DECEMBER 5, 2017
The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on December 5, 2017, at the
Apache Junction City Council Chambers pursuant to the notice
required by law.
CALL TO ORDER
Mayor Serdy called the meeting to order at 7:00 p.m.

Vice Mayor Wilson gave the Invocation.

AWARDS, PRESENTATIONS AND PROCLAMATIONS
Sponsorship/Partnership Programs Coordinator Roger Hacker
recognized individuals and organizations who have made donations
to support city activities, programs and projects.Some
recipients in attendance spoke about the reason for their
donation and all had their picture taken with Mayor Serdy and
various staff members.
Councilmember Struble commented during the recognition item that
last spring the council moved to have a town hall and retreat to
develop a vision, mission and goals for the community.They had
the town hall in September and retreat in last October.They
started to develop a vision, mission statement and four, large
goals for the community.The assistance the organizations gave
to help fund the retreat was immeasurable.The vision, mission
statement and goals will help to bring the community together in
the future, such as working with the school district.The
community has to start working together and continue to work
together to build the community to be even better.
ANNOUNCEMENT OF CURRENT EVENTS

Vice Mayor Wilson thanked the community and the parks and
recreation department for the Christmas event we had this past
weekend and the parade of lights.It gets bigger every year.
Councilmember Struble commented the Kiwanis Club had a booth at
the festival and it seemed like there was a lot more people.
They had a lot of great comments from people.He thanked all
the employees in the city as they probably all had a part in
this event.
Councilmember Struble announced the Kiwanis Club will be having
the AJ Kids Idol program on January 28 at Barleens.
Mayor Serdy asked the age for the program.
Councilmember Struble commented from kindergarten to high
school.They have to live in or attend school in Apache
Junction.
Councilmember Evans announced this Saturday between 9 and 2 is
the first Farmers' Market for the season at Earth Heart Park.
Councilmember Evans announced the Community Development
Corporation had a retreat this past week and is moving forward.
Councilmember Waldron reminded everyone there are 19 shop local
days until Christmas.
Councilmember Rizzi thanked the parks and recreation staff for
the Christmas event and thanked the clean up crew who cleaned up
after the parade.
Councilmember Rizzi commented on their tailgate party they had
at their business during the parade and encouraged other
businesses to do so in the future.
Councilmember Rizzi announced the Light the Trail event got a
slow start so they are delaying the voting for a little bit and
there will be a link for the people to vote on the businesses.
Councilmember Barker commented the parade was awesome and the
tree lighting was marvelous.

Mayor Serdy commented the parade was a great thing for the city
with people coming from outside the city to enjoy it.It is an
economic driver for the restaurants.
Mayor Serdy announced Wendy's is open with the grand opening on
Friday.
Mayor Serdy announced Richard Wilson has been named interim
Chief Executive Officer of the Chamber of Commerce.
Mayor Serdy announced there has been a rash of dumping in the
city from people out of town.He commended the police and park
rangers who found clues leading to an arrest.
CITY MANAGER'S REPORT
City Manager Bryant Powell commented on the holiday light
parade, the winter visitors welcome back bash, the mission and
vision statement, desert dumping and solid waste pickup and
thanked Arizona State University for being a partner on the
Arizona Project Cities and those that participated in the town
hall.
Vice Mayor Wilson commented he has talked to other cities over
the years on how they do donations to their community.Just
about every one of them are shocked to hear that we have a
community that gives like this.We have a great community, a
unique community that is willing to step forward and give to the
community to keep it going.He wanted to say a special thank
you for that.

