HomeMy WebLinkAbout2016-01-05 City Council Regular MinutesCITY COUNCIL REGULAR MEETING JANUARY 5, 2016 The regular meeting of the City Council of the City of Apache Junction, Arizona, was held on January 5, 2016, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Insalaco called the meeting to order at 7:00 p.m. INVOCATION Councilmember Wilson gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Evans led the Pledge of Allegiance. ROLL CALL Councilmembers Present:Mayor Insalaco Councilmember Evans Councilmember Rizzi Councilmember Serdy Councilmember Waldron Councilmember Wilson Staff Present: (Vice Mayor Barker was absent.) Councilmember Evans SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS, PRESENTATIONS AND PROCLAMATIONS Mayor Insalaco read a proclamation designating January 20, 2016 as Arizona Winter Visitors' Day and presented it to Judy of the Arizona Winter Residents Association. ANNOUNCEMENT OF CURRENT EVENTS Councilmember Rizzi commented Recreation Superintendent Liz Langenbach, City Manager Bryant Powell and she met with some hot air balloon pilots last spring to bring some type of balloon festival to the city.They had their first balloon glow at the winter festival.They are hoping to have more in the future, including a hot air balloon event. CITY MANAGER'S REPORT City Manager Bryant Powell commented on the work of Detective Garcia on the Vehicle Theft Task Force, a new program at Paws and Claws, showed a news video on Paws and Claws and advised they moved the date back on the boards and commissions recognition dinner. PUBLIC HEARINGS None. OLD BUSINESS None. NEW BUSINESS REGULAR MEETING OF THE CITY COUNCIL JANUARY 5, 2016 PAGE 2 OF 6 RESOLUTION NO. 16-01, AUTHORIZING THE EXECUTION AND ADOPTION OF THE FIRST AMENDMENT TO THE AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT FOR PLAN, DESIGN, CONSTRUCT, OPERATE, MAINTAIN AND FINANCE THE TOPAZ REGIONAL WIRELESS COOPERATIVE NETWORK briefed the council on the item. Captain Arnold Freeman Mayor Insalaco called for any discussion.There being no discussion, he called for a motion. Councilmember Waldron MOVED THAT RESOLUTION NO. 16-01, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING EXECUTION AND ADOPTION OF THE FIRST AMENDMENT TO THE AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT TO PLAN, DESIGN, CONSTRUCT, OPERATE, MAINTAIN AND FINANCE THE TOPAZ REGIONAL WIRELESS COOPERATIVE ("TRWC") NETWORK, BE APPROVED. Councilmember Serdy SECONDED THE MOTION. VOTE":Unanimous_ The motion carried'. DIRECTION TO STAFF PROPOSED ORDINANCE NO. 1422, AMENDING CHAPTER 4 FEES,BY REPEALING ARTICLE 4-4,PLANNING, ZONING REVIEW AND SUBDIVISION FEES,SECTION 4-4-10 PLANNING AND ZONING FEES IN ITS ENTIRETY; ADOPTING NEW PROVISIONS TO REPLACE THOSE NOTED ABOVE; ESTABLISHING AN EFFECTIVE DATE AND A REVOLVING SIXTY MONTH REVIEW PERIOD REGULAR MEETING OF THE CITY COUNCIL JANUARY 5, 2016 PAGE 3 OF 6 ) Development Services Director Larry Kirch briefed the council on the item. Mayor Insalaco called for any discussion.There being no discussion, he called for a motion. Councilmember Waldron MOVED THAT THE FOLLOWING DIRECTION BE GIVEN TO STAFF REGARDING PROPOSED ORDINANCE NO. 1422, REPEALING EXISTING AND ADOPTING NEW PLANNING ADMINISTRATIVE FEES:THAT STAFF PRESENT A FINAL PROPOSED ORDINANCE BASED ON THE DRAFT DATED JANUARY 5, 2016 INCLUDING ANY CHANGES DEEMED NECESSARY BY THE CITY ATTORNEY AND BRING IT BACK FOR A PUBLIC HEARING AND VOTE ON MARCH 15, 2016. I FURTHER MOVE THAT STAFF TAKE ALL NECESSARY ACTIONS TO MEET THE LEGAL REQUIREMENTS SET FORTH IN STATE LAW REGARDING NOTIFICATION OF THIS PENDING ACTION. Councilmember Rizzi SECONDED THE MOTION. VOTE:Unanimous. The motion carried: SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES Councilmember Waldron commented the executive session and work session scheduled for Monday, January 18, 2016 have been cancelled due to Martin Luther King, Jr. Day.He MOVED THAT AN EXECUTIVE SESSION AT 5:45 P.M. AND A WORK SESSION AT 7:00 P.M. BE HELD ON TUESDAY, JANUARY 19, 2016, IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY. Councilmember Rizzi SECONDED THE MOTION. VOTE:Unanimous. (During the vote Councilmember Wilson and City Clerk Kathleen Connelly discussed the reason for the motion including the work session.) REGULAR MEETING OF THE CITY COUNCIL JANUARY 5, 2016 PAGE 4 OF 6 The motion carried. CALL TO THE PUBLIC Mr. Terry Dunn, 234 S. Starr Road, Apache Junction, addressed the council to compliment the city for the fire apparatus obtained by the fire district and asked if there is a city ordinance on drones regarding a private individual going over a neighbor's yard to document violations for code compliance. City Attorney Joel Stern stated they cannot talk about it here but they can direct staff to look into it. Councilmember Waldron directed the city attorney to look into it as it is becoming a major issue.It involves the Federal Aviation Administration and it has to be licensed. Councilmember Serdy asked if they can make statements about it. City Attorney Joel Stern stated they can reply to what the gentleman said but they cannot discuss it amongst themselves. Councilmember Serdy commented to his knowledge Paradise Valley is the only one that has an ordinance and they outlawed them period.
