matt Busby gave the monthly financial
update.
Councilmember Struble commented comparing the year to date of
actual sales tax collection and accruals, it is much lower for
this year compared to previous years.He asked if that means we
are still lacking the state reimbursing us the money that we are
due.
Assistant City Manager Matt Busby stated that is very much the
case.They are still trying to figure it out, and he thinks the
state is trying to figure out their systems and remit it to us
in a timely manner.What we are used to getting is changing now
since last January when the department of revenue began
collections.
Councilmember Struble commented when you look at our specific
revenue, most of our collections are up from other revenue
sources and such but it has very significantly dropped from year
to year from our self -tax collection.He wanted to make a point
of it so that if there is anybody out there that represents us
on the state, please pay attention to it.

#2349, addressed the council.She stated last year Tuni House's
car show did not go over very well because the weather was bad.
They have set another date for a rain date, just in case.That

is why there are two of these.They had to be done separately.
Hopefully she has a good turnout for this one as it is for a
very good cause.Another is the Beer and Brat Festival at the
Lodge which is the Thursday kick-off for Lost Dutchman Days.

Mayor Serdy requested the
applicant address the council.He asked if they are white brats
or red brats.
Ms. Cindy Pierson, Elks Lodge
#2349, stated they are Johnsonville Brats.They do it every
year and they would love everybody to come out.It is the kick-
off for Lost Dutchman Days.They have 4 bands during the day.
The first two bands are polka bands.It is the biggest event of
the year for the Elks.

#2349, addressed the council.She stated the only thing
different this year is they will have it on Friday instead of
Saturday.They are trying to get a little better turnout.It
is a good time.
Mayor Serdy asked what kind
of band they will have.
Ms. Cindy Pierson stated it
will be a country band.Lost Dutchman Days brings the band in.

commented he thought it was a great opportunity.It helps out
them and it helps us, too.In this case it is a loader and not

first sat on the council he felt like we were giving away value.
Then it was explained to him through the auction process and

Larry Kirch stated that would probably be one of the uses we
would say would not be allowed.They were recently meeting with
an architect who was working on a possible medical office in
that corridor.He was trying to put a medical office building
of about 9,000 sq.ft.That will be a good test for them to see

what they might need for a landscape buffer, possibly moving it
to the north property line instead of having it along the
roadway.He thinks it will be a good update.

stated he wanted to thank Larry and his staff for moving
quickly.They have an economic development opportunity and they
needed to move to see if they could get some things happening in
that area.A very good group is interested in making that
happen.

reason this came back is because they did not have enough
applicants last time that were qualified.
Councilmember Barker
commented they were not qualified so that has to be emphasized
as we go out for this, that the applicant has to be a
contractor, has to be an engineer, et cetera.
City Manager Bryant Powell
stated they will emphasize that.He thinks that is very
important, especially on the Construction Code Board of Appeals.
They will be ready for that once they are given direction to
recruit.He asked if there is any other place that they are
missing that they can think of.They are trying all avenues of
social media and the traditional ways.Maybe there are other
ways.
Councilmember Rizzi asked
what the minimum age must be.She asked if they could go to any
of our youth for any of these.

commented they have to have an engineering degree.