briefed the council on the item.
Councilmember Rizzi commented
her question was on liability as he said they could put them on
the traffic lights.The city has a say in safety.She is not
sure how they would regulate that.The city could determine
that the way they installed it is safe.She asked what would
happen if something were to happen afterwards that caused an
injury accident.She asked if the city would be liable.
City Attorney Joel Stern
stated it would depend on how someone sued.Essentially, the
wireless company will be liable.They might have to reinforce
it.The city would get sued and add Verizon.The city would
try to get out of the lawsuit by saying it has a contract with
them and they are supposed to indemnify the city.They would
then take on the lawsuit and pay for any of the damages.That
is how it is supposed to work.
Councilmember Rizzi commented
that even though the city has input on the safety it would still
not come back on the city.
City Attorney Joel Stern
stated someone can always allege that but it will be their
standards that are approved.The city would not be the
engineers that stamp those.It would be their engineers that
stamp them and we would approve it as to form which would say
that meets our standards.As for actual liability, no.We set
the standards and they have to have an outside registered
engineer or someone on their staff stamping it.They have an
agreement in here that they would have to sign to have that
location.
Mayor Serdy opened the public
hearing on the items.There being no one wishing to speak, he

closed the public hearing and reopened the items to council
discussion.There being no further discussion, he called for a
motion.

)Mayor Serdy commented this
normally would have been a work session item but in order to
save on staff and time it has been moved to this regular
session.
City Clerk Kathleen Connelly
briefed the council on the item.
Mayor Serdy requested the
applicant for the Construction Code Board of Appeals address the
council.
Mr. David Hantzsche, 142 S.
Royal Palm Road, Apache Junction, addressed the council.He had
applied for the position.
Mayor Serdy thanked him for
applying and called for any questions.
Councilmember Struble asked
what position he is applying for.
City Clerk Kathleen Connelly
requested the development services director respond as their
packets had emails on what this board should or should not
consist of.
Development Services Director
Larry Kirch stated they have a copy of the ordinance and an
email from him in their packets.There are currently three
board members.Over the years they have had six but technically
they only need five.There is one lay person on the board and
that person has to be a city resident.They currently have a
lay person on the board that is not a city resident.They have
to thank that person for their service even though they have not
had a meeting since they were appointed.To meet with the
ordinance they need a new lay person that is a city resident.
Technically they currently have three vacancies.Mr. Hantzsche
could fill the lay person vacancy as he is a city resident.

Vice Mayor Wilson asked if he
understands that the board does not necessarily meet all the
time.
Mr. Hantzsche stated he does.
Mayor Serdy thanked him for
stepping up and applying.He asked when this would come back to
them.
City Clerk Kathleen Connelly
stated it will be the December 19th meeting for appointment.
Mayor Serdy commented there
are four applicants.
City Clerk Kathleen Connelly
stated there are four applicants for the sewer board.Four that
were filed on time and a fifth one that was not.They include
Mr. Buzzin, and she does not see him here at this time, Mr.
Robert Schroeder is here, Phillip Tremonti, Kevin Voight and the
one that was received late is Richard Dwyer.Three people are
city residents even though it is not a requirement.Two live in
Gold Canyon.The city attorney might want to explain whether or
not they have to be city residents and residents of the sewer
district.
Councilmember Waldron
commented they also have a copy of an email that says Mr. Voight
is not interested.
City Attorney Joel Stern
stated under 48-711, the special districts law, which was relied
upon to create this district, for appointment or reappointing
someone they do not have to be a city resident.They do not
have to live in the district but if they do and they have 40
acres or more then they cannot be an appointee.They cannot be
a city council member, city employee, an agent thereof or a
relative.It is limited but people living in Gold Canyon can
sit on the board.He believes past councils have appointed
people from Gold Canyon.

