CALL TO ORDER Mayor Insalaco called the meeting to order at 7:00 p.m. INVOCATION Councilmember Rizzi gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Waldron led the Pledge of Allegiance. Councilmember Wilson SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS, PRESENTATIONS AND PROCLAMATIONS Mayor Insalaco read a proclamation designating October 16-22, 2016 as Arizona Cities and Towns Week and presented it to Public Information Officer Al Bravo. ANNOUNCEMENT OF CURRENT EVENTS Vice Mayor Barker announced she, Mayor Insalaco and Councilmember Serdy toured Gateway Airport.She and Councilmember Serdy climbed to the top of the control tower. Mayor Insalaco had previously been up there on an earlier tour. She commented it was incredible to watch the traffic controllers with their screens. Councilmember Serdy commented their view is dominated by the Superstition Mountains. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 2 OF 20 Councilmember Serdy commented this past weekend was the Superstition Mountain Promotional Club ranch rodeo.They did an awesome job.He would like to see it get bigger and bigger every year. Councilmember Wilson commented they actually have ranches participate with their ranch hands.It was very interesting to see. Vice Mayor Barker commented she was at the multi -generational center on the weekend for the Pretty in Pink Celebration.It was a Zumba thing and there were 50-100 in the gym moving their feet faster than anybody's ever allowed to move their feet.It was grand fun. CITY MANAGER'S REPORT City Manager Bryant Powell commented on how the city engages the residents through phone calls, emails, blogs, Facebook methods as well as regular methods.He read thank yous regarding tree clean up and the library.He showed shots from the new drone on the downtown park. Councilmember Rizzi asked if Matt McNulty received training in order to fly the drone. City Manager Bryant Powell stated he did get some training and he is a natural.It is a combination of having the talent to do it and the training.He does not know where he went for training but they have to follow all the Federal Aviation Administration rules.He also had to be licensed. Councilmember Rizzi commented it is an amazing opportunity to be able to market our community in a way that we have not been able to before.She just caught a glimpse of Superstition Mountain in the background.It is something they would not have had before. PUBLIC HEARINGS APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE FOR COMMUNITY ALLIANCE AGAINST FAMILY ABUSE REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 3 OF 20 )City Clerk Kathleen Connelly briefed the council on the item. Mayor Insalaco requested the applicant address the council. Ms. Dorian Townsend, executive director of Community Alliance Against Family Abuse addressed the council for any questions. Councilmember Rizzi asked what the theme would be.They are excited as to what it will be each year. Ms. Dorian Townsend stated they are continuing with the theme of Giddy Up Gala.They will have the cowboy dance, the Roadhouse Wranglers will again be performing and they are looking forward to a great barbecue dinner.They will also have a silent auction.For the first time they will have a wine pool and they will have a spinning wheel for different prizes.They will also have a special survivor story. Mayor Insalaco opened the public hearing on the item. Mr. Elliott Fisher, 547 E. Quail, Apache Junction, addressed the council.He asked if this is for item number 7. Councilmember Evans commented it is. Mr. Fisher stated he does not see how the two go together - liquor licenses and family abuse. One of the biggest problems in family abuse is substance abuse. It just seems kind of strange. Mayor Insalaco closed the public hearing with no one else wishing to speak.He reopened the item to council discussion.There being no further discussion, he called for a motion. Mayor Insalaco requested the applicant address the council. Mr. Len LaFlesch, 6568 E. Hacienda, Gold Canyon, addressed the council.They do this every year and he is asking for their approval to serve beer at the festival. Mayor Insalaco opened the public hearing on the item.There being no one wishing to speak, he closed the public hearing and reopened the item to council discussion.There being no further discussion, he called for a motion. APPLICATION FOR A PERSON TRANSFER, INDIVIDUAL, SERIES 6 LIQUOR LICENSE FOR SUPERSTITION SKIES BAR AND RESTAURANT )City Clerk Kathleen Connelly briefed the council on the item. Ms. Janet Sotomayor, 400 E. San Angelo, Gilbert, addressed the council.She stated she is working diligently right now to make Superstition Skies a shining star, the historic place it has always been. Mayor Insalaco commented he is glad she is bringing it back to where it was. Vice Mayor Barker commented it was nice to see her again. Mayor Insalaco opened the public hearing on the