Councilmember Struble asked
for clarification on the one that is two weeks late.
City Clerk Kathleen Connelly
stated they gave it to the council.It is at their discretion
whether or not they want to consider it.If it is not
considered now, it will be put in the file for the next time
there is an appointment and it will come back to them then.
Mayor Serdy asked if that
person only tried for the sewer board or did he put in for
others.
City Clerk Kathleen Connelly
stated it was just the sewer board.
Mayor Serdy asked if anyone
was here that they could talk to tonight about the sewer board.
There was general discussion
among the council and staff that determined the only applicant
for the sewer board in attendance was Robert Schroeder.
Mr. Robert Schroeder, 3899 S.
Wickiup, Apache Junction, addressed the council.
Vice Mayor Wilson asked why
he was interested in this.
Mr. Robert Schroeder stated
ten years ago he started a business in Apache Junction.The
city and residents have been very good to him.Five years ago
he decided to make a commitment to the city and every day since
then he has been working towards that.This is another step for
more knowledge to make him a more valuable resource to the city.
Mayor Serdy asked if he
thought it would be too much with him being on the planning and
zoning commission.
Mr. Robert Schroeder stated
he understands it is one day a month in the morning.He does
not think that would be a problem.

Councilmember Struble
commented they do meet more than once a month during budget time
and others issues that might come up.
Mr. Robert Schroeder stated
that is understandable when something comes up that is out of
the ordinary.Generally, it is the third Tuesday or fourth
Tuesday of the month.
City Clerk Kathleen Connelly
stated before he sits down, Larry Kirch just pointed out to her
that Mr. Schroeder could serve as the second contractor on the
Construction Code Board of Appeals.He is not a general
contractor.She does not know if he is interested in that or if
there would be a conflict with the planning and zoning
commission.The city attorney would have to answer that.
City Attorney Joel Stern
stated it would depend on what cases are presented before the
planning and zoning commission.Generally, he would say no, he
could do it if he really wanted to.If they were to fill it
with Mr. Schroeder and an issue came up, he could then declare a
conflict.He does not think the board has met in years.
Besides that, he does not think there is a conflict.
Mayor Serdy commented it is a
position they really need to fill because it is empty.
City Attorney Joel Stern
stated they could do that and he could talk to him if he feels
there is any conflict on a case by case.
City Clerk Kathleen Connelly
stated that is if he is interested.
Mr. Robert Schroeder stated
he likes the meeting times.That works out pretty well.If
they need somebody he is a contractor in the city.
Councilmember Struble asked
if he understands it is somewhat of an autonomous board.The
city council appoints them and the board oversees the budget,
policies, procedures and everything that goes along with it.

he understands completely.
Mayor Serdy thanked him and
commented there were no others to interview so they will talk
about this on December 19th.He asked how many positions were
open on the sewer board.

NO -COST OBLIGATION
INTERGOVERNMENTAL AGREEMENT WITH
PINAL COUNTY ALLOWING FOR THE
COLLABORATION OF ROAD MAINTENANCE
FOR SELECT SEGMENTS OF
SUPERSTITION MOUNTAIN DRIVE,
SOUTH MOUNTAIN VIEW ROAD,
SOUTHERN AVENUE AND TOMAHAWK ROAD )

Kiesow briefed the council on the item.
Councilmember Barker
commented he mentioned the widening of Southern west of
Ironwood.They would have to widen on the south side as there
is a sidewalk on the north side.
Public Works Manager Shane
Kiesow stated that is correct.
Councilmember Barker asked if
the south side is Pinal County.
Public Works Manager Shane
Kiesow stated it is.
Councilmember Barker asked if
that is part of the intergovernmental agreement.
Kiesow stated that is correct.

Kiesow stated it is not.There will be a separate
intergovernmental agreement for that.

Councilmember Barker
commented they will have to pull that into the city.
Public Works Manager Shane
Kiesow stated he does not think they are looking to pull that
into the city or take over the street.It will be covered for
the city to maintain that once the full improvements are made at
that time.There currently is some existing pavement.
Councilmember Barker
commented very poor existing pavement.It has large holes into
which she has fallen.
Public Works Manager Shane
Kiesow stated he thinks this will give us a little bit more
capability to go out there and address that issue in the future.
City Manager Bryant Powell
stated he wanted to thank public works and Pinal County for
working with this.It will help the city a bunch as there are
several county islands which cause a little organizational
friction.This is a great process improvement.They are
working through this agreement and he thinks it will serve the
city and its residents well.They have a great opportunity.If
there is an accident on US 60 they can have the opportunity to
have widened capacity on Southern.It will be great to have.
Vice Chairperson Wilson
commented he had talked about the general upkeep.He asked if
it goes back to the original responsibility if the road
deteriorates to where it has to be repaired.He asked what kind
of insurance they will have that they are doing the proper
maintenance on that section.
Public Works Manager Shane
Kiesow stated there are so many different practices for
maintenance even when it comes to the rehabilitation of a road.
It would take them forever to put this agreement together when
it comes down to covering all those different practices.He has
had discussions with their pavement manager and they have an
understanding as to what is considered routine maintenance.
There might be some differences in opinion in the future where
he might say a road needs an overlay and the county may think it

is not quite there yet.They will have to collaborate together
to come to an agreement.They may need to have constant
communication to determine if the county is moving forward to
get it done by a certain time.It could be a reason for the
city to cancel the agreement if the county is not doing the
level of maintenance the city believes needs to be done.It can
be canceled at any time.
Mayor Serdy commented this is
a discussion item only with no action to be taken and he moved
on to the next item.
CONSTRUCTION AGREEMENT WITH VIASUN
CORPORATION FOR THE INSTALLATION
OF SIDEWALKS ON PALO VERDE DRIVE
IN THE GRAND VIEW NEIGHBORHOOD

Schatz briefed the council on the item.
Councilmember Waldron asked
if the city is funding $37,000.00 above the State Special
Project grant.
Project Engineer Raquel
Schatz stated that is correct.Actually, per Resolution No. 17-
06 that was presented earlier this year, the engineer estimate
that was provided with the application was much higher than the
current estimate, so that resolution accounted for about $77,000
of leverage and overages.They had already determined what the
funding would be but now that the cost has gone down from
$332,000 previously, the current one now includes contingency
for almost the same amount for the application funding without
contingency.We are actually saving money.Whatever is over
the overage that had already been put away for funding, the
overage over that HURF will be paying for.If we do use all the
contingency money there would only be about $918 left that the
city would be responsible for.
Councilmember Struble
commented the sidewalks will be on the west side.He asked if
the east side would still be a curb and gutter.

Schatz stated that is correct.
Councilmember Struble
commented there would be dirt to the east of the curb and
gutter.

Schatz stated it will be graded behind the curb and gutter.
They do not have any additional funds for that.
Councilmember Struble asked
if this includes the wastewater infrastructure or does more
infrastructure have to be done.
Project Engineer Raquel
Schatz stated this is the easiest road and that is why it was
chosen.There are only 2 or 3 sewer manholes that the
contractor will have to rotate to get out of the curb and gutter
area.Arizona Water Company utilities are in the alley.They
will have more in the future that will have to be relocated.
Mayor Serdy closed the
discussion with no further comments and called for a motion.
Councilmember Barker MOVED
THAT APPROVAL BE GIVEN TO THE CONSTRUCTION AGREEMENT BETWEEN THE
CITY OF APACHE JUNCTION AND VIASUN CORPORATION FOR THE
INSTALLATION OF SIDEWALKS ON PALO VERDE DRIVE IN THE GRAND VIEW
NEIGHBORHOOD IN THE AMOUNT OF $307,228.25 PLUS 10% FOR
UNFORESEEN CHANGES IN THE AMOUNT OF $30,722.82 FOR A TOTAL
AMOUNT NOT TO EXCEED $337,951.07; AND THAT AUTHORIZATION BE
GIVEN TO THE MAYOR TO SIGN THE AGREEMENT PENDING FINAL APPROVAL
AS TO FORM BY THE CITY ATTORNEY.