item. Mr. Elliott Fisher, 547 E. Quail, Apache Junction, addressed the council.He stated this is an appropriate place for a liquor license.It seems like over the last few years the liquor license applications have increased greatly.Maybe things have changed with state law. It is taking a lot of time on the agenda and maybe there is a faster way of getting the appropriate liquor licenses through without spending so much time at the council meeting. City Clerk Kathleen Connelly stated they are doing what is required by state law with regard to liquor licenses.The statute requires that the local governing body give approval or disapproval to these licenses. Mayor Insalaco closed the public hearing with no one else wishing to speak.He reopened the item to council discussion.There being no further discussion, he called for a motion. ORDINANCE NO. 1437, ADOPTING BY REFERENCE THE "CITY OF APACHE REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 7 OF 20 JUNCTION PERSONNEL RULES 2016" AND DECLARING AN EMERGENCY )City Attorney Joel Stern briefed the council on the item. Mayor Insalaco opened the public hearing on the item.There being no one wishing to speak, he closed the public hearing and reopened the item to council discussion.There being no further discussion, he called for a motion. Councilmember Waldron MOVED THAT ORDINANCE NO. 1437 BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilmember Rizzi SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathleen Connelly read the ordinance by title only with the emergency clause. Councilmember Waldron MOVED THAT ORDINANCE NO. 1437, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED. Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. ORDINANCE NO. 1438, REVISING CITY CODE SECTION 2-1-3 DUTIES OF OFFICE AND SECTION 2-3-1 PRIMARY ELECTION AND DECLARING AN EMERGENCY )City Attorney Joel Stern briefed the council on the item. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 8 OF 20 There was general discussion on the date of the swearing in ceremony in January 2017. Mayor Insalaco opened the public hearing on the item.There being no one wishing to speak, he closed the public hearing and reopened the item to council discussion.He asked if anyone had a date for the swearing in. The consensus for the swearing in date was January 3, 2016. Mayor Insalaco closed the discussion with no further comments and called for a motion. Vice Mayor Barker MOVED THAT ORDINANCE NO. 1438 BE READ TITLE ONLY WITH THE EMERGENCY CLAUSE AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilmember Rizzi SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathleen Connelly read the ordinance by title only with the emergency clause. Vice Mayor Barker MOVED THAT ORDINANCE NO. 1438, AS READ BY THE CITY CLERK AND INCLUDING THE DATE OF JANUARY 3, 2017 AS OUR FIRST SWEARING IN, BE APPROVED AND ADOPTED. Councilmember Wilson SECONDED THE MOTION. VOTE:Unanimous. The motion carried. OLD BUSINESS REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 9 OF 20 None. NEW BUSINESS None. DIRECTION TO STAFF PROPOSED GUIDELINES ON RECOGNITION FOR INDIVIDUALS/ORGANIZATIONS WHO PROVIDE MONETARY CONTRIBUTIONS TO THE CITY )Sponsorship/Partnership Programs Coordinator Roger Hacker briefed the council on the item.He asked if anyone would like changes to the recommendation of a donation from $250 to $500 receiving a group photo and their name read during the council meeting and a donation of $501 to $999 receiving an individual photo with the mayor and their name read during a council meeting. Councilmember Serdy commented he would like to see an opening for something smaller.They can go with this recommendation but if the mayor or any councilmember knows of a little group or someone that is donating something from the heart, like a cub scout troop that donates $80, that means more than a major corporation giving $2,000.He would like the discretion for anybody to present it if they work that hard on it.They could do that at will if they need to do it. Councilmember Rizzi commented she thought it was a good idea. Mayor Insalaco agreed.He had said that in the meeting.They will have some people in that category.It is not so much the dollar sign as it is who is giving it, how their giving it and why they are giving it. Councilmember Evans asked if they were saying below $500 or are they saying the $250 to $500. Councilmember Serdy commented it is not.It is if it is something special. Councilmember Wilson commented they can leave it at that, but he agrees whole- heartedly because they have smaller groups that really work hard to donate for a specific cause.If a councilmember or the mayor or even the public information officer says they worked real hard and need to be recognized there should be something. Councilmember Serdy commented sometimes it might not even be money.It could be just work. Vice Mayor Barker commented what they are really talking about is the recognition of a