AGREEMENT FOR LANDSCAPE
MAINTENANCE SERVICES FOR THE CITY )

Blake briefed the council on the item.
Councilmember Struble
commented they basically absorbed the increase in the minimum
wage from last January to this point.They are now asking for
an increase because of the next increase in the minimum wage.
It will be another 50 cents on January 1.He does not have to
answer that.He is just making a statement on what happened to
this company and why they are asking for an increase.
Parks Superintendent Nick
Blake stated they have been impacted by that.
City Manager Bryant Powell
stated he thinks it is another year before they go out and bid
again.They have been very competitive.We do have to stay on
top of it and manage the contract.
Mayor Serdy asked if there
would be any more maintenance in the future with the project
that they have going with the Royal Palm median and around
Flatiron.Once they turn that over to us completely the city
will be doing that in house.

Blake stated Flatiron is ours right now.We are maintaining
that.
Mayor Serdy asked if they are
through the warranty period.
Parks Superintendent Nick
Blake stated they are not through the warranty period but any
maintenance is ours.
City Manager Bryant Powell
asked about the maintenance on Royal Palm.

Blake stated the maintenance that they do on Royal Palm is weed
control and litter control.If they start adding substantial
landscaping in there whoever bids that project will increase
their price as there will be more to do.
Mayor Serdy commented the
residents are willing to step up and do it if that does not
bother the city attorney.They can talk about that when it
happens.
Councilmember Waldron
commented the motion mentions Royal Palm Road.He asked if that
is only for the palm trees.
Parks Superintendent Nick
Blake stated that is basically for the watering of the palm
trees and weed control and litter control.
Mayor Serdy asked how long
they have had the contract.
Parks Superintendent Nick
Blake stated Somerset has had it for three years.
Mayor Serdy commented whoever
had it before them actually killed some of the palm trees on
Royal Palm by trimming them too much.
Parks Superintendent Nick
Blake stated it was about that time that they put in the
irrigation system to provide water.
Mayor Serdy closed the
discussion with no further comments and called for a motion.
Councilmember Rizzi MOVED
THAT THE FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF
APACHE JUNCTION AND SOMERSET LANDSCAPE MAINTENANCE INC. FOR
LANDSCAPE MAINTENANCE FOR RENAISSANCE POINT, ARROYO VERDE,
PHELPS DRIVE PHASE I AND II, IRONWOOD COVE, ROYAL PALM RD.,
IRONWOOD DR. EXIT, GOLDFIELD RD. EXIT, TOMAHAWK RD. EXIT, IDAHO

vote yes but this is one of those unintended or maybe intended
consequences of the vote of that 206 which raised the minimum
wage.It made us reallocate funds to this, which is appropriate
because they are doing a good job for us, but it means that we
have to reallocate funds from something else that we serve our
public and our citizens which hinders us to do something good
for the city because we have to pay those extra wages.)

DIRECTION TO STAFF
FLEET LEASE TO PURCHASE OPTION

Matt Busby briefed the council on the item.
Fleet Services Supervisor
Brian Gleave briefed the council on the options for leasing the
white fleet and police department vehicles and the maintenance
costs involved.
Assistant City Manager Matt
Busby thanked Brian and Heather Hodgman for taking a deep dive
on this issue.He and Bryant are very comfortable with their
recommendation and think it is a good thing.It is not just
about getting new vehicles.They have driven in some of the
city's vehicles circa 1998.The fuel economy and less
maintenance will also bring savings.It will free up staff to
work on other vehicles that may be backlogged.It is also about
the safety of the employees.The newer vehicles have better
safety options and it is better for the employees to be in these
newer vehicles than the older ones.Those are just some of the
added benefits of going to this option.It allows us to replace
them faster.We probably have the ability in the current budget

constraints to replace maybe 6 or 7 vehicles and many of those
are usually police vehicles each year in our budget so we do not
get to some of our white fleet that he is referring to.He
added Donna Meinerts is in the audience to answer any questions,
along with Brian and Heather.
Councilmember Struble asked
what they can do with the vehicles.
Fleet Services Supervisor
Brian Gleave stated from the governmental side of it, it is
actually finances.There is no limit on what they can do to the
vehicle.They can mount anything they want on the vehicles.
They can put as many miles as they want to.At the end of five
years, they pay one dollar and the vehicle is 100% ours.
Councilmember Struble asked
if he is comfortable with the types of vehicles they are going
to get.They have everything they need.
Fleet Services Supervisor
Brian Gleave stated they have picked the vendors, several are on
state contract, which cover a wide range of what we currently
use.That is one of the reasons they picked that vendor.
Councilmember Struble asked
if that includes cars and trucks.