group and since this deals with either groups or individuals they could just put a group category in there. Mayor Insalaco commented it would be like she said, a special group. Councilmember Serdy commented it may not even be money.It could be just an effort like a clean up or something, like someone saw a fire and they saved the house. Councilmember Rizzi commented they just need to add a category. Sponsorship/Partnership Programs Coordinator Roger Hacker stated he would try to summarize that.It would be a discretionary category for the elected officials if they are aware of a group that has made a contribution to the community, be it cash, in -kind or service. The consensus of the council was that was correct. Sponsorship/Partnership Programs Coordinator Roger Hacker continued with his briefing. He asked if they had addressed the suggestion of flexibility and the amount of donation receiving a ceremonial check. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 11 OF 20 Vice Mayor Barker asked who brought it up and explain why. Sponsorship/Partnership Programs Coordinator Roger Hacker stated he believed Councilmember Serdy brought it up. Vice Mayor Barker asked why. Councilmember Serdy asked what the question was. Sponsorship/Partnership Programs Coordinator Roger Hacker stated on October 3 Councilmember Serdy commented there might be a group making a donation from the heart that has worked hard to make that donation and they do not make the $2,500 limit for a ceremonial check at a council meeting.Councilmember Serdy suggested some discretionary latitude that if there is such a group and it is brought up by a councilmember that there could be a ceremonial check made for a group if they give less than $2,500. Councilmember Serdy commented that is kind of going on what they were just talking about with the last time.He hates to see efforts not go rewarded. Councilmember Rizzi commented her only question is how would they decide who gets that check and who does not. Mayor Insalaco commented the ceremonial check runs about $35 to make. Sponsorship/Partnership Programs Coordinator Roger Hacker stated that is correct. Mayor Insalaco commented if someone donates $100 to whatever and they are given a ceremonial check worth $35 it kind of defeats their purpose. Councilmember Serdy commented just let them donate the real check.He asked why it would have to be a ceremonial check. Councilmember Serdy commented again they can give them the real check.It looks like it is not that important. Vice Mayor Barker commented it kind of defeats the purpose there.She thinks they can honor those smaller groups or those who do a fantastic service like volunteering to clear out the wash which is going to take a tremendous amount of work.If one of the scouting groups or one of the other groups in town digs in and does their thing, it may not be monetary but it certainly is a service to the community. She thinks they covered that earlier in the first page. City Manager Bryant Powell stated he agreed that it was in the earlier discussion, whether it is a monetary check or a formal thing.That exemption from the beginning will provide more flexibility.They could do something different instead of the big check. Sponsorship/Partnership Programs Coordinator Roger Hacker asked if their concern about immediate recognition has been addressed by their previous comments. Vice Mayor Barker commented she thought so.As a donor they do not need immediate recognition.It is kind of neat that Friends wants to put on two events a year and all the people who have been so kind to donate to the area will be invited that. Sponsorship/Partnership Programs Coordinator Roger Hacker stated their concern about the immediacy of recognition has been addressed by what they added earlier. Councilmember Rizzi commented she thought they had touched it all. Councilmember Wilson commented they are recognizing different people and different REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 13 OF 20 groups that have donated but they are also basically letting the community know that these activities and things that they are trying to accomplish are being done outside of the tax dollars. They need to make sure they are putting that information out and tell the people that the community is stepping forward to take these things on instead of tax dollars. Vice Mayor Barker asked if he thought once every quarter is enough for that type of reminder. After a while people pay no attention to it if they put it out on a weekly basis. Councilmember Wilson commented he did not mean that.He just wanted to make sure they are not looking at the aspect of going to twice a year. Vice Mayor Barker commented they would be doing it quarterly at council meetings. Councilmember Wilson commented he had heard twice a year from the Friends and he immediately kicked in on that.They need to make sure they are being recognized and that they are doing these things and they are being done because the community is stepping forward.We have a great community and he wants to make sure that the community knows that we, as a city, appreciate them doing it. Sponsorship/Partnership Programs Coordinator Roger Hacker stated he obviously was not clear.Friends is offering to host a party twice a year for donors. Vice Mayor Barker commented the quarterly council meeting recognition is still a part of this. Councilmember Wilson commented he misunderstood. Sponsorship/Partnership Programs Coordinator Roger Hacker stated Councilmember Wilson is talking about the three themes that came out of the committee. They are doing things with private dollars, not tax dollars. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 14 OF 20 The donation is making an impact on the community.And we live in the very generous community of Apache Junction and Gold Canyon.Those are obvious things that will be carried through as everything gets done.He is sensing they are okay with this and he will move on. Councilmember Wilson commented now that he is clear with everything he may. Sponsorship/Partnership Programs Coordinator Roger Hacker stated there was a suggestion of a thank you note to be signed by councilmembers.He asked if they want to have it as just a thank you or a thank you and inviting them as a guest at a future council meeting.He asked if they want to go ahead with the thank you notes. Mayor Insalaco commented that answers everything right there. Vice Mayor Barker commented she would like the second one.It is the key if they are going to do quarterly meetings.They can put the date on it.The council can be given "x" number of cards and they can get them signed.He will then have them and put the appropriate date on them. Sponsorship/Partnership Programs Coordinator Roger Hacker asked if that was acceptable to everyone. Councilmember Waldron commented it gives a group the chance to schedule the appearance. Councilmember Rizzi commented she feels it is important to add that personal touch.She thinks it makes a difference.She believes that was Gail's suggestion and she thinks it is important to add that. The council consensus was they are comfortable. City Clerk Kathleen Connelly stated that is more a question for the city attorney.She stated if it is not a gift.The postage would need to be reimbursed but there would be staff time involved. City Attorney Joel Stern stated it is probably not a gift since the Friends are a 501C(3).He thinks they are okay. Sponsorship/Partnership Programs Coordinator Roger Hacker stated these are suggestions that he does not think need to be included in the action on the first week.He can just implement these on his own. Councilmember Wilson SECONDED THE MOTION. VOTE:Unanimous. The motion carried. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES Vice Mayor Barker MOVED THAT AN EXECUTIVE SESSION AT 5:45 P.M. AND A WORK SESSION AT 7:00 P.M. BE HELD ON MONDAY, OCTOBER 31, 2016, IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY; AND THAT AN EXECUTIVE SESSION AT 5:45 P.M. BE HELD ON TUESDAY, NOVEMBER 1, 2016, IN THE CITY COUNCIL CONFERENCE ROOM. Councilmember Rizzi SECONDED THE MOTION. VOTE:Unanimous. The motion carried. CALL TO THE PUBLIC Ms. Dorian Townsend, 185 N. Apache Trail #1, Apache Junction, Community Alliance Against Family Abuse, addressed the council regarding services for the homeless and the hardof hearing. She also requested everyone wear purple on October 20 to support domestic violence awareness. Mr. Darryl Cross, 1018 N. Acacia, Apache Junction, addressed the council regarding the effects of oleander on horses and REGULAR -MEETING OF THE CITY COUNCIL OCTOBER 18, 2016 PAGE 17 OF 20 requested an ordinance to prevent oleander from encroaching onto a neighboring property and that no new plants be planted in equine areas. Mr. Elliott Fisher, 547 E. Quail, Apache Junction, addressed the council regarding his case on the improper filing of his candidate papers and a request from the city attorney to drop the case. Mr. Thomas Aulik, 503 E. Montebello, Apache Junction, addressed the council regarding the late fees he has to pay for the water district due to the timing of the billing. Vice Mayor Barker requested the city manager look into the oleander issue.It sounds like a reasonable request. City Manager Bryant Powell stated they certainly can. Vice Mayor Barker commented the water, district is not the city council..He would have to speak to the water.district board for that request. Councilmember Waldron asked if he could make a comment.He commented it is just a thank you he wanted to make. City Attorney Joel Stern stated he could if it is in response to criticism. Councilmember Waldron commented he wanted to give a shout out to the Friends of Apache Junction because the Veterans Center was a victim of a burglary and they lost electronic equipment.They gave a $500 donation to help replace the equipment.