Brian Gleave stated they can purchase everything from a small
sedan clear up to an F550.
Assistant City Manager Matt
Busby stated with the direction to move forward with this
option, Bryant will probably be signing an application to Ford
Municipal Finance or whatever it is called.They would start
the next step in the approval process and start getting the
vehicles delivered.

ANNOUNCEMENT OF CURRENT EVENTS
Councilmember Rizzi announced Community Alliance Against Family
Abuse has doubled the number of people served this year with
their Holiday House.
Mayor Serdy announced the Veterans Center is having an open
house on Thursday from late morning to around 4 p.m.
Mayor Serdy announced the city employee breakfast was last week
and he thanked them for the incredible job done this year that
included the opening of Flatiron Park, the flooding earlier in
the year, illegal dumping, the new Fry's opening and the budget
seeming to go through smoother this year.
Councilmember Struble announced the city council will have their
own trivia contest team next year.

City Manager Bryant Powell commented on the finance department
winning the trivia contest, the city partnership with Arizona
State University, the State of the City event, Central Arizona
Association of Governments, Wendy's ribbon -cutting event and the
Arizona Department of Transportation round -about.
Assistant City Manager Matt Busby gave an update with the
monthly financial report.

Mr. Manjinder Singh, Phoenix,
addressed the council to comment he loves this city, used to own
a gas station here in 2007, they like the area and community and
would like to support it.
Mayor Serdy commented they
are glad to have them.He opened the public hearing on the
item.There being no one wishing to speak, he closed the public
hearing and reopened the item to council discussion.There
being no further discussion, he called for a motion.

SOFTWARE AND LICENSING AGREEMENT
WITH BOMT SYSTEMS LLC

Connelly briefed the council on the item.
Mayor Serdy commended City
Manager Bryant Powell and Assistant City Manager Matt Busby for
combining the work session and regular meetings so that staff
does not have to stay late for a short work session.It is good
to do it this way.He called for any questions.
Councilmember Evans asked if
we are positive our current equipment will handle this change
and the conversion without losing things because of what we went
through with the Arizona Department of Revenue saying they were
ready for this new software.
City Clerk Kathleen Connelly
stated that is correct.We would not move it to the new system
without preserving what we have.We would have some redundancy.
We still have the hard copies of things if we ever have to go in
that direction.IT is comfortable with it.She has to rely on
them as to their having the equipment and if they have any
issues with it.They are comfortable working with the people on
the other end.The big difference with this is that over the
years the department has worked with companies that are located
out of the country, in different time zones, and when they are
working on something like this and they are talking to someone
who is perhaps in India, it becomes very difficult.One of
these folks lives in Apache Junction and one in Mesa.They have
said that if there is a problem they will come here at whatever
time is necessary to offer support and make changes.
Councilmember Evans commented
in phase one it says something about under the application and

the existing businesses and licensing that their billing was
based on a forty -hour week for the entire amount.She asked who
came up with their being able to accomplish this in a one -week
time frame.Page one on their system says anything over forty
hours will be billed out at the hourly rate of $65 per hour.
City Clerk Kathleen Connelly
stated together they came up with their being able to do this in
forty hours.This did not just happen.This has been discussed
with other staff with the City of Mesa since February 2016.In
various stages they have been familiar with what we had on our
end, not just the tax licenses but the regular business
licenses.In looking at our data and working with Anne, this is
the amount of time they figured they needed.
Councilmember Evans commented
one of the reasons she asked that question was the figure for
$62,500.She is under the understanding that it will be a
$62,500 plus.
City Clerk Kathleen Connelly
stated if necessary.Originally this started off with a
ballpark figure of $30,000.The more they looked at what we
had, we have a large data base of historical data which is
critical, and the more customized we wanted, the figure grew.
We have no reason to believe that they will suddenly say they
have expended all of their time and they now have to do this
other stuff.
Councilmember Evans commented

stated that is correct.
Councilmember Evans asked if
there is money available in the budget if we go over the
$62,500.
City Clerk Kathleen Connelly
stated the $62,500 will take us to June 30, 2018, if it even
reaches the total amount by that time.We will have to budget
something in the fiscal year 2018-2019 budget.

that part will be covered.She asked if this parallels some of
the information we were trying to get out of the agreement we
made with the Department of Revenue when it took over.
City Clerk Kathleen Connelly
stated that is using information gotten from the Department of
Revenue.It will be taking the data from the licensing system
that just went into effect on December 1 and our historical
data, something that is already in the system, making it
operational, and taking some Department of Revenue information.
It will run parallel but they will not merge.
Councilmember Evans commented
she was trying to figure out if they would work together or
become a duplication.We would then not need to do this.
City Clerk Kathleen Connelly
stated it will not be a duplication.This will stand alone.We
will not be relying on something from the Phoenix BMI system for
anything in here.
Councilmember Barker asked if
the city would still be using the Phoenix system.
City Clerk Kathleen Connelly
stated that is different information.The Phoenix system looks
at taxpayers statewide.This is our licensing component.
Councilmember Barker
commented we will still be using the Phoenix system.We will
still be paying the fee to Arizona Department of Revenue.We
have to find $32,500 in the general fund to pay up to the
$65,000.
City Clerk Kathleen Connelly
stated that is correct.She has been assured by two people in
this room that it can be done.
City Manager Bryant Powell
stated he wanted to put this into perspective as well that they
studied out the alternatives.Some of the alternatives they
looked at were in the $200,000 to $500,000 range.Whenever he

talked to other cities and towns regarding tax mantra, from his
perspective, it is awesome to have someone that is next to us in
Mesa who knows our system and can get it going.And the bad
news, because of these changes, they will have to pay the
$30,000 and they have to pay now what was well under $100,000
will have to be budgeted for over $100,000 now.That is thanks
to our state legislature over that effort of changing the law to
not be able to have self -collection.
Mayor Serdy commented if one
talks to other sister cities they are all upset, also.
City Clerk Kathleen Connelly
stated if they are ever allowed to go back to self -collection
this will come in handy.
Councilmember Struble
commented he cannot say what he wants to say.The city manager
stated they will have to budget for 2018-2019.He asked if
there is any kind of idea what they will need.
City Clerk Kathleen Connelly
stated they will know a bit more when they get to the end of
this.What she believes will happen is what happens with any
new program.As they go through it they will find they should
have included something else or because they will be sending
information to development services, they may ask if there is
any chance they could also do something else for them.For
example, on the new business license application there are
references to home -based businesses.Last week they became
aware that a member of the legislature is looking to make
changes to home -based businesses so that would have to be
integrated into this.

this system is expandable to other departments.

stated that is the advantage of dealing with people who are
here.Their jurisdictions will be going through the same stuff
we are going through.

why they cannot have them do whatever they need to do so we can
tie it into the actual tax collection module for the state so
that we do not have to pay fees, any more money, if we are
already going to do this.He asked if the state is holding us
back from tying into it.

stated she is not sure if the state would allow something.
Councilmember Struble
commented they are already allowing Phoenix to do it.

stated they are doing that through a special intergovernmental
agreement.This would be just Apache Junction.

commented he understands that.He asked if there would be an
annual cost like every year they would have to budget $10,000 to
it.

stated if they continue to grow this there will be an ongoing
cost.

commented he is sure that when we get the accounting software
there will be an annual maintenance fee.

will be a lot more costly than this.

$50,000-$60,000.They are saving on the foreign country kind of
thing.

Busby stated Anne has an answer for the annual maintenance
stuff.
Senior Auditor Anne Wenk
stated it is a $5,000 per year maintenance cost.They do not
plan for it to fluctuate because they are trying to keep the
costs down for us seeing that we are a really small city.He
has written a program similar to this for the City of Mesa which
is why he knows approximately how much time each portion is
going to take.
Councilmember Evans asked if
the maintenance also includes any upgrades or revisions to the
system.
Senior Auditor Anne Wenk
stated any updates.
Councilmember Struble asked
about occurrence of use.

stated that is all included and they have promised that if we
need them, they are allowed to take time off at that moment
because we are working with Mesa, too.

commented he totally understands what they are trying to do with
this.It all makes sense.It just irritates him.

stated in a perfect world it would be good to have one system
but when you deal with the Department of Revenue.

commented he knows.We are mandated to do that and then we are
basically mandated to pay another $9,000 to Phoenix to get the
information out of the system that we should be getting for the
$78,000.

commented and they are shortchanging us on the money that they
are supposed to be reimbursing in the first place.He is just
ranting here.Now we have to spend this money as they are
probably not going to allow us to tie into the system for this
information that we need for the whole thing to work.He hopes
there are some legislators out there, specifically the ones that
work in our district, that are actually going to be watching
this session tonight and maybe get hold of the cities in this
state that are having to do this because we have some
legislators that are trying to balance the budget on our backs.

commented he was concerned about Mr. Schroeder getting a little
overextended as he is already on planning and zoning and is
interested in the sewer district.He reached out to Mr.
Tremonti who had shown some interest in being on the sewer
district board but something happened and he did not receive the
notification or did not feel whatever to do the interview.He
invited him here.He is here and is interested in the sewer
board.If the councilmembers have questions for him, he is
prepared to answer them.He thought it would be good for Mr.
Tremonti to come up and introduce himself.

asked if she could ask the city attorney a question.The agenda
is not worded to allow for the interview.

skill to have for the sewer district, his impressions of the

years assuming that the state allows the sale of the land south
of US 60.He is not terribly familiar with the wastewater
treatment process nor is he a customer of the district.In

Director Liz Langenbach briefed the council on the item.
Mayor Serdy asked if
everything is fine with the school intergovernmental agreement
and the sharing of it.He asked if it is all on the city.
Parks and Recreation Director
Liz Langenbach stated this portion is.The intergovernmental
agreement they have with the school district makes them
responsible for certain portions of that shared property and
this is not one of them.This is one of the things that is
highlighted in our maintenance.They have fulfilled their
obligations in renovating the tennis courts, adding pickle ball
lines which are something our community definitely benefits from
much more so than the students.They have fulfilled their
obligations out there.This is one of ours.
Councilmember Struble asked
what the life expectancy is on this.
Parks and Recreation Director
Liz Langenbach stated the current product lasted about 14 years
since its last renovation.This deck is easier to maintain and
could last longer.It has a longer warranty than the existing
one.We are way beyond our warranty on the current one.Our
parks division does an amazing job at doing a lot of preventive
maintenance.She believes it is probably within a 15- to 20-
year range before they would be replacing something like that.
Councilmember Struble asked
if she would be having a cannonball contest at the end of this.

PARK POOL DECK REFURBISHMENT BE AWARDED TO FLEXGROUND THROUGH
THE IGPA COOPERATIVE CONTRACT IN THE AMOUNT OF $241,207.41 PLUS
5% FOR CHANGE ORDERS IN THE AMOUNT OF $12,060.37 FOR A TOTAL
AMOUNT NOT TO EXCEED $253,267.78; AND THAT AUTHORIZATION BE
GIVEN FOR THE MAYOR TO SIGN THE CONTRACT